HomeMy WebLinkAboutORDINANCES-2001-043-O-01• 04/03/01 43-0-01 AN ORDINANCE Vacating a Portion of the East-West Alley Between 537 Custer Avenue and 547 Custer Avenue To Abutting Owners NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF EVANSTON, COOK COUNTY, ILLINOIS: SECTION 1: That the certain portion of the East-West public alley between 537 Custer Avenue and 547 Custer Avenue legally described as: PART OF THE EAST -WEST 19.0 FEET WIDE ALLEY LYING SOUTH OF • LOT 14 AND NORTH OF LOTS 11, 12 AND 13 IN BLOCK 8 IN KEENEY & RINN'S ADDITION TO EVANSTON, IN SECTION 19, TOWNSHIP 41 NORTH, RANGE 14, EAST OF THIRD PRINCIPAL MERIDIAN, IN COOK COUNTY, ILLINOIS, DESCRIBED AS FOLLOWS: BEGINNING AT THE SOUTHWEST CORNER OF SAID LOT 14; THENCE EAST ALONG A LINE BEING THE SOUTH LINE OF SAID LOT 14, A DISTANCE OF 99.93 FEET; THENCE SOUTHEASTERLY 27.56 FEET TO A POINT ON THE NORTH LINE OF SAID LOT 11, 120.0 FEET EAST OF THE NORTHWEST CORNER OF SAID LOT 13; THENCE WEST ON THE NORTH LINE OF SAID LOTS 11, 12 AND 13, 120.0 FEET TO THE NORTHWEST CORNER OF LOT 13, THENCE NORTH 19.0 FEET TO THE PLACE OF BEGINNING. is hereby vacated to abutting owners John J. Lieneweber and Mary McAuley as indicated by the words "hereby vacated" as shown on the plat of survey, Exhibit A, attached hereto and incorporated into this Ordinance. 40 43-0-01 SECTION 2: Said alley portion is hereby vacated and closed, inasmuch as the corporate authorities of the City of Evanston have determined that the public interest will be served by said vacation. SECTION 3: The sum of five thousand dollars ($5,000.00) is the agreed -upon compensation for the vacation. Payment of said sum in full to the City within sixty (60) days of the passage of this Ordinance is a condition precedent to its validity. SECTION 4: Pursuant to 65 ILCS 5/11-91-1, any and all easements for utilities as may be on, under, or above the vacated property, including rights -of -way, license and easement rights, and rights of ingress and egress for the maintenance, renewal, and reconstruction thereof are hereby reserved to the City or to the respective public utility. SECTION 5: That all ordinances or parts of ordinances in conflict herewith are hereby repealed. SECTION 6: That this ordinance shall be in full force and effect from and after its passage, approval, and publication in the manner provided by law.
