HomeMy WebLinkAboutORDINANCES-2007-037-O-07• 3/23/2007 37-0-07 AN ORDINANCE Granting Evanston Landmark Status to the Building at 1414 Davis Street WHEREAS, the City has enacted a Historic Preservation Ordinance ("Ordinance"), Title 2, Chapter 9 of the Evanston City Code of 1979, as amended; and WHEREAS, Section 2-9-5 of the Ordinance sets forth the process whereby the Preservation Commission shall nominate and consider applications for landmark designation and designate landmarks and historic districts; and WHEREAS, Rebecca Kuchar and Scott Small, owners of the property • located at 1414 Davis Street, the "Subject Property"), ( � submitted an application on October 11, 2006, for the designation of the building on the Subject Property, as an Evanston Landmark; and WHEREAS, the Preservation Commission conducted public hearings, pursuant to proper notice, on November 14, 2006, January 16, 2007, and February 20, 2007, to consider the application pursuant to Section 2-9-5 of the Ordinance; and WHEREAS, the Preservation Commission, after taking testimony, receiving other evidence and making a verbatim record, found that the aforesaid building at 1414 Davis Street, with a wood frame and stucco finish, constructed in the Craftsman style, met the criteria in Sections 2-9-4(A)2, 2-9-4(A)3, 2-9-4(A)4, and 2-9-4(E) of the Ordinance for designation as an Evanston Landmark; and 37-0-07 WHEREAS, at its March 6, 2007 meeting, the Preservation Commission voted to recommend that the City Council grant Evanston Landmark designation to said • building at 1414 Davis Street and adopted a Resolution "Requesting the City Manager to Transmit the Evanston Preservation Commission's Report and Recommendation that the City Council Designate the Building at 1414 Davis Street, as an Evanston Landmark" to the City Council; and WHEREAS, the Planning and Development Committee of the City Council considered and adopted the record and recommendation of the Preservation Commission at its April 10, 2007 meeting and recommended that the City Council designate the building at 1414 Davis Street, as an Evanston Landmark; and WHEREAS, the City Council considered and adopted the respective records and recommendations of the Preservation Commission and the Planning and Development Committee at its April- 23, 2007 meeting, and • NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF EVANSTON, COOK COUNTY, ILLINOIS: part hereof. SECTION 1. The above recitals are found as fact and made a SECTION 2: Pursuant to Section 2-9-5(G) of the Ordinance, the City Council hereby designates the building at 1414 Davis Street as an Evanston Landmark. SECTION 3: That if any provision of this ordinance or the application thereof to any person or circumstance is held invalid, the invalidity shall not affect other provisions or applications of this ordinance which can be given effect without the invalid provisions or applications thereof. 0 -2- 37-0-07 . SECTION 4: That all ordinances or parts of ordinances in conflict herewith are hereby repealed. SECTION 5: That this ordinance shall be in full force and effect from and after its passage, approval, and publication in the manner provided by law.
