HomeMy WebLinkAboutORDINANCES-2010-016-O-10• Effective Date: March 29, 2010 2/11/2010 16-0-10 AN ORDINANCE Amending Title 8, Chapter 5% of the City Code, 'Municipal Solid Waste Hauling Licenses' NOW BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF EVANSTON, COOK COUNTY, ILLINOIS: SECTION 1: That Title 8, Chapter 5'/2 of the Evanston City Code of 1979, as amended (the "City Code"), is hereby amended by the enactment of a new Section 6 thereof, with the existing Sections 6 and 7 thereof retained and re -numbered accordingly. The new Section 6 shall read as follows: 8-51/2-6: RESIDENTIAL RECYCLING REQUIREMENTS: (A) Each building in the City that contains five (5) or more residential units and is served by the exclusive municipal solid waste franchise contractor, designated pursuant to Subsection 8-5-9-3 of this Title, shall receive one (1) ninety-five (95) gallon recycling cart from said contractor at no cost to the owners of such buildings. (B) The owner of each building that receives a recycling cart pursuant to this Section shall provide adequate on -site storage space for each cart and access to each cart to the building residents and the municipal solid waste franchise contractor. SECTION 2: That all ordinances or parts of ordinances in conflict herewith are hereby repealed. SECTION 3: That if any provision of this ordinance or application thereof to any person or circumstance is held unconstitutional or otherwise invalid, such invalidity shall not affect other provisions or applications of this 46 ordinance that can be given effect without the invalid application or provision, and each invalid provision or invalid application of this ordinance is severable. 16-®-10 SECTION .4: That this ordinance shall be in full force and effect from and after its passage, approval and publication in the manner • provided by law.
