AN ORDINANCE
Amending Title 3, Chapter 5 of the City Code
To Allow Sale By Class G, H, N, 0, and S Licensees
of Alcoholic Liquor, Beer, and Wine in Original Packages
Beginning at 8:00 am on Certain Holidays
WHEREAS, the Liquor Commissioner of the City of Evanston has determined
that allowing Class G, Class H, Class N, Class O, and Class S liquor licensees to sell
alcoholic liquor, beer, and wine at retail in original packages for consumption off the
premises where sold after the hour of 8:00 am at certain holiday times is in the best
interests of the citizens of Evanston; and
• WHEREAS, the City Council hereby adopts the determination of the Liquor
Commissioner and finds that such sales are appropriate,
NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF EVANSTON, COOK COUNTY, ILLINOIS:
SECTION 1: That Subsection 3-5-6(G)(3) of the City Code of the City of Evanston
of 1979, as amended, is hereby further amended to read as follows, with Section 3-5-6(G)
otherwise unchanged:
Section 3-5-6(G)(3)(A)
3a. Except as provided in subsection 3-5-6(G)(3)(b), it shall be unlawful for the holder of
a Class G license to offer for sale at retail any alcoholic liquor in original packages for
consumption off the premises where sold before the hour of ten o'clock (10:00) A.M. or
after the hour of ten o'clock (10:00) P.M. Monday through Thursday; before the hour of ten
o'clock (10:00) A.M. or after the hour of eleven o'clock (11:00) P.M. Friday and Saturday;
• and before the hour of twelve o'clock (12:00) noon or after the hour of ten o'clock (10:00)
P.M. on Sunday.

3b. On the days set forth in this Subsection 3-5-6(G)(3)(b), the sale of alcoholic liquor at •
retail pursuant to the Class_ G license may begin after eight o'clock (8:00) A.M. On these
days, alcoholic liquor shall not be sold after the hour of ten o'clock (10:00) P.M.

The total number of Class G and Class H licenses in force at any one time shall not exceed
two (2). (Ord. 73-0-94)
SECTION 2: That Subsection 3-5-6(H)(4), as amended, is hereby further
amended to read as follows, with Section 3-5-6(H) otherwise unchanged.
4a. Except as provided in subsection 3-5-6(H)4(b), it shall be unlawful for the holder of a
Class H license to offer for sale at retail any alcoholic liquor in original packages for
consumption off the premises where sold before the hour of ten o' clock (10:00) A.M. or
after the hour of ten o'clock (10:00) P.M. on Monday through Thursday; before the hour of
ten o'clock (10:00) A.M. or after the hour of eleven o'clock (10:00) P.M. Friday and
Saturday; and before the hour of twelve o'clock (12:00) noon and after the hour of ten o'
clock (10:00) P.M. on Sunday. (Ord. 68-9-97).
b. On the days set forth in this Subsection 3-5-6(H)(4)(b), the sale of alcoholic liquor at
retail pursuant to the Class H liquor license may begin after eight o'clock (8:00) A.M. On
these days, alcoholic liquor shall not be sold after the hour of ten o'clock (10:00) P.M.

• SECTION 3: That Subsection 3-5-6(N), as amended, is hereby further
amended to read as follows, with Section 3-5-6(N) otherwise unchanged:
Section 3-5-6(N)(6)
6a. Except as provided in Subsection 3-5-6(N)(6)(b), it shall be unlawful for the holder of
a Class N license to offer for sale at the licensed premises requiring membership, alcoholic
liquor in original packages for consumption off the premises where sold before the hour of
eleven o'clock (11:00) A.M. and after the hour of ten o'clock (10:00) P.M. on Monday
through Saturday; and before the hour of twelve o'clock (12:00) noon and after the hour
of ten o'clock (10:00) P.M. on Sundays.
b. On the days set forth in this Subsection 3-5-6(N)(6)(b), the sale of alcoholic liquor at
retail pursuant to the Class N license may begin after eight o'clock (8:00) A.M. On these
days, alcoholic liquor shall not be sold after the hour of ten o'clock (10:00) P.M.

SECTION 4: That Subsection 3-5-6(0)(5) as amended, is hereby further
amended to read as follows, with Section 3-5-6(0) otherwise unchanged 3-5-6(0)(5)(a).
5a. Except as provided in subsection 3-5-6(0)(5)(b), it shall be unlawful for the holder of
a Class O license to offer for sale at the licensed premises requiring membership, warm
beer and wine in original packages for consumption off the premises where sold before the
hour of eleven o'clock (11:00) A.M. or after the hour of ten o'clock (10:00) P.M. on Monday
through Saturday; and before the hour of twelve o'clock (12:00) noon and after the hour
of ten o'clock (10:00) P.M. on Sundays.
b. On the days set forth in this Subsection 3-5-6(0)(5)(b), the sale of warm beer and wine
at retail pursuant to the Class O license may begin after eight o'clock (8:00) A.M. On these
days, warm beer and wine shall not be sold after the hour of ten o'clock (10:00) P.M.

SECTION 5: That Subsection 3-5-6(S)(5) as amended, is hereby further
amended to read as follows, with Section 3-5-6(S) otherwise unchanged 3-5-6(0)(5)(a).
5a. Except as provided in Subsection 3-5-6(S)(5)(b), it shall be unlawful for the holder of
a Class S license to offer for sale at any wine in original packages for consumption off the
premises where sold before the hour of ten o'clock (10:00) A.M. or after the hour of ten
o'clock (10:00) P.M. on Monday through Thursday; and before the hour of ten o'clock
(10:00) am or after the hour of eleven o'clock (11:00) A.M. Friday and Saturday; before the
hour of twelve o'clock (12:00) noon and after the hour of ten o'clock (10:00) P.M. on
Sunday.
b. On the days set forth in this Subsection 3-5-6(S)(5)(b), the sale of any wine in original •
packages for consumption off the premises pursuant to a Class S license may begin after
the hour of 8:00 A.M. On these days, wine shall not be sold after the hour of ten o'clock
(10:00) P.M.

SECTION 6: That all ordinances or parts of ordinances in conflict herewith are
hereby repealed.
