HomeMy WebLinkAboutORDINANCES-2002-096-O-0209/17/2002 • 96-0-02 AN ORDINANCE Vacating a Portion of the Public Street (Forest Avenue) South of South Boulevard To Abutting Owners WHEREAS, Mid -Chicago Properties ("Mid -Chicago"), has sought vacation of a portion of Forest Avenue south of South Boulevard for a proposed private development on the adjacent property at 220 South Boulevard; and WHEREAS, Mid -Chicago is the owner of property abutting the subject public street (Forest Avenue) at 220 South Boulevard, NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF EVANSTON, COOK COUNTY, ILLINOIS: • SECTION 1: That the certain portion of the public street (Forest Avenue) south of South Boulevard legally described as: THE EAST 16.0 FEET OF FOREST AVENUE, LYING WEST OF AND ADJOINING LOT 6 IN BLOCK 13 IN KEENEY AND RINNE ADDITION TO EVANSTON, SAID ADDITION BEING A SUBDIVISION OF THE SOUTH Y2 OF THE SOUTH Y2 AND THE NORTH Y2 OF THE SOUTH '/z OF THE SOUTHEAST '/4 OF SECTION 19, TOWNSHIP 41 NORTH, RANGE 14, EAST OF THE THIRD PRINCIPAL MERIDIAN, ALSO ALL OF THE NORTH Y2 OF THE NORTH Y2 OF THE SOUTH '/2 OF SAID QUARTER SECTION 19, LYING WEST OF THE MILWAUKEE DIVISION OF THE CHICAGO AND NORTHWESTERN RAILROAD, IN COOK COUNTY, ILLINOIS. As indicated by the words "hereby vacated" on the Plat of Vacation attached to and incorporated into this ordinance, be and the same is hereby vacated and closed, inasmuch 0 as the corporate authorities of the City of Evanston have determined that the public interest n LJ 96-0-02 will be served by the aforesaid vacation, provided that said vacation shall be subject to the following terms and conditions: That said vacation shall be subject to the usual easements for public utilities, including, but not limited to, such rights -of -way, license and easement rights to such equipment as is presently installed and located on those portions of the public right-of-way hereby closed and the rights of ingress and egress for the maintenance, renewal and reconstruction thereof. SECTION 2: That all ordinances or parts of ordinances in conflict herewith are hereby repealed. SECTION 3: That this ordinance shall be in full force and effect from and after its passage, approval, and publication in the manner provided by law.
