AN ORDINANCE
Amending the Zoning Map to Re -Zone 415 Sherman Avenue
from R4 General Residential and off Hospital Overlay Districts
to R5 General Residential District
WHEREAS, Northstar Trust Company (the "Applicant"), owner of
the property located at 415 Sherman Avenue, Evanston, Illinois (the "Subject
Property"), legally described in Exhibit A, attached hereto and incorporated
herein by reference, submitted an application pursuant to the provisions of Title 6
of the Evanston City Code, 1979, as amended, ("the Zoning Ordinance"),
requesting an amendment to the Zoning; Map to re -zone the Subject Property
• from R4 General Residential District and off Hospital Overlay District to R5
General Residential District; and
WHEREAS, on May 12, 2010, the Plan Commission held a public
hearing, pursuant to proper notice, in case no.10PLND-0022, received
testimony, made a written record and findings that the application met the
standards set forth in Section 6-3-4-5 of the Zoning Ordinance, "Standards for
Amendments", and recommended City Council approval thereof; and
WHEREAS, at its meeting of June 14, 2010, the Planning and
Development Committee of the City Council considered and adopted the Plan
Commission's findings and recommendation in case no. 10PLND-0022, and
recommended City Council approval thereof; and

WHEREAS, at its meeting of June 28, 2010, the City Council
considered and adopted the records and recommendations of the Plan
Commission and the Planning and Development Committee,
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL
OF THE CITY OF EVANSTON, COOK COUNTY, ILLINOIS:
SECTION 1: That the foregoing recitals are found as fact and
made a part hereof.
SECTION 2: That the City Council hereby adopts the records and
recommendations of the Plan Commission and the Planning and Development
Committee in case no. 10PLND-0022.
SECTION 3: That the City Council hereby amends the Zoning
Map, cited in Section 6-7-2 of the Zoning Ordinance, to re -zone the Subject
Property to R5 General Residential District.
SECTION 4: That all ordinances or parts of ordinances in conflict
herewith are hereby repealed.
SECTION 5: That if any provision of this ordinance or application
thereof to any person or circumstance is held unconstitutional or otherwise
invalid, such invalidity shall not affect other provisions or applications of this
ordinance that can be given effect without the invalid application or provision, and
each invalid provision or invalid application of this ordinance is severable.
SECTION 6: That this ordinance shall be in full force and effect
from and after its passage, approval and publication in the manner
provided by law.
