HomeMy WebLinkAboutORDINANCES-1998-015-O-98• 2/2/98 15-0-98 AN ORDINANCE Amending Section 9-5-23(D) of the Evanston City Code Regulating the Use of Leaf Blowers BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF EVANSTON, COOK COUNTY, ILLINOIS: SECTION 1: That Section 9-5-23(D) of the City Code of Evanston, 1979, as amended, be and is further amended by adding an additional subparagraph (D)(4): 9-5-23: NOISES PROHIBITED: It shall be unlawful for any person within the City to make, continue or cause to be made or continued, any loud, unnecessary or unusual noise which either annoys, disturbs, injures or endangers the comfort, repose, convenience, health, peace or safety of others, • within the limits of the City. The following acts, among others, are declared to be loud, disturbing and unnecessary noises in violation of this Section, but this enumeration shall not be deemed to be exclusive, namely: (D) 1. Drums: The use within the City of any drum or other instrument or device for the purpose of attracting attention, by the creation of noise, to any place of business or entertainment or place of public assembly. 2. Pile Drivers, Hammers: The operation within the City between the hours of nine o'clock (9:00) P.M. and seven o'clock (7:00) A.M. of any pile driver, steam shovel, pneumatic hammer, derrick, steam or electric hoist, or other appliance, the use of which is attended by loud or unusual noises. 3. Blowers: The operation within the City of noise -creating blower or power fan or any internal combustion engine, the operation of which causes noise due to the explosion of operating gases or fluids, unless the noise from such blower or fan is muffled and such engine is equipped with a muffler device to deaden such noise. 0 15-0-98 • 4. Leaf Blowers: The use of any backpack -mounted or hand-held gasoline - powered leaf blower type of machine at any time between .May 15th and September 30, and between December 15th and March 30th of each year and at other times of the year between 9:00 P.M. and 7:00 A.M. on weekdays, 5:00 P.M. and 9:00 A.M. on Saturdays and Sundays. On Sundays a permit from the City Manager or his/her designee is required for commercial use only. Any person, firm or corporation who violates this subparagraph (4) shall be fined not less than $25 for a first offense and not less than $100 for any subsequent offense within one year. SECTION 2: All ordinances or parts of ordinances in conflict herewith are hereby repealed. SECTION 3: This ordinance shall be in full force and effect from and after its passage, approval, and publication in the manner provided by law.
