HomeMy WebLinkAboutORDINANCES-2006-056-O-064/5/06, 4/4/06 56-0-06 AN ORDINANCE SETTING TERM LIMITS FOR THE NORTHWESTERN UNIVERSITY/CITY COMMITTEE WHEREAS, on February 17, 2004 the City of Evanston and Northwestern University in the matter of Northwestern Universitv v. City of Evanston, no. 00-C-7309 in the United States District Court for the Northern District of Illinois, Eastern Division entered into an Agreed Order which resolved subject litigation; and is WHEREAS, as a result of the Agreed Order a University/City Committee ("Committee") was created; and WHEREAS, pursuant to said Order included among the City membership on the Committee were "two representatives of the Community, who shall be chosen by and serve at the pleasure of the City Council"; and WHEREAS, on May 24, 2004 the City Council made the initial appointments of David Schoenfeld and Robert Atkins as City representatives on the Committee; and WHEREAS, the City Council did not establish a set term for these appointments; and • 56-0-06 • WHEREAS, on April 3, 2006 the Rules Committee of the City Council determined that a set term of a fixed duration for the two community representatives on the Committee is in the best interests of the City; and WHEREAS, the Rules Committee has recommended that the term of appointment of the two representatives of the Community to the Committee be for four years on a staggered two year basis. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF EVANSTON, COOK COUNTY, ILLINOIS: SECTION 1: The term of appointment for the two representatives of the Community appointed to the University/City Committee pursuant to Consent Degree entered in the matter of Northwestern Universitv v. City of Evanston, no. • 00-C-7309 in the United States District Court for the Northern District of Illinois, Eastern Division shall be as follows: a) There shall be two members of the Community, who shall be chosen by and serve at the pleasure of the City Council, appointed to the University/City Committee. b) Each member shall serve for a four year term. c) For the two current members, one term shall terminate upon the effective date of this Ordinance and the other term shall terminate on May 1, 2008. d) Thereafter a person shall be appointed to fill each position on the Committee, pursuant to the Court Order as the successor of the representative whose term shall expire that year to serve as a representative for four years. SECTION 2: That all ordinances or parts of ordinances in conflict • herewith are hereby repealed. 2 Ej • SECTION 3: That this Ordinance shall be in full force and effect from and after its passage, approval, and publication in the manner provided by law.
