HomeMy WebLinkAboutORDINANCES-1999-027-O-99�-J 6/8/99, 9/1/99, 9/17/99, 12/01/99 12/7/99, 1 /28/00 27-0-99 AN ORDINANCE CREATING A NEW TITLE 9, CHAPTER 3 OF THE CITY CODE REGARDING POWERS AND JURISDICTION OF CAMPUS POLICE WHEREAS, the Private College Campus Police Act ("PCCPA") 110 ILCS 1020, provides that Board of Trustees of a private university may establish campus police departments and may appoint persons to be members of such departments, and WHEREAS, the PCCPA requires that persons appointed members of private campus police departments shall, prior to appointment, complete the training in basic law enforcement and firearms provided for in section 110 ILCS 1020/1; and WHEREAS, the PCCPA grants members of private campus police departments the powers of municipal police officers, including the power to make arrests under the circumstances provided in 725 ILCS 5/107-2 of the Illinois Code of Criminal Procedure, for violations of state statutes, municipal or county ordinances; and WHEREAS, the aforesaid grant of powers is subject to the limitations that campus police have no authority to serve civil process and that the powers granted may be exercised only on university property, for the protection of students, employees, visitors and their property, and the property of the university, unless otherwise authorized by a 10 county or municipality; and 27-0-99 WHEREAS, the PCCPA us requires that uniforms, vehicles and badges of cam q 9 P police officers shall be distinctive from those of the local law enforcement agency where the campus is located; and WHEREAS, Northwestern University is a private university which has established a campus police department; and WHEREAS, all members of the Northwestern University Campus Police Department have completed the training required of them by 110 ILCS 1020/1 prior to their appointment; and WHEREAS, Northwestern University and the Evanston Police Chief have requested the City Council to authorize the expansion of powers of members of the Northwestern University Campus Police Department beyond the territorial and other limitations imposed by the PCCPA; and WHEREAS, said expansion is mutually agreeable between the City and Northwestern University, NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF EVANSTON, COOK COUNTY, ILLINOIS: SECTION 1: That the Evanston City Code of 1979, as amended, be, and it hereby is, further amended, by deleting existing Title 9, Chapter 3, and substituting therefor, a new Title 9, Chapter 3, to read as follows: 9-3-1: RECITALS FOUND AS FACT: That the City Council hereby finds as fact the foregoing recitals and incorporates them herein. • 2 27-0-99 9-3-2: NORTHWESTERN UNIVERSITY PROPERTY DEFINED: For purposes of the grant of authority by this Title 9, Chapter 3 to members of the Northwestern University Campus Police Department to exercise their powers beyond university property for the protection of students, employees, visitors, and their property, and the property of the University. "Northwestern University Property" shall be defined, as set forth in Exhibit A, attached hereto and made a part hereof. 9-3-3: CAMPUS POLICE AUTHORITY: a. All campus police officers appointed to be members of the Northwestern University Campus Police Department pursuant to the provisions of 110 ILCS 1020/1, as amended, shall have the powers of municipal peace officers within the area (See Exhibit B) bounded by the City limit to the north, Davis Street to the south, Lake Michigan to the east, and the west boundary being as follows: Ridge from Davis to Emerson; Emerson from Ridge to Maple, Maple from Emerson to Foster, Foster from Maple to Sherman, Sherman from Foster to Noyes, Noyes from Ridge to Sherman, Ridge from Simpson to Noyes, Simpson from Ridge to Green Bay, Green Bay from Simpson to City Limits; provided, however, that within these boundaries, the City of Evanston Police Department shall have exclusive jurisdiction for death investigations. Notwithstanding any other provisions of this Ordinance, campus police shall have no authority to serve civil process. Northwestern University Police will only have police authority pursuant to 110 ILCS 1020/1 beyond their property if the agreement in section 9-3-6 exists. b. The Northwestern University Campus Police Department may render such assistance to the Evanston Police Department as the Chief of the Evanston Police Department or his designee deems necessary or appropriate in any area(s) of the City beyond the boundaries set forth in section 9-3-3(a). When providing such assistance, Northwestern University Campus Police Department Officers appointed pursuant to 110 ILCS 1020/1, as amended, shall have the powers of municipal peace officers. 9-3-4: CITY NOT LIABLE: As a condition of the grant of authority in section 9-3-3, Northwestern University shall indemnify and hold harmless the City, from all claims for damages, costs, or expenses against the City arising out of or in connection with the activities of members of its campus police department. Northwestern University shall annually provide the City Manager with a certificate of insurance acceptable to the City evidencing liability coverage in the amount of three million dollars insuring activities by its campus police officers and naming the City as additional insured. 9-3-5: As a further condition to the grant of authority in section 9-3-3, the uniforms, vehicles, and badges of members of the Northwestern University Campus Police Department shall be distinctive, in the City's sole judgment, from those of City of Evanston police officers. 3 27-0-99 9-3-6: COOPERATIVE AGREEMENTS: The Chief of Police shall have authority to negotiate a cooperative agreement with the Northwestern University Campus Police Department for law enforcement functions pursuant to this Chapter 3. Such agreement shall be in writing and shall be subject to the annual review and approval of the City Council. The agreement may not be modified nor modifications implemented without the prior review and approval of the City Council. SECTION 2: All ordinances or parts of ordinances in conflict herewith are hereby repealed.
