AN ORDINANCE
Amending Section 6-3-10-5 of the
Zoning Ordinance Regarding Penalties for Violations
WHEREAS, the Plan Commission held a public hearing on
July 13, 2005, pursuant to proper notice in case no. ZPC 05-06-T, to amend the
text of the Zoning Ordinance regarding penalties for violations; and
WHEREAS, the Plan Commission received testimony and made a
verbatim transcript and findings pursuant to Section 6-3-4-5 of the Zoning
• Ordinance that the amendment met the standards for text amendments, and
recommended City Council approval thereof; and
WHEREAS, the Planning and Development Committee of the City
Council adopted the findings and recommendation of the Plan Commission in case
no. ZPC 05-06-T, and recommended City Council approval thereof; and
WHEREAS, the City Council adopted the respective records and
recommendations of the Plan Commission and the Planning and Development
Committee at its July 25, 2005 meeting; and
WHEREAS, the City Council voted to suspend its Rules to allow
introduction and passage of this Ordinance on July 25, 2005,

NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF

THE CITY OF EVANSTON, COOK COUNTY, ILLINOIS:

SECTION 1: That the foregoing recitals are found as fact and made
SECTION 2: That Section 6-3-10-5 of the Zoning Ordinance is hereby
amended to read as follows:
Section 6-3-10-5: PENALTIES AND REMEDIES FOR VIOLATIONS:
(A) Violations of the provisions of this Ordinance or failure to comply with any of
its requirements, including violations of any conditions and safeguards established
in connection with approval of a variation, special use, unique use, zoning
certificate, or development plan approval, shall be punishable by a fine of not less
than one hundred dollars ($100.00) nor more than one thousand dollars
($1,000.00).
(B) Each day that any violation continues after notification by the Zoning •
Administrator that such violation exists, shall be considered a separate offense for
purposes of the penalties and remedies specified in this subsection
6-3-10-5(A) above.
(C) This Ordinance may also be enforced by an appropriate equitable action.
SECTION 3: That all ordinances or parts of ordinances in conflict
herewith are hereby repealed.
SECTION 4: That this ordinance shall be in full force and effect from
and after its passage, approval, and publication in the manner provided by law.
