AN ORDINANCE
Vacating A Portion of the Public Street (Brown Avenue)
North of Greenleaf Street and West of Dodge Avenue
To Abutting Owners
WHEREAS, Benvenuti & Stein, Inc. (Benvenuti & Stein), has sought
vacation of a portion of Brown Avenue to provide for the expansion of the business and
• parking on property adjacent to 2001 Greenleaf Street; and
WHEREAS, Benvenuti & Stein has reported that this portion of Brown
Avenue is being used for an illegal dumping yard; and
WHEREAS, Benvenuti & Stein has agreed to clean-up the portion of
Brown Avenue to be vacated, install a fence and develop the property, and return this to
the tax rolls; and
WHEREAS, Benvenuti & Stein are the owners of property abutting the
subject public street (Brown Avenue);
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF EVANSTON, COOK COUNTY, ILLINOIS:

SECTION 1: That the certain portion of the public street (Brown Avenue) north
of Greenleaf Street and west of Dodge Avenue legally described as:
That part of Brown Avenue lying West of the Adjoining Lots 13 to 16, both
inclusive, and East of the Adjoining Lots 9 to 12, both inclusive, in Block 1 in
Pitner's 3`d Addition to Evanston described as follows; beginning at the
Northwest corner of said Lot 16, thence West along a line being the North line of
said Lot 16 projected West, 7.68 feet to the point of beginning; thence continuing
West along said projected line at a distance of 58.32 feet to the Northeast corner
of said Lot 9; thence South along the East line of said Lots 9 to 12, both inclusive,
to the Southeast corner of Lot 12; thence East along a line being the South line of
said Lot 12 projected East to the Southwest corner of said Lot 13; thence
Northerly along a straight line to the point of beginning, all in the Northwest
Quarter of Section 24, Township 41 North, Range 13 East of the Third Principal
Meridian, in Cook County, Illinois;
As indicated by the words "hereby vacated" on the Plat of Vacation attached to and
incorporated into this ordinance, be and the same is hereby vacated and closed, inasmuch
as the corporate authorities of the City of Evanston have determined that the public is
interest will be served by the aforesaid vacation, provided that said vacation shall be
subject to the following terms and conditions:
That said vacation shall be subject to the usual easements for public utilities, including,
but not limited to, such rights -of -way, license and easement rights to such equipment as is
presently installed and located on those portions of the public right-of-way hereby closed
and the rights of ingress and egress for the maintenance, renewal and reconstruction
thereof.
SECTION 2: That all ordinances or parts of ordinances in conflict herewith are
hereby repealed.
SECTION 3: That this ordinance shall be in full force and effect from and after
its passage, approval, and publication in the manner provided by law. 0
