HomeMy WebLinkAboutORDINANCES-2009-015-O-09• 3/23/2009 15-0-09 AN ORDINANCE Authorizing the Sale of Surplus Fleet Vehicles Owned by the City of Evanston (Obenauf Auction Service Municipal Equipment Auction) WHEREAS, the City Council of the City of Evanston has determined that it is no longer necessary, practical, or economical for the best interest of the City to retain ownership of certain surplus fleet vehicles hereinafter described; and WHEREAS, the City Council has determined that it is in the best interest of the City of Evanston to sell said surplus fleet vehicles to the highest bidder at the Obenauf Auction Service Vehicle & Equipment Auction to be held on April 18, 2009, at the Lake County Fairgrounds in Grayslake, Illinois. • NOW THEREFORE, BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF EVANSTON, COOK COUNTY, ILLINOIS: SECTION 1: That, pursuant to Section 1-17-3(B) of the City Code of the City of Evanston, 1979, as amended, the City Council finds that the following described surplus fleet vehicles summarized in Exhibit A, attached hereto and incorporated herein, has an aggregate value in excess of one thousand five hundred dollars ($1,500.00). SECTION 2: That, pursuant to said Section 1-17-3(B), the City Council hereby authorizes and directs the Interim City Manager to sell upon terms and conditions she deems reasonable, necessary, and in the best interest of the City the aforedescribed surplus fleet vehicles now owned by the City of Evanston at the 0 Obenauf Auction Service Vehicle & Equipment Auction to be held on April 18, 2009, at 15-0-09 the Lake County Fairgrounds in Grayslake, Illinois to the highest bidder on said surplus fleet vehicles. • SECTION 3: That, upon payment of the price indicated by the Obenauf Auction Service, the Interim City Manager is hereby authorized to convey evidence of ownership of aforesaid surplus personal fleet vehicles to the Obenauf Auction Service. SECTION 4: That all ordinances or parts of ordinances in conflict herewith are hereby repealed. SECTION 5: That this Ordinance 15-0-09 shall be in full force and effect from and after its passage, approval and publication in the manner provided by law. SECTION 6: That if any provision of this Ordinance 15-0-09 or application thereof to any person or circumstance is held unconstitutional or otherwise invalid, such • invalidity shall not affect other provisions or applications of this Ordinance 15-0-09 that can be given effect without the invalid application or provision, and each invalid application of this Ordinance is severable.
