AN ORDINANCE
Banning the Sale of Bidi Cigarettes
WHEREAS, recent studies by the United States Centers of Disease Control and
Prevention, and by other organizations, have found that a product known as "bidi
cigarettes" has become increasingly popular among young people; and
WHEREAS, bidi cigarettes generally deliver more nicotine and are therefore more
addicting that other cigarettes, in part because they contain tobacco that is wrapped in a
slow -burning material that requires shorter and harder puffs to withdraw the smoke; and
• WHEREAS, studies have indicated that cigarettes are a "gateway" drug for some
youths who go on to use illegal drugs; and
WHEREAS, It is reasonable to conclude that prohibiting the sale of bidi cigarettes
will lead to a reduction in smoking addiction among youths, will remove a product that may
be particularly likely to lead young smokers to illegal drugs, and will eliminate law
enforcement problems that may be associated with a common product that resembles
marijuana cigarettes;
NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
EVANSTON, COOK COUNTY, ILLINOIS:
SECTION 1: That Chapter 16 of Title 3 of the Evanston City Code, 1979, as
• amended is further amended by adding the following definition to Section 3-16-1:

BIDI CIGARETTE: A product that (1) contains tobacco that is wrapped in temburni
or tendu leaf or that is wrapped in any other material identified by rules of the
Department of Public Health that is similar in appearance or characteristics to the
temburni or tendu leaf and (ii) does not contain a smoke filtering device.
SECTION 2: That Chapter 16 of Title 3 of the Evanston City Code, 1979, as
amended is further amended by adding the following new Section 3-16-9 and renumbering
the existing Section 3-16-9 as 3-16-10.
3-16-9: SALE OF BIDI CIGARETTES PROHIBITED:
No person shall sell, give away, barter, exchange, or otherwise furnish to any
other person a bidi cigarette.
SECTION 3: That all ordinances or parts of ordinances in conflict herewith are
hereby repealed.
SECTION 4: That this ordinance shall be in full force and effect upon passage and is
approval.
