AN ORDINANCE
Amending Chapter 25 of Title 3 of
the Evanston City Code Regulating
the Farmers' Market
WHEREAS, the Evanston Farmers' Market is an annual event held from May to
October; and
WHEREAS, the items for sale include produce and flowers grown by regional
growers; and
WHEREAS, home baked items are sold weekly by Evanston non-profit
• organizations at the Farmers' Market; and
WHEREAS, there is an interest to add to the Farmers' Market the sale of bread
by Evanston bakeries; and
WHEREAS, Chapter 25 of Title 3 of the Evanston City Code sets forth the
regulations regarding the Farmer's Market,
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
EVANSTON, COOK COUNTY, ILLINOIS:
SECTION 1: That Section 3-25-1 of the Evanston City Code, 1979, as amended,
is hereby further amended by adding the following new subsection (C) to the definition of
Saleable Items:
(C) The sale of bread shall be allowed by any licensed, food certified bakery
establishment. Establishments must be licensed by the City of Evanston. The

bread must have been made from all fresh ingredients and processed on site,
including mixing, shaping, final proofing, and baking. No bread can be sold if the
ingredients have been prepared off -site but is baked on the premises. Eligible
bakers shall be only those where the sale of breads and pastries are the exclusive
items for sale. No establishment will be eligible if bread is only an ancillary item for
sale. The sale of bread is the only item which shall be allowed to be sold by the
bakeries. The sale of pies, muffins, cookies or cakes shall be prohibited by the
bakeries.
SECTION 2: That Section 3-25-3(A) of the Evanston City Code, 1979, as amended,
is hereby further amended as follows:
3-25-3: LICENSES AND PERMITS:
(A) Licensing Provisions: No grower or producer shall sell or offer for sale any
product without having first obtained a license or permit therefor. Each
license shall be valid for one season, and the seasonal fee for such license
shall be four hundred dollars ($400.00). A license granted hereunder is not
transferable. is
SECTION 3: That Section 3-25-3(B) of the Evanston City Code, 1979, as amended,
is hereby further amended as follows:
(B) Daily Permits: A grower or producer may obtain a daily permit, entitling him
to occupy one space in the market for one day. The daily fee for such permit
shall be one hundred dollars ($100).
SECTION 4: That Section 3-25-6(A) of the Evanston City Code, 1979, as amended,
is hereby further amended by adding the following new subparagraph 9:
3-25-6: GENERAL REGULATIONS:
(A) No licensee or permittee shall:
9. Be selected to participate in the Evanston Farmers' Market without
providing evidence that real estate and property taxes and Illinois sales taxes
have been paid during the previous market season. First time vendors shall
have all required licenses and must show evidence thereof.

SECTION 5: That all ordinances or parts of ordinances in conflict herewith are
hereby repealed.
SECTION 6: That this ordinance shall be in full force and effect from and after its
passage, approval, and publication in the manner provided by law.
