HomeMy WebLinkAboutORDINANCES-2009-065-O-099/4/2009 65-0-09 AN ORDINANCE Authorizing the Sale of Surplus Fleet Vehicles and Equipment Owned by the City of Evanston (Obenauf Auction Service Municipal Equipment Auction) WHEREAS, the City Council of the City of Evanston has determined that it is no longer necessary, practical, or economical for the best interest of the City to retain ownership of certain surplus fleet vehicles and equipment hereinafter described; and WHEREAS, the City Council has determined that it is in the best interest of the City of Evanston to sell said surplus fleet vehicles and equipment to the highest bidder at the Obenauf Auction Service Vehicle & Equipment Auction to be held on December 5, 2009, at the Lake County Fairgrounds located at 1060 East Peterson Road in Grayslake, Illinois 60030. NOW THEREFORE, BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF EVANSTON, COOK COUNTY, ILLINOIS: SECTION 1: That, pursuant to Section 1-17-3(B) of the City Code of the City of Evanston, 1979, as amended, the City Council finds that the following described surplus fleet vehicles and equipment summarized in Exhibit A, attached hereto and incorporated herein, has an aggregate value in excess of one thousand five hundred dollars ($1,500.00). SECTION 2: That, pursuant to said Section 1-17-3(B), the City Council hereby authorizes and directs the City Manager to sell upon terms and conditions he • deems reasonable, necessary, and in the best interest of the City the aforedescribed surplus fleet vehicles and equipment now owned by the City of Evanston at the Obenauf 65-0-09 Auction Service Vehicle & Equipment Auction to be held on December 5, 2009, at the Lake County Fairgrounds located at 1060 East Peterson Road in Grayslake, Illinois 60030, to the highest bidder on said surplus fleet vehicles and equipment. SECTION 3: That, upon payment of the price indicated by the Obenauf Auction Service, the City Manager is hereby authorized to convey evidence of ownership of aforesaid surplus fleet vehicles and equipment to Obenauf Auction Service. SECTION 4: That all ordinances or parts of ordinances in conflict herewith are hereby repealed. SECTION 5: That, if any provision of this Ordinance 65-0-09 or application thereof to any person or circumstance is held unconstitutional or otherwise invalid, such invalidity shall not affect other provisions or applications of this Ordinance that can be given effect without the invalid application or provision, and each invalid application of this Ordinance is severable. SECTION 6: That this Ordinance 65-0-09 shall be in full force and effect from and after its passage, approval and publication in the manner provided by law. The property is presently assigned to the Public Works Department (Water Distribution and Streets & Sanitation) and the Office of Emergency Management. We typically participate in three auctions per year in the Lake County and Northern Illinois area through Obenauf Auctioneers, 118 North Orchard Street, Round Lake, Illinois 60073 ((847) 546-2097) for surplus property. This is a request for City Council consideration and approval of Ordinance 65-0-09 to sell this surplus equipment through Obenauf Auction Services' live auction on Saturday, December 5, 2009, at the Lake County Fairgrounds located at 600 East Peterson Road in Grayslake, Illinois 60030, or any subsequent Obenauf online internet based auction. Proceeds from the auction are to be credited to account 7705.56065, "Sale of Surplus Property." The City of Evanston has successfully utilized Obenauf Auction Services for both live on location auctions and internet auctions for many years.
