1 AN ORDINANCE
I Amending Chapter 5 of the Code of the
City of Evanston, 1957, As Amended
IBE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF EVANSTON$ COOK COUNTY,
1ILLINOIS:
SECTION 1: That Section 5-5 of the Code of the City of Evanston, 1957,.
as amended, be and hereby is further amended to read as
follows:
"Section 5-5. Same - Fees.
Upon the furnishing of the information required by Section 4 of
this Chapter and a showing by any applicant for a permit that he is
` prepared to comply with the regulations promulgated by the Finance
Director, a permit shall be issued following payment of the applicable

I� fee, as follows:
+ (a) All dogs - $15.00;
I
I (b) All cats - $5.00;
I (c) For each animal of other domestic species - $3.00;
(d) For each kennel or pet shop, covering all animals kept during the
year - $50.00;
(e) For any zoological garden or animal act, covering all animals kept -
$100.00;

(f) No fee shall be required of any humane society, veterinary hospital,

1: or municipal animal control facility.

I! Nothwithstanding the requirements aforesaid, an applicant, upon presenta-
tion of proof that said applicant is beyond the age of 65 years or is
within that class of persons designated by standards of the Department

of Health, Education, and Welfare as below the prevailing poverty level,
such applicant shall be issued a permit for an animal upon payment of
one-half (1/2) of the established fee,"
j� SECTION 2: That Section 5-26 of the Code of the City of Evanston, 1957,
as amended, be and hereby is further amended to read as

I! "Section 5-26. Control of Defecation.

a. It shall be unlawful for any person to cause or permit a dog to

be on any property, public or private, 46W owned or possessed by
such person unless such person has in his immediate possession a
device for the removal of excrement.and a depository for the transmission
of excrement to a receptacle located upon property owned or possessed
by such person.
b. It shall be unlawful for any person in control of, causing or
permitting any dog to be on any property, public or private, not owned
or possessed b such person to fail to remove excrement left b such

dog to a proper receptacle located on property owned or possessed by
such person."
II SECTION 3: That Section 5-27 of the Code of the City of Evanston, 1957,
I as amended, be further amended to read as follows:
f "Section 5-27. Violation of Ordinance - Fine.
Any person violating any provision of this Ordinance shall be deemed '
to be guilty of an offense and shall be punished by a fine of not less
than $10 for the first offense, $20 for the second offense, $40 for the
third offense, $80 for the fourth offense, $160 for the fifth offense
and $200 for each offense thereafter. If any violation.shall be of a I�
continuing nature, each day of violation shall be deemed a separate
offense and subject to the progressive penalties contained herein. In j
the event a person is found guilty of a violation of Section 5-15 of this

Ordinance, his permit to own, keep or harbor or have custody of animals i
shall be manditorily revoked and no new permit shall be issued to that
person for a period of one year."
SECTION 4: All ordinances or portions.of ordinances in conflict with
the terms of this ordinance are hereby repealed.
SECTION 5: This ordinance shall be in full force and effect from and
after its passage, approval and publication in the manner
provided by law.
