HomeMy WebLinkAboutORDINANCES-2000-034-O-005/18/00 34-0-00 AN ORDINANCE Vacating a Portion of the Public Alley located between buildings at 1508 and 1514 Elmwood to abutting owner at 1508 Elmwood. WHEREAS, Wilson Perry Associates has sought vacation of a portion of an alley between 1508 and 1514 Elmwood to provide for vehicular access; and WHEREAS, Wilson Perry Associates has reported that this portion of the alley, west of Elmwood and south of Grove, is currently unsurfaced and unsafe; and WHEREAS, Wilson Perry Associates, has agreed to clean-up the portion of the alley to be vacated, pave the alley and install a fence and develop the property, and return this to the tax rolls; and WHEREAS, Wilson Perry Associates are owners of the property • abutting the subject public alley west of Elmwood and south of Grove; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF EVANSTON, COOK COUNTY, ILLINOIS: Section 1: That the certain portion of the public alley west of Elmwood Avenue and south of Grove Street legally described as: That portion of the east -west 10-1' alley lying south and adjoining lots 1 and 2 in block 53 in the subdivision by Obadiah Huse and other's of blocks 50 to 53, both inclusive, in the original Village of Evanston, in section 18, Township 41 north, range 14, east of the third principal meridian, in Cook County, Illinois. As indicated by the words "hereby vacated" on the Plat of Vacation attached to and incorporated into this ordinance, be and the same is hereby vacated and closed, inasmuch as the corporate authorities of the City of Evanston have determined that the public interest will be served by the aforesaid vacation, provided that said vacation shall be subject to the following terms and conditions: 34-0-00 05/22/00 06/12/00 That said vacation shall be subject to the usual easement s for public utilities, including, but not limited to, such rights -of -way, license and easement rights to such equipment as is presently installed and located on those portions of the public right-of-way hereby closed and the rights of ingress and egress for the maintenance, renewal and reconstruction thereof. SECTION 2: That all ordinances or parts of ordinance in conflict herewith are hereby repealed. SECTION 3: That this ordinance shall be in full force and effect from and after its passage, approval, and publication in the manner provided by law.
