AN ORDINANCE
Amending Sections 2-176 through 2-178
Of the Municipal Code Relating To
The Powers and Responsibilities
Of the Art Commission

BE IT ORDAI14ED BY THE CITY COU14CIL OF THE C-UTY OF EVANSTON, COOK
COUNTY, I,LLINOIS:
SECTION 1: That Sections 2-176 through 2-17131 of the Code of the
City of Evanston, 1957 as amended, be and are hereby
further amended to read as follows:
"2-176 - Powers and Responsibilities.
Whenever a work of art is proposed to be erected or placed in,
over, upon or allowed to extend in, over, or upon any .street, alley,
avenue, square, common, boulevard, park, grounds used for public
purposes, municipal building, school building, or other public build=
ing or public place under the control• of the City or any department
or officer thereof, a design of such work of art or a mold thereof
shall be submitted together with -a statement of zt!-e'proposed loca-
tion of such work of art to the art commission fa:r review. The term
'work of art' as used in this context shall be deemed to include all
paintings, murals, stained glass, statues, bas rE.liefs, sculptures,
monuments, ornaments, fountains, arches, ornamental gateways, or
other structures of a permanent character intended for ornament or
commemoration. The commission, upon receipt of - uch a submission
shall review such proposal and deliver a report of its findings to
the City Council giving due consideration to the aesthetics of the
work and the location thereof in keeping with ttie general health,

safety.and welfare. Any proposed removal, relocation, or altera-
tion of a work of art presently in the possessiaa, of the.City or in
any parks, boulevards, public grounds, school buildings, or school`
grounds shall be submitted to the art commission for review and
subsequent recommendation to the City Council.
The commission shall act in the same capacity, in respect to
designs of buildings, bridges, approaches, gates„ fences, or
other structures erected or to be erected upon and belonging to and
occupied by the City or a part of any of the parks, public grounds
or boulevards under the jurisdiction of the City and in respect of
the lines, grades, and plotting.of the public ways and grounds,.and
in respect of the. arches, bridges; structures, and approaches which
are the property of any corporation or private individual and which
is over any public land or dedicated right-of-way of the City. The
conimission may offer advice and suggestions to otrners of private
property in relation to beautification thereof and any person who
may be about to erect any building or improvement- may submit designs
thereof to the commission for advice and 'suggestion. The art commis-
sion may receive complaints and suggestions of citizens or voluntary
associations whose objects are as set forth above and may report with
comment upon such complaint or suggestion to the City Council. The
commission shall record its proceedings and make an annual report
thereof in writing to the Mayor.
2-177 -Failure of commission to make decisions.
Except as provided in Section 2-178 of this. Code,, if the art
commission shall fail to submit its report upon any matter submit-
ted for its consideration within sixty (60) days of such submission
its findings and recommendations shall be deemed unnecessary.

Sec. 27178 - Removal or relocation of existing works of art.
In case the removal or 'relocation of any existing work of art
or other matter that under the provisions of Section 2-176 of this
Code would be within the purview of the art commission, shall be
deemed necessary by those in power to cause such removal or.re-
location, the commission shall within forty-eight hours after
notice, give recommendation regarding such removal or relocation,
and in case of its failure so to act within forty-eight hours after
the receipt of such notice, its findings and recommendations shall
be deemed unnecessary."
SECTION 2: This Ordinance shall be in full force and effect from
and after its passage, approval and publication in the
manner provided by law.
