HomeMy WebLinkAboutORDINANCES-1999-086-O-99• 05/26/99, 06/8/99, 07/16/99 86-0-99 AN ORDINANCE Amending the Zoning Ordinance to -- Add a Definition of "Music Venue" to List Same as a Special Use in Certain Zoning Districts, and Making Related Amendments WHEREAS, the Plan Commission held a public hearing on May 12, 1999 pursuant to proper notice in case no. ZPC 99-4-T(R) a petition to amend Section 6-18-3 of the Zoning Ordinance to add a definition of "music venue" and to add same as a special use or permitted use in appropriate Zoning Districts; and WHEREAS, based upon the record, the Plan Commission made written findings of fact and recommended that the City Council approve the amendment of 6- 18-3 with a definition of "music venue, live", an amendment to the definition of "cultural facility," and the addition of "music venue" to the listed special uses in the B1, B2, B3, C1, C1 a, C2, D1, D2, D3, D4, RP, 01, U1, U2, and U3 Zoning Districts, said amendments having met the standards for text amendments set forth in Section 6-3-4-5 of the Zoning Ordinance; and WHEREAS, the Planning and Development Committee of the City Council considered the proposed amendment and recommended City Council approval thereof with revisions, NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF EVANSTON, COOK COUNTY, ILLINOIS: N 1 M • SECTION 1: That the City Council hereby adopts the findings and recommendation of the Plan Commission and the recommendation of the Planning and Development Committee in the aforedescribed case number ZPC 99-4T(R), and the text of the Zoning Ordinance is hereby amended as more specifically set forth below. SECTION 2: That Section 6-18-3 of the Zoning Ordinance, "Definitions", is revised by amending the definition of "cultural facility" and by adding a definition of "music venue, live" in appropriate alphabetical order: 6-18-3 CULTURAL An indoor theater, auditorium, or other building or structure FACILITY designed, intended, or used primarily for musical, dance, dramatic, or other performances, or a library, museum or • gallery operated primarily for the display, rather than the sale, of works of art. A "Cultural Facility" does not include a "Live Music Venue." MUSIC VENUE A commercial land use in which the principal activity is the LIVE provision of live entertainment in a non -theatrical setting without a theatrical stage other than a raised platform and/or without fixed seating. A Live Music Venue may or may not, subject to all applicable legislation, include the service of alcoholic liquor, and may or may not allow dancing. A Live Music Venue is not an establishment in which the principal use is the service of prepared food and beverages and in which the land user provides live entertainment as an accessory or incidental to the service of prepared food and beverages, nor is a LIVE MUSIC VENUE a cultural facility in which musical entertainment is provided in a theatrical setting or with fixed seating. SECTION 3: That the following sections of the Zoning Ordinance be amended to • add the use category of "live music venue" to the list of special uses permitted in the listed zoning districts: E • 6-11-3-4, D2 Downtown Retail Core District 6-11-4-3, D3 Downtown Core Development 6-11-5-3, D4 Downtown Transition 6-12-2-3, RP Research Park District SECTION 4: That Chapter 16 of the Zoning Ordinance, "Off -Street Parking and Loading", is hereby amended at Section 6-16-3-5, Table 168, to add "music venue, live" under Culture/Entertainment, after Cultural Facilities (not including College/University Facilities) and before Swimming Pool or Skating Rink: LIVE MUSIC VENUE One space for every 250 square feet of gross floor area devoted to non -seated assembly. SECTION 5: That Chapter 16, Section 6-16-3-5 is further amended at Table 16E to read as follows: • Auditoriums, Cultural and Conference Facilities and Live Music Venue 10,000 - 20,000 One Short 20,001 - 100,000 One Long each additional 100,000 One Long SECTION 6: That all ordinances or parts of ordinances in conflict herewith are hereby repealed. SECTION 7: That this ordinance shall be in full force and effect from and after its passage, approval, and publication in the manner provided by law.
