AN ORDINANCE
Adopting The City of Evanston's
Code of Ethics
WHEREAS, 5 ILCS 425/83 requires units of local government to prohibit the solicitation
and acceptance of gifts in a manner substantially in accordance with the requirements of the _ _
ILLINOIS STATE GIFT BAN ACT (5 ILCS 415/1 et seq; Public Act 90-737);
WHEREAS, state law requires townships to appoint their own Ethics Commission or
enter into an intergovernmental agreement to provide for such a commission; and
WHEREAS, pursuant to the Intergovernmental Cooperation Act, 5 ILCS 220/3, Evanston
• Township and the City of Evanston may and desire to enter into an Intergovernmental
Agreement providing for compliance with the State Gift Ban Act;
NOW THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE TOWN
OF EVANSTON, COOK COUNTY, ILLINOIS: _
SECTION 1: That the Evanston Township Board adopts by reference Chapter 10 of
Title 1 of the Evanston City Code and all amendments thereto, pertaining to the Board of
Ethics, Code of Ethics and adoption of the State Gift Ban Act. A copy of the Intergovernmental
Agreement between Evanston Township and the City of Evanston is attached as Exhibit A and
made a part hereof.
SECTION 2: ETHICS OFFICER. That an Ethics Officer shall be appointed. The Ethics
• Officer shall review economic interest statements, provide guidance on the interpretation of

the Act and provide guidance on the implementation of the Act. 5 ILCS 425/35. The Ethics
Officer shall serve until he/she resigns or is replaced by majority vote of the Township Board. •
SECTION 3: That all ordinances or parts of ordinances in conflict herewith are hereby
repealed.
SECTION 4: That this ordinance shall be in;full force and effect from and after its
passage, approval, and publication in the manner provided by law.

• EXHIBIT A
INTERGOVERNMENTAL AGREEMENT BETWEEN
THE CITY OF EVANSTON AND EVANSTON TOWNSHIP
This Intergovernmental Agreement ("Agreement") is made as of this day of
L' Ac �e/' 1999, by and between the CITY OF EVANSTON, ("City") an Illinois
municipal corporation ("City"), and the EVANSTON TOWNSHIP, ("Township"),
WHEREAS, 5 ILCS 425/83 requires units of local government to prohibit the solicitation
and acceptance of gifts in a manner substantially in accordance with the requirements of the
ILLINOIS STATE GIFT BAN ACT (5 ILCS 415/1 et seq; Public Act 90-737); and
WHEREAS, state law requires townships to appoint their own Ethics Commission or
enter into an intergovernmental agreement to provide for such a commission; and
• WHEREAS, pursuant to the Intergovernmental Cooperation Act, 5 ILCS 220/3, Evanston

Township and the City of Evanston may enter into an Intergovernmental Agreement providing
for compliance with the State Gift Ban Act;
NOW THEREFORE, the parties hereto, in consideration of the mutual covenants
hereinafter contained agree as follows: - - - - --
1. That Evanston Township will adopt by reference Chapter 10 of Title 1 of
Evanston City Code pertaining to the Board of Ethics, the Code of Ethics and the adoption of
the State Gift Ban Act.
2. That the Board of Trustees of Evanston Township will appoint its own Ethics
Offycer.
3. That the Board of Ethics for the City will serve as the Ethics Commission for the
Township, as well as the City.

IN WITNESS WHEREOF, the City of Evanston and Evanston Township have caused this
Agreement to be executed, as of the date first set forth above, by their duly authorized officers.
