HomeMy WebLinkAboutORDINANCES-1976-107-O-7612-2-76 107-0-76 AN ORDINANCE Amending.the Definition of Floor Area in Section III of the Evanston Zoning Ordinance Adopted November 21, 1960, as Amended WHEREAS, the Zoning Amendment Committee conducted a public hearing on July 1, 1976 to consider amending the Zoning Ordinance to define enclosed porch and/or open porch, and to amend the definition of gross floor area in a manner that would allow existing roofed porches to be included in the computation of floor area so they may be enclosed without increasing the floor area ratio, pursuant to notice and publication thereof in accordance with law; and • WHEREAS, the Zoning Amendment Committee has made its findings and recommendations to the City Council of the City of Evanston; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF EVANSTON, COOK COUNTY, ILLINOIS: SECTION 1: That the definition of "floor area (gross floor area)" for the purpose of deter- mining the floor area ratio and conversions of existing struc- tures in Section III of the Evanston Zoning Ordinance adopted November 21, 1960, as amended, be further amended to read as follows: •. "FLOOR AREA (GROSS FLOOR AREA) - for the purpose of determining the floor area ratio and conversions of exist- 107-0-76 -2- 0 ing structures. The sum of the gross horizontal areas of the several floors of building, including the basement floor but not including a cellar floor, measured from the exterior faces of the exterior walls or from the center line of walls separating two buildings. The 'floor area' of a building shall also include elevator shafts and stair wells at each floor; floor space used for mechanical equipment, except equipment, open or enclosed, located on the roof; penthouses; finished attic space having headroom of five feet or more; interior bal- conies and mezzanines; enclosed porches or porches covered by a roof suitable for covering a habitable room, but not exterior balconies; and floor space devoted to accessory uses; provided, however, that any space devoted to off -scree: parking or loading shall not be included in 'floor area'." SECTION 2: All ordinances or parts of ordinances in conflict herewith are hereby repealed. SECTION 3: This ordinance shall be in full force and effect from and after its passage, approval and publication in the manner provided by law. Siegel Corporation Counsel , 1976 EVANSTON TRAFFIC ORDINANCE An Ordinance Regulating Traffic Upon the Public Streets of the City of Evanston BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF EVANSTON, COOK COUNTY, ILLINOIS: SECTION 1: That Chapter 27 of the Code of the City of Evanston, 1957',asi amended, be and hereby is further amended to read as follows: "Chapter 27 - MOTOR VEHICLE CODE ARTICLE I - WORDS AND PHRASES DEFINED Sec. 27-1.1. The following words and phrases when used in this chapter shall, for the purposes of this chapter, have the meanings respectively ascribed to them in this section, except when the context otherwise requires; in the event` that no definition is provided herein for a word or phrase used in this chapter, ,,',meaning shall be determined by reference to the Illinois Motor Vehicle Code; 1969, as amended. Alley. A public way within a block, generally giving access to the rear*'bf lots or buildings and not used for general traffic circulation. Bicycle. Every device propelled by human power upon which any person may ride, having two tandem wheels either of which is more than 16 inches in diameter. Business District. The territory contiguous to and including a street'when., within any six hundred feet along such street there are buildings in use'for` business or industrial purposes, including but not limited to hotels, banks or`'` office buildings, railroad stations and public buildings which occu py' rat- least ,three hundred feet of frontage on one side or three hundred feet collectively on both sides of the street. Controlled Access Highway.. Every highway, street or roadway in respect to' which owners or occupants of abutting lands and other persons have no legal ci right of access to or from the same except at such points only and ARTICLE III - ENFORCEMENT AND OBEDIENCE Sec. 27-3.1. Authority of police and fire department officials. (a) It shall be the duty of the officers.of the police department or such officers as are assigned by the chief of police to enforce all street traffic laws of this city and all of the State vehicle laws. (b) Officers of the police department or such officers as are assigned by the chief of police are hereby authorized to direct all traffic by voice, hand or signal in conformance with traffic laws, provided that, in the event of a fire or other emergency or to expedite traffic or to safeguard pedestrians, officers of the police department may direct traffic as conditions may require notwithstanding the provisions of the traffic laws. (c) Officers of the fire department, when at the scene of a fire, may direct or assist the police in directing traffic thereat or in the immediate vicinity. Sec. 27-3.2. Required obedience to ordinance. It is unlawful and an offense for any person to do any act forbidden or fail to perform any act required in this ordinance. Sec. 27-3.3. Obedience to police and fire department officials. No person shall willfully fail or refuse to comply with any lawful order or direction of any police or other officer invested by law with authority to direct, control or regulate traffic. Sec. 27-3.4. Certain nonmotorized traffic to obey regulations. (a) Every person propelling any push cart upon a.roadway shall be granted all of the rights and shall. be subject to all of the duties applicable to the driver of a vehicle by this ordinance and by the rules of the road portion of the Illinois Vehicle Code, except those provisions which by their very nature can have no application. -10- (b) Every person riding an animal or driving any animal -drawn vehicle upon a roadway shall be granted all of the rights and shall be subject to all of the duties applicable to the driver of a vehicle by this ordinance, except those provisions of this ordinance which by their very nature can have no application. Sec. 27-3.5. Use of coasters, roller skates and similar devices. No person upon roller skates, or riding in or by means of any coaster, toy vehicle, or similar device, shall go upon any roadway except while crossing a street on a crosswalk and when so crossing such person shall be granted all of the rights and shall be subject to all of the duties applicable to pedestrians. This section shall not apply upon any street while set aside as a play street as authorized herein. Sec. 27-3.6. Public employees to obey traffic regulations. (a) The provisions of this chapter applicable to the drivers of vehicles upon the streets and highways shall apply to the drivers of all vehicles owned or operated by the United States, the state, county or city, or any other political subdivision, except as provided in this section and subject to such specific exceptions as are set forth in this chapter with reference to authorized emergency vehicles. (b) The provisions of this chapter shall not apply to authorized persons, teams, motor vehicles and other equipment while actually engaged in work upon the surface of the street or highway but shall apply to such persons and vehicles when traveling to or from such work. Sec. 27-3.7. Authorized emergency vehicles. (a) The driver of an authorized emergency vehicle, when responding to an emergency call or when in the pursuit of an actual or suspended violator 'll of the law or when responding to but not upon returning from a fire alarm, may _I _11- park or stand, irrespective of the provisions of this ordinance. 00 (b) The foregoing provision shall not relieve the driver of an 8 authorized emergency vehicle from the duty to park or stand with due regard for the safety of all persons, nor shall. such provision protect the driver from the consequences of his reckless disregard for the safety of others. -12- ARTICLE IV - TRAFFIC CONTROL DEVICES Sec. 27-4.1. Authority to install traffic -control devices. The traffic engineer shall place and maintain official traffic -control devices when and as required under the traffic ordinances of this city to make effective the provisions of said ordinances, and may place and maintain such additional official traffic -control devices as he may deem necessary to regulate, warn or guide traffic under the traffic ordinances of this city or the Illinois Vehicle Code. Sec. 27-4.2. Manual and specifications for traffic -control devices. All traffic -control signs, signals and devices shall conform to the manual and specifications approved.by the Department of Transportation. All signs and signals required hereunder for a particular purpose shall so far as practicable be uniform as to type and location throughout the city. All traffic -control devices so erected and not inconsistent with the provisions of State law or this ordinance shall be official traffic -control devices. Sec. 27-4.3. Obedience to official traffic -control devices. The driver of any vehicle shall obey the instructions of any official traffic -control device applicable thereto placed in accordance with the provisions of this ordinance, unless otherwise.directed by a traffic or police officer, subject to the exceptions granted the driver of an authorized emer- gency vehicle. Sec. 27-4.4. When official traffic -control devices required for enforcement purposes. No provision of this ordinance for which official traffic -control devices are required shall be enforced against an alleged violator if at the time and place of the alleged violation an official device is not in proper position and sufficiently legible to be seen by an ordinarily observant person. When- ever a particular section does not state that official traffic -control devices -13- are required, such section shall be effective even though no devices are erected or in place. Sec. 27-4.5. Official traffic -control devices - presumption of legality. (a) Whenever official traffic -control devices are placed in position approximately conforming to the requirements of this ordinance, such devices shall be presumed to have been so placed by the official act or direction of lawful authority, unless the contrary shall be established by competent evidence. (b) Any official traffic -control device placed pursuant to the provisions of this ordinance and purporting to conform to the lawful requirements per- taining to such devices shall be presumed to comply with the requirements of this ordinance, unless the contrary shall be established by competent evidence. Sec. 27-4.6. Authority to establish play streets. The traffic engineer shall have authority to declare any street or part thereof a play street and to place appropriate signs or devices in the roadway indicating and helping to protect the same. Sec. 27-4.7. Play streets. Whenever authorized signs are erected indicating any street or part thereof as a play street, no person shall drive a vehicle upon any such street or portion thereof except drivers of vehicles having business or whose residences are within such closed area, and then any said driver shall exer- cise the greatest care in driving upon any such street or portion thereof. Sec. 27-4.8. Designation of crosswalks and establishment of safety zones. The traffic engineer is hereby authorized: 1. To designate and maintain, by appropriate devices, marks, or lines upon the surface of the roadway, crosswalks at intersections where in his opinion there is particular danger to pedestrians crossing the roadway, and at such other places as he may deem necessary. • -14- in such manner as may be determined by the public authority having juris- diction over such highway, street or roadway. Crosswalk. (a) That part of a roadway at an intersection included within the connections of the lateral lines of the sidewalks on opposite sides of the highway measured from the curbs or, in the absence of curbs, from the edges of the traversable roadway; (b) Any portion of a roadway at an intersection or elsewhere distinctly indicated for pedestrian crossing by lines or other markings on the surface placed in accordance with the provisions in the Manual adopted by the Illinois departnient.of.Transportation, as authorized in Sec. 11-301 of the Illinois Vehicle Code. Commercial Vehicle. Any vehicle operated for the transportation of persons or property in the furtherance of any commercial or industrial enterprise, For -Hire or Not -For -Hire not including however a recreational vehicle not being used commercially. Dealer. Every person engaged in the business of buying, selling or exchanging vehicles and who has an established place of business for such purpose in this state. Driver or Operator. Every person who drives or is in actual physical control of a vehicle. Highway. The entire width between the boundary lines of every way publicly maintained when any part thereof is open to the use of the public for purposes of vehicular travel, Intersection. (a) The area embraced within the prolongation or connection of the lateral curb lines, or, if none, then the lateral boundary lines of the roadways of two highways which join one another at, or approximately at, right angles or the area within which vehicles traveling upon different roadways joining at any other angle may come in conflict. -2- (b) Where a highway includes two roadways 40 feet or more apart, then every crossing of each roadway of such divided highway by an inter- secting highway shall be regarded as a separate intersection. (c) The junction of an alley with a street or highway does not con- stitute an intersection. Laned Roadway. A roadway which is divided into two or more clearly marked lanes for vehicular traffic. Loading Zone. The space adjacent to a curb reserved for the exclusive use of vehicles during the loading or unloading of passengers or material. Merging Traffic. A maneuver executed by the drivers of vehicles on converging roadways to permit entry into the junction thereof, wherein the driver of each vehicle involved is required to adjust his vehicular speed and lateral position so as to avoid a collision with any other vehicle. Motor Vehicle. Every vehicle which is self-propelled and every vehicle which is propelled by electric power obtained from overhead trolley wires, but not operated upon rails. Motorcycle. Every motor vehicle having a seat or saddle for the use of the rider and designed to travel on not more than 3 wheels in contact with the ground, but excluding a tractor. National Holiday. January 1, May 30, July 4, first Monday in September (Labor Day), fourth Thursday in November (Thanksgiving), and December 25. Negligent. The word "negligent" as used herein shall mean without due care and caution, or without due regard to the width, grade, curves, corners, traffic and,other attendant conditions of streets, highways, roads, or other ways used for vehicular traffic within the city limits. Owner. A person who holds the legal title of a vehicle or in the event -3- 1*1 t �q_ 0 a vehicle is the subject of an agreement for the conditional sale or lease thereof with the right of purchase upon performance of the condition stated in the agreement and with an immediate right of possession vested in the conditional vendee or lessee, or in the event a mortgagor of a vehicle is entitled to possession, then such conditional vendee or lessee or mort- gagor shall be deemed the owner for the purposes of this chapter. Park or Parking. Means the standing of a vehicle, whether occupied or not, otherwise than when temporarily and actually engaged in loading or unloading merchandise or passengers. Passenger vehicle. A motor vehicle, not a truck or recreational vehicle, designed for the carrying of not more than 10 persons. Pedestrian. Any person afoot. Person. Every natural person, firm, copartnership, association or corporation. Police Officer. Every officer authorized to direct or regulate traffic or to make arrests for violations of traffic regulations. Private Road or Driveway. Every way or place in private ownership and used for vehicular travel by the owner and those having express or implied permission from the owner but not by other persons. Principal Place of Business. The place where any person transacts his principal business, or where he makes up and approves his payroll, main- tains a central file of records and maintains his principal executive of- ffices. In the event that not all of these functions are performed in one place, then that place where a majority of such functions are performed or the place where such person does in fact principally transact and control his business affairs. Railroad. A carrier of persons or property upon cars, other than street- cars, operated upon stationary rails. Railroad Signs or Signal. Any sign, signal or device other than -4- an official traffic control device erected in accordance with the laws governing same and intended to give notice of the presence of railroad tracks or the approach of a railroad train. Railroad Trains. A steam engine, electric or other motor, with or without cars coupled thereto, operated upon rails, except streetcars. Recreational vehicle. Every vehicle originally designed or permanently converted and used for living quarters or"for human habitation and not used as a commercial vehicle, including any house car, house trailer, camper or private living coach. Residence district. The territory contiguous to and including a street not comprising a business district when the property on such street for a distance of three hundred feet or more is in the main improved with residences or residences and buildings in use for business. Right-of-way. The right of one vehicle or pedestrian to proceed in a lawful manner in preference to another vehicle or pedestrian approaching under such circumstances of direction, speed and proximity as to give rise to danger of collision unless one grants precedence to the other. Road Tractor. Every motor vehicle designed and used for drawing other vehicles and not so constructed as to carry any load thereon either independently or any part of the weight of a vehicle or load so drawn. Roadway. That portion of a street improved, designed or ordinarily used for vehicular travel, exclusive of the berm or shoulder. In the event a street includes two or more separate roadways, the term "roadway" as used herein shall refer to any such roadway separately, but not to all such roadways collectively. Safety Zone. The area or space officially set apart within a roadway for 5 the exclusive use of pedestrians and which is protected or is so marked or indicated by adequate signs as to be plainly visible at all 00 times while set apart as a safety zone. p y o e. School Bus. Every motor vehicle owned or operated by or for a public or governmental agency or by or for a private or religious organization for the transportation of pupils in connection with any school activity. Semitrailer. Every vehicle without motive power designed for carrying persons or property and for being drawn by a motor vehicle and so constructed that some part of its weight and that of its load rests upon or is carried by another vehicle. Sidewalk. That portion of a street between the curb lines, or the lateral lines of a roadway, and the adjacent property lines intended for the use of pedestrians. Stand or Standing. Means the halting of a vehicle, whether occupied or not, otherwise than when temporarily and actually engaged in receiving or dis- charging passengers: Stop. When required, means complete cessation from movement. Street. The entire width between boundary lines of every way publicly main- tained when any part thereof is open to the use of the public for purposes of vehicular travel. Through Street or Highway. Every highway or portion thereof on which ve- hicular traffic is given preferential right of way, and at the entrances to which vehicular traffic from intersecting highways is required by law to yield right of way to vehicles on such through highway in obedience to either a stop sign or a yield sign, when such signs are erected as provided in this chapter. Traffic. Pedestrians, ridden or herded animals, vehicles and other -6- conveyances, either singly or together, while using any street for purposes of travel. Traffic Control Signal. Any device whether manually, electricallyor mechan- ically operated, by which traffic is alternately directed to stop and to proceed. Traffic Control Device. Any sign or marking erected, installed, painted or affixed to or adjacent to a roadway or entries to roadways giving notice to vehicle operators of the existence of restrictions on the use, movement, parking, or standing of any motor vehicle, pursuant to the provisions of this code or the Illinois Vehicle Code. Trailer. Every vehicle without motive power in operation, other than a pole trailer, designed for carrying persons or property and for being drawn by a motor vehicle and so constructed that no part of its weight rests upon the towing vehicle. Truck. Every motor vehicle designed, used or maintained primarily for the transportation of property. Truck Tractor. Every motor vehicle designed and used primarily for drawing other vehicles and not so constructed as to carry a load other than a part of the weight of the vehicle and load so drawn. Vehicle. Every device in, upon or by which any person or property is or may be transported or drawn upon a street, except devices moved by human power or used exclusively upon stationary rails or tracks. Yield right-of-way. When required by an official sign means the act of granting the privilege of the immediate use of the intersecting roadway to traffic within the intersection and to vehicles approaching from the right or left, but when the roadway is clear may proceed into the intersection. I ARTICLE II - ADMINISTRATION Sec. 27-2.1. Traffic Engineer. There is hereby established the office of traffic engineer, who shall be appointed by the city manager and be responsible directly to the public works group manager. The position of traffic engineer shall be included in the classified civil service of the city. The compensation of the traffic engineer shall be the sum appropriated for this position by -the annual appropriation ordinance of the city. Sec. 27-2.2. Traffic Engineer - Powers and duties generally. It shall be the duty of the traffic engineer to administer the regula- tions and specifications promulgated by the city council governing crosswalks, safety zones, traffic lanes, loading zones and the erection and maintenance of traffic signs, traffic signals and traffic -control devices. It shall further be the duty of the traffic engineer either upon his own initiative or at the direction of the city manager or the city council to conduct studies of traffic accidents, traffic congestion and other conditions affecting the safe and convenient use of the streets, highways and alleys; to analyze the effect and operation of regulations controlling parking and street traffic; to devise ameliorative action to supervise the placing, maintenance and oper- ation of traffic signs and signals authorized by the city; and, to perform such other duties as shall be ordered from time to time by the city mahager or the city council. In addition to the specific powers and duties given to the traffic engineer elsewhere in this chapter, he shall act as a general advisor to he city council with respect to all traffic matters and traffic legislation. he traffic engineer shall have the authority, either upon his own initiative r upon reference from the city council to investigate, hold hearings when ecessary and to recommend suitable legislation by the city council with we respect to all traffic matters. Sec. 27-2.3. Traffic Engineer - Authority to make regulations. The traffic engineer, with the approval of the city manager, is hereby empowered to make regulations necessary to make effective the provisions of this chapter and the other ordinances of the city regulating traffic. Nothing contained herein shall be construed to enable the traffic engineer to implement regulations which are contrary to regulations published by the Illinois Department of Transportation. Sec. 27-2.4. Traffic Engineer - To designate method of identifying funeral processions. The traffic engineer shall designate a type of pennant or other identifying insignia to be displayed upon, or other method to be employed to identify, the vehicles in funeral processions. M 2. To establish safety zones of such kind and character and at such places as he may deem necessary for the protection of pedestrians. Sec. 27-4.9. Traffic lanes. The traffic engineer is hereby authorized to mark traffic lanes upon the roadway of any street or highway where a regular alignment of traffic is necessary. Sec. 27-4.10. Markings upon the Roadway. The traffic engineer is hereby authorized to mark the roadway of any public way to give notice to users thereof of regulations or restrictions pertaining to the movement of traffic thereon. -15- L11 f ARTICLE V - SPEED REGULATIONS Sec. 27-5.1. State speed laws applicable. The Illinois Vehicle Code regulating the speed of vehicles shall be applicable upon all streets within this city, except as this ordinance, as authorized by the Illinois Vehicle Code, hereby declares and determines upon the basis of an engineering and traffic investigation that certain speed regulations shall be applicable upon specified streets or in certain.areas, in which event it shall be unlawful for any person to drive a vehicle at a speed in excess of any speed so declared in this ordinance when signs are in place giving notice thereof. Sec. 27-5.2. Increasing State speed limits in certain zones. It is hereby determined upon the basis of an engineering and traffic investigation that the speed permited by State law upon those streets or portions thereof described in Schedule I is less than is necessary for safe operation of vehicles thereon by reason of the designation and signposting of said streets as through highways, or by reason of widely spaced intersections, and it is hereby declared that the maximum speed limit upon those streets or portions thereof described in Schedule I shall be as therein stated, which speeds so declared shall be effective at the time specified therein when signs are erected giving notice thereof. Sec. 27-53. Decreasing State speed limits in certain zones. It is hereby determined upon the basis of an engineering and traffic investigation that the speed permitted by State law upon those streets or portions thereof described in Schedule II is more than is necessary for safe operation of vehicles thereon by reason of the narrowness of said streets, pedestrian and vehicular traffic thereon, and the closely spaced intersecting streets, and it is hereby declared that the maximum speed limit upon those streets or portions thereof described in Schedule II shall be as therein stated, which speeds so declared shall be effective at the time specified -16- therein when signs are erected giving notice thereof. Sec. 27-5.4. Regulation of speed by traffic signals. The traffic engineer is authorized to regulate the timing of traffic signals so as to permit the movement of traffic in an orderly and safe manner at speeds slightly at variance from the speeds otherwise applicable within the area, or at intersections and shall erect appropriate signs giving notice thereof. l • -17- ARTICLE VI - TURNING MOVEMENTS Sec. 27-6.1. Authority to place devices altering normal course for turns. The traffic engineer is authorized to place official traffic -control devices within or adjacent to intersections indicating the course to be traveled by vehicles turning at such intersections, and such course to be traveled as so indicated may conform to or be other than as prescribed by law. Sec. 27-6.2. No turns. Turning movements including right and left hand turns and U turns shall be prohibited on streets or portions of streets and alleys designated in Schedule III, attached hereto, when properly signposted. Sec. 27-6.3. Limitations on turning around. The driver of any vehicle shall not turn such vehicle so as to proceed in the opposite direction upon any street in a business district and shall not upon any other street so turn a vehicle unless such movement can be made in safety and without interfering with other traffic. t • ARTICLE VII - ONE-WAY STREETS AND ALLEYS Sec. 27=7.1. Authority to sign one-way streets and alleys. Whenever any ordinance of this city designates any one-way street or alley, the traffic engineer shall place and maintain signs giving notice thereof, and no such regulation shall be effective unless such signs are in place. Signs indicating the direction of lawful traffic movement shall be placed at every intersection, including the junction of an alley with a street or highway, where movement of traffic in the opposite direction is prohibited. Sec. 27-7.2. One-way streets and alleys. Upon those streets and parts of streets and in those alleys described in Schedule IV, attached hereto and made a part hereof, vehicular traffic shall move only in the indicated direction when signs indicating the direction of traffic are erected and maintained at every intersection, including the junction of an alley with a street or highway, where movement in the opposite direction is prohibited. Sec. 27-7.3. Authority to restrict direction of movement on streets during certain periods. The traffic engineer is hereby authorized to determine and designate streets, parts of streets or specific lanes thereon upon which vehicular traffic shall proceed in one direction during one period and the opposite direction during another period of the day and shall place and maintain appropriate markings, signs, barriers or other devices to give notice thereof. The traffic engineer may erect signs temporarily designating lanes to be used by traffic moving in a particular direction, regardless of the center line of the roadway. 0 • -19- Is ARTICLE VIII - STOP AND YIELD INTERSECTIONS Sec. 27-8.1. Through streets designated. Those streets and parts of streets described in Schedule V, attached hereto and made a part hereof, are hereby declared to be through streets for the purpose of this ordinance. Sec. 27-8.2. Signs required at through streets. Whenever any ordinance of this city designates and describes a through street it shall be the duty of the traffic engineer to place and maintain a stop sign, or on the basis of an engineering and traffic investigation at any intersection a yield sign, on each and every street intersecting such through street unless traffic at any such intersection is controlled at all times by traffic -control signals; provided, however, that at the intersection of two such through streets or at the intersection of a through street and a heavy traffic street not so designated, stop signs shall be erected at the approaches of either of said streets as may be determined by the traffic engineer upon the basis of an engineering and traffic study. _# -20- ARTICLE IX - MISCELLANEOUS DRIVING RULES Sec. 27-9.1. Stop when traffic obstructed. No driver shall enter an intersection or a marked crosswalk unless there is sufficient space on the other side of the intersection or crosswalk to accomodate the vehicle he is operating without obstructing the passage of other vehicles or pedestrians, notwithstanding any traffic -control signal indication to proceed. Sec. 27-9.2. Driving through funeral or other procession. No driver of a vehicle shall drive between the vehicles comprising a funeral or other authorized procession while they are in motion and when such vehicles are conspicuously designated as required in this ordinance. This provision shall not apply at intersections where traffic is controlled by traffic -control signals or police officers. Sec. 27-9.3. Drivers in a procession. Each driver in a funeral or other procession shall drive as ISnear to the right-hand edge of the roadway as practicable and shall follow the vehicle ahead as close as is practicable and safe. Sec. 27-9.4. Funeral processions to be identified. A funeral composed of a procession of vehicles shall be identified as such by the display upon the outside of each vehicle of a pennant or other identifying insignia or by such method as may be determined and designated by the traffic engineer. Sec. 27-9.5. When permits required for funerals and processions. No procession or parade, excepting a funeral procession, forces of the U. S. Army and Navy, the military forces of the State, and forces of the Department of Police and the Fire Department of the City shall occupy, march or proceed along any street except in accordance with a permit issued by the City Council, and such other regulations as are set forth in this chapter which may apply. Nothing in this ordinance shall apply to processions -21- or parades which utilize the sidewalks rather than the street. A person seeking issuance of a parade permit shall file an application with the city manager on forms provided by the city manager for such purpose. Such application shall be filed not less than 10 days nor more than 365 days before the date on which it is proposed to conduct the parade. The application for a parade permit shall set forth the following information: (a) the name, address and telephone number of the person seeking to conduct such parade; (b) if the parade is proposed to be conducted for, on behalf of, or by an organization, the name, address and telephone number of the headquarters of the organization, and of the authorized and responsible heads of such organization; (c) the name, address and telephone number of the person who will be the parade chairman and who will be responsible for its conduct; (d ) the date when the parade is to be conducted; (e) the route to be traveled, the starting point and the termination point; (f) the approximate number of persons who, and animals and vehicles which, will constitute such parade; the type of animals, and description of the vehicles; (g) the hours when such parade will start and terminate; (h) a statement as to whether the parade will occupy all or only a portion of the width of the streets proposed to be traversed; (i) the location by streets of any assembly areas for such parade; (j) the time at which units of the parade will begin to assemble at any such assembly area or areas; (k) the interval of space to be maintained between units of such parade; -22- (1) if the application for a parade permit is made by an agent rather than the individual responsible for the parade, the applicant shall file with the city manager a written statement authorizing the agent to act on behalf of the applicant. This provision shall not apply to a duly authorized officer of an organization which complies with subparagraph (b) of this section; (m) any additional information which the city manager shall find reasonably necessary to fairly evaluate as to whether a permit should issue. The city manager shall submit said application to the city council together with his comments and recommendations with respect to said application. The city council shall issue a parade permit if it shall find that: (1) the conduct of the parade will not substantially interrupt the safe and orderly movement of pedestrian and vehicular traffic on and con- tiguous to its route or unreasonably interfere with the rights of other persons who utilize the public ways: (2) the conduct of the parade will not tend to cause or promote a breach of the peace, cause injury to persons or property, provoke disorderly conduct or create a public nuisance; (3) the purpose of the parade is not unlawful; (4) the conduct of the parade will not unreasonably affect or interrupt business and commerce within the area to be traversed. The city council may alter the proposed route or change the hours requested if such alterations or changes are necessary to meet the foregoing standards. Incident to the conduct of a parade for which a permit has been issued, the city shall provide such services, and only such services, as are deemed • necessary by the city manager to promote public safety and order. Sec. 27-9.6. Driving under the influence. (a) No person who is under the influence of intoxicatingliquor q uor may drive or be in actual physical control of any vehicle within the corporate -23- limits of the City of Evanston. (b) No person who is a habitual user of or under the influence of any narcotic drug or who is under the influence of any other drug to a degree which render him incapable of safely driving a vehicle may drive or be in actual physical control of any vehicle within the corporate limits of the City of Evanston. It shall not be a defense that a person charged with a violation of this subsection is or has been entitled to use such drug under the laws of the State of Illinois. (c) The admission into evidence of the amount of alcohol in the person's blood at the time of the act alleged as shown by chemical analysis of his breath, blood, urine, saliva or other bodily substance, shall be as prescribed by the laws of the State of Illinois and shall give rise to such presumptions, if any, as provided by the laws of the State of Illinois. Sec. 27-9.7. Negligent driving. It shall be unlawful for any person to operate any vehicle upon a public way, negligently, heedlessly, and without due caution in a manner so as to endanger or be likely to endanger any person or property. Sec. 27-9.8. Clinging to moving vehicles. No person shall cling to or attach himself or any device upon which he is riding to any vehicle traveling upon the streets or alleys of the city. It shall be unlawful for the driver of any motor vehicle knowingly to permit any person to cling to or attach himself or any device upon which he is riding to the vehicle operated by said driver. Sec. 27-9.9. Boarding or alighting from vehicles. No person shall board or alight from any vehicle while such vehicle is in motion. Sec. 27-9.10. Unlawful riding. No person shall ride on any vehicle upon any portion thereof not designed 4P or intended for the use of passengers. This provision shall not apply to -24- to an employee engaged in the necessary discharge of a duty, or to persons riding within truck bodies in space intended for merchandise. -25- r ARTICLE X - PEDESTRIANS' RIGHTS AND DUTIES Sec. 27-10.1. Crossing at right angles. Except where otherwise indicated by a crosswalk or other official traffic -control devices, a pedestrian shall cross a roadway at right angles to the curb or by the shortest route to the opposite curb. Sec. 27-10.2. Prohibited crossing. (a) No pedestrian shall cross a roadway other than in a crosswalk in any business district. (b) No pedestrian shall cross a roadway other than in a crosswalk upon any through street marked with a crosswalk. Sec. 27-10.3. Obedience of pedestrians to bridge and railroad traffic. (a) No pedestrian shall enter or remain upon any bridge or approach thereto beyond the bridge signal, gate, or barrier after a bridge operation signal indication has been given. (b) No pedestrian shall pass through, around, over, or under any crossing gate or barrier at a railroad grade crossing or bridge while such gate or barrier is closed or is being opened or closed. Sec. 27-10.4. Drivers to exercise due care. Notwithstanding other provisions of this ordinance every driver of a vehicle shall exercise due care to avoid colliding with any pedestrian upon any roadway and shall give warning by sounding the horn when necessary and shall exercise proper precaution upon observing any child or any obviously confused or incapacitated person upon a roadway. -26- ARTICLE XI - REGULATIONS FOR BICYCLES Sec. 27-11.1. Registration required. No person who resides within the city shall ride or propel a bicycle on any street or upon any public way within the city unless such bicycle has been registered and a registration plate is attached thereto, as pro- vided in this article. Sec. 27-11.2. Registration - issuance. The police department shall issue a permanent registration plate upon receipt of the proper application and evidence of payment of the registration fee. The department shall affix the registration plate to the left side of the vertical section of the frame under the seat. No person shall remove the registration plate from the bicycle at any time. Sec. 27-11.3. Finance Director to collect fees and keep record of registrations and fees collected. The finance director shall collect a registration fee of 50 cents per bicycle and shall keep a record of the date of issuance, the name and address of the person to whom issued, the number on the frame of the bicycle for which issued, the permanent registration number of the bicycles, and a record of all bicycle registration fees collected by him. Sec. 27=11.4. -When chief of police not to approve issuance of registration plate. The chief of police shall not approve the issuance of a registration plate for any bicycle when he knows, or has any reasonable grounds to believe, that the applicant is not the owner of, or entitled to possession of, such bicycle, or when the bicycle is not properly equipped in accordance with the provisions of this chapter and other ordinances of the city. Sec. 27-11.5. Registration - duty of registered owner upon sale or other disposal of bicycle. Upon the sale or other disposal of a registered bicycle, the registered owner or the new owner shall notify the police department in writing upon a -27- form provided for this purpose. Sec. 27-11.6. Impounding unregistered bicycles. The chief of police shall cause the impounding of unregistered bicycles and shall retain possession of such bicycles until satisfactory proof of ownership is received. Upon receipt of this proof of ownership, and evidence of payment of the registration fee, a permanent registration plate shall be affixed to the bicycle. Sec. 27-11.7. Duty of rental agencies. A rental agency shall not rent or offer any bicycle for rent unless the bicycle is registered and a registration plate is attached thereto as provided in this article, and such bicycle is equipped with the equipment required for operation by the provisions of this chapter and other ordinances of the city. Sec. 27-11.8. Responsibility of parent. If the person subject to the requirements of this article is a minor, the duties herein imposed shall be performed by his parent or guardian. Sec. 27-11.9. Obedience to traffic -control devices. (a) Any person operating a bicycle shall obey the instructions of official traffic -control devices applicable to vehicles, unless otherwise directed by a police officer. (b) Whenever authorized signs are erected indicating that no right or left or U turn is permitted, no person operating a bicycle shall disobey the direction of any such sign, except where such person dismounts from the bicycle to make any such turn, in which event such person shall then obey the regulations applicable to pedestrians. Sec. 27-11.10. Parking. No person shall park a.bicycle upon a street other than upon the the roadway against the curb or upon the sidewalk in a rack to support the bicycle or against a building or at the curb, in such manner as to afford -28- • the least obstruction to pedestrian traffic. Sec. 27-11.11. Riding on sidewalks. (a) No person shall ride a bicycle upon a sidewalk within a business district. (b) Whenever any person -is riding a bicycle upon a sidewalk, such person shall yield th.e right of way to any pedestrian and shall give audible signal before overtaking and passing such pedestrian. Sec. 27-11.12. Bicycle routes. The traffic engineer by and with the consent of the city council is authorized to designate certain streets or portions thereof as bicycle routes. Upon such designation, signs shall be erected giving notice thereof. Those streets or portions thereof so designated shall be maintained in Schedule XVI attached hereto and made a part hereof. -29- 1/22/76 1 L� the least obstruction to pedestrian traffic. Sec. 27-11.11. Riding on sidewalks. (a) No person shall ride a bicycle upon a sidewalk within a business district. (b) No person 15 or more years of age shall ride a bicycle upon any sidewalk in any district. (c) Whenever any person is riding a bicycle upon a sidewalk, such person shall yield the right of way to any pedestrian and shall give audible signal before overtaking and passing such pedestrian. Sec. 27-11.12. Bicycle routes. The traffic engineer by and with the consent of the city council is authorized to designate certain streets or portions thereof as bicycle routes. Upon such designation, signs shall be erected giving notice thereof. -29- ARTICLE XII - STOPPING, STANDING, PARKING GENERALLY Sec. 27-12.1. Parking not to obstruct traffic. No person shall park any vehicle upon a street, other than an alley, in such a manner or under such conditions as to obstruct the free movement of traffic. Sec. 27-12.2. Parking prohibited in specified places. No person shall park a motor vehicle, except when necessary to avoid conflict with other traffic or in compliance with the directions of a police officer or a traffic control device, in any of the following places: 1. on a sidewalk or parkway; 2. within 8 feet of a public.or private driveway or alley; 3. within an intersection; 4. within 15 feet of a fire hydrant; 5. on a crosswalk; 6. within 20 feet of a crosswalk at an intersection; 7. within 20 feet upon and along the approach of any flashing beacon, stop sign, or traffic -control signal located in the side of a roadway; 8. within 50 feet of the nearest rail of a railroad grade crossing; 9. within 20 feet of the driveway entrance to any fire station and on the side of a street opposite the entrance to any fire station within 75 feet of said entrance when properly signposted. Sec. 27-12.3. Parking for certain purposes prohibited. It shall be unlawful for any person to park or place any automobile, truck, trailer or other vehicle upon or in any street, alley or parkway for the purpose of selling or offering the same for sale or rent. No sign or lettering shall be attached or placed upon any automobile, truck, trailer or other vehicle parked in or upon any public street, alley or parkway of the city indicating that such vehicle is offered for sale or for rent. It • shall also be unlawful to park any vehicle upon any street in a business district from which any merchandise is being sold. -30- Sec. 27-12.4. Emergency parking. Nothing contained in this article shall be construed to prohibit emergency vehicles or vehicles operated by physicians on emergency calls from parking or standing such a motor vehicle in a zone where parking or standing is otherwise prohibited, during the course of said emergency call. Sec. 27-12.5. Parking in alleys within the business district. It shall be unlawful for the operator of any vehicle to park the same in any alley within a business district; provided, however, that nothing herein shall be construed to prohibit the parking of delivery trucks while actually engaged in the delivery or picking up of merchandise or material. Sec. 27-12.6. Parking in Predominantly Residential Areas. It shall be unlawful for any person to park a vehicle, other than a passenger vehicle as defined in this Chapter, in any street of any block in which more than one-half of the buildings in such block are used exclusively for residential purposes, for a longer period than is necessary for the reasonably expeditious loading or unloading of such vehicles. Any person violating the provisions of this section shall be fined not less than Five dollars nor more than Twenty-five dollars for each offense. Sec. 27-12.7. Parking in alleys within residence districts. It shall be unlawful for the operator of any vehicle to park the same in the alley of any residence district, defined in Article I of this ordinance, except with the left or right wheels of the vehicle within twelve inches of the west side of north and south alleys and the south side of east and west alleys, except where parking on both or a different side of the alleys shall have been provided for or prohibited by ordinance and so indicated. Nothing herein shall be construed to permit parking in those alleys where by ordinance all parking shall have been prohibited. • Sec. 27-12.8. Parking on private property. No person shall stand or park a vehicle on any private lot or lot area -31- I 2 without the express or implied consent of the owner thereof. Whenever signs or markings have been erected on any lot or lot area, contiguous or adjacent to a street, thoroughfare or alley indicating that no vehicles are permitted to stand or park thereon, it shall be unlawful for any person to drive a vehicle across any curb or lot line or over any driveway from a street or I alley into such lot or area for the purpose of standing or parking such vehicle, or for any person to stop, stand or park any vehicle in such lot or lot area. Sec. 27-12.9. Parking near school property. Whenever an entrance to school property is used as an entrance or exit for school children, it shall be unlawful to park any vehicle on the school side of the street between the property lines of such school property between the hours of 8:00 A.M. and 4:00 P.M. on any school day; provided that signs are erected giving notice thereof. Sec. 27-12.10. Method of parking. Every vehicle stopped or parked upon a roadway where there is an adjacent curb shall be so stopped or parked with the right-hand wheels of such vehicle parallel with and within twelve inches of the right-hand curb, except as other- wise provided in the following paragraphs: (a) Upon those streets which have been marked or signed for angle parking, vehicles shall be parked at the angle to the curb indicated by such marks or signs. (b) Upon one-way streets or any alley where signs have been erected indicating that parking is permitted upon the left-hand side of any such street or alley, vehicles parking in such areas shall be parked with the left-hand wheels of such vehicle parallel with and within twelve inches of the left-hand curb. (c) In places where and at hours when stopping for loading or unloading -32- . _.,.. - � .,.-.. _ .ate.,.... ... ..... ..,. .. ._ ..«....m .. �._ n � � _.,...3�.. .fr ... of merchandise or materials is permitted, vehicles used for the transportation of merchandise and materials may back into the curb to take on or discharge loads when the owner of such vehicle holds a permit granting him such privilege. Such permit shall be either in the possession of the driver or on the vehicle at the time such vehicle is backed against the curb to take on or discharge a load. Sec. 27-12.11. Unattended motor vehicles. No person driving or in charge of a motor vehicle shall permit it to stand unattended without first stopping the engine, locking the ignition and removing the key, or when standing upon any perceptible grade, without effectively setting the brake thereon and turning the front wheels to the curb or side of the street or highway. Sec. 27-12.12. Signs or markings indicating angle parking. (a) The traffic engineer shall determine upon what streets angle parking shall be permitted and shall mark or sign such streets, but such angle parking shall not be indicated upon any Federal -aid or State highway within this city unless the Illinois Department of Transportation has determined by resolution or order entered in its minutes that the roadway is of sufficient width to permit angle parking without interfering with the free movement of traffic. (b) Angle parking shall not be indicated or permitted at any place where passing traffic would thereby be caused or required to drive upon the left side of the roadway. Sec. 27-12.13. Alternate night parking. To facilitate the cleaning of streets and public thoroughfares within the City of Evanston, the City is hereby divided into six (6) districts. When signs e are erected giving notice thereof it shall be unlawful, where parking is not • otherwise prohibited, for any person to stop, stand, park or leave unattended a motor vehicle upon the following described streets upon the days and between the • hours hereinafter set forth: -33- A) DISTRICT ONE: All that part of the City lying east of the west line of Ridge Avenue, and south of a line commencing at a point, being the inter- section of the north line of Dempster Street and the west line of Ridge Avenue; thence east along the said north line of Dempster Street to the center of the right-of-way of the Milwaukee Division of the Chicago and Northwestern Railway Company; thence southerly along the centerline of said right-of-way to the north line of Lee Street thence east along the north line of Lee Street to the east city limits; (1) Between the hours of nine o'clock AM (9:00 A.M.) and three o'clock P.M. (3:00 P.M.). a) On the south side of all streets and public thoroughfares extending in a general easterly and westerly direction and on the west side of all streets and public thoroughfares extending in a general northerly and southerly direction on each Tuesday. b) On the north side of all streets and public thoroughfares extending in a general easterly and westerly direction, and on the east side. of all streets and public thoroughfares extending in a general northerly and southerly direction on each Wednesday. B) DISTRICT TWO: All that part of the City lying south of the north line of Main Street and west of the west line of Ridge Avenue. (1) Between the hours of two o'clock A.M. (2:00 A.M.) and six o'clock A.M. (6:00 A.M.). a) On the south side of all streets and public thoroughfares extending in a general easterly and westerly direction, and on the west side of all streets and public thoroughfares extending in a general northerly and southerly direction on each Monday. b) On the north side of all streets and public thoroughfares extending • in a general easterly and westerly direction, and on the east side • of all streets and public thoroughfares extending in a general -34- FA • northerly and southerly direction on each Thursday. C) DISTRICT THREE: All that part of the City south of the north line of Lake Street and north of a line commencing at a point being the intersection of the west City limits and the north line of Main Street extended thence easterly along the north line of Main Street to the west line of Ridge Avenue thence northerly along the west line of Ridge Avenue to the north line of Dempster Street thence easterly along the north line of Dempster Street to the center of the right-of-way of the Milwaukee Division of the Chicago and Northwestern Railway and thence southerly along the center line of the aforesaid right-of-way to the intersection thereof with the north line of Lee Street thence easterly along the north line of Lee Street to the east City limits: (1) Between the hours of two o'clock A.M. (2:00 A.M.) and six o'clock P.M. (6:00 A.M.). a) On the south side of all streets and public thoroughfares extending in a general easterly and westerly direction, and on the west side of all streets and public thoroughfares extending in a general northerly and southerly direction on each Monday. b) On the north side of all streets and public thoroughfares extending in a general easterly and westerly direction, and on the east side of all streets and public thoroughfares extending in a general and northerly and southerly direction on each Thursday. D) DISTRICT FOUR: All that part of the City lying north of the north line of Lake Street and south of a line commencing at a point being the inter- section of the west line of McCormick Boulevard and the south line of Elgin Road and thence north, northeasterly along said west line, thence becoming the north line of McCormick Boulevard to the east line of Bridge Street, thence east, southeasterly along the east lime of Bridge Street to its intersection with the north line of Simpson Street and thence easterly along the north line of Simpson Street and the same extended to the east t • 4 El City limits: ; also that part of Sherman Avenue extending north from the north line of Simpson Street to the south line of Colfax Street: (1) Between the hours of two o'clock A.M. (2:00 A.M.) and six o'clock A.M. (6:00 A.M.). a) On the south side of all streets and public thoroughfares extending in a general easterly and westerly direction, and on the west side of all streets/and public thoroughfares extending in a general northerly and southerly direction on each Tuesday. b) On the north side of all streets and public thoroughfares ex- tending in a general easterly and westerly direction, and on the east side of all streets and public thoroughfares extending in a general northerly and southerly direction on each Friday. E) DISTRICT FIVE: All that part of the City lying north of the north line of Simpson Street and the same extended east to the City limits and east of the line commencing at a point being the intersection of the north City limits and the center of the right-of-way of the Milwaukee Division of the Chicago Northwestern Railway and thence south easterly along the center of the aforesaid right-of-way to the intersection thereof with the north line of McCormick Boulevard as extended east and thence South- westerly along the north line of McCormick Boulevard to its intersection with the east line of Bridge Street and thence easterly along said east line of Bridge Street to the intersection of the north line of Simpson; provided, however, that that portion of Sherman Avenue which extends from the north line of Simpson Street to the south line of Colfax Street shall be excluded therefrom: (1) During the months of April, May, June, July, August, September, October, November between the hours of two o'clock A.M. (2:00 A.M. and six o'clock A.M. (6:00 A.M.). -36- .1. .. .&-. r a) On the south side.of all streets and public thoroughfares extending in a general easterly and westerly direction, and on the west side of all streets and public thoroughfares extending in a general northerly and southerly direction on each Wednesday. b) On the north side of all streets and public thoroughfares extending in a general easterly and westerly direction, and on the east side of all streets and public thoroughfares extending in a general northerly and southerly direction on each Friday. (2) During the months of December, January, February, and March, between the hours of two o'clock A.M. (2:00 A.M.) and.six o'clock A.M. (6:00 A.M.). a) on the south side of all streets and public thoroughfares extending in a general easterly and westerly direction and on the west side of all streets and public thoroughfares extending in a general northerly and southerly direction on Monday, Wednesday, and Friday of each week. b) On the north side of all streets and public thoroughfares extending in a general easterly and westerly direction, and on the east side of all streets and public thoroughfares extending in a general northerly and southerly direction on Tuesday, Thursday and Saturday of each week. F) DISTRICT SIX: All that part of the City lying west of the line commencing at a point being the intersection of the north City limits and the center line of the right-of-way of the Milwaukee Division of the Chicago and Northwestern Railway Company and thence southeasterly along aforesaid center line of the right-of-way of the Chicago and Northwestern Railway Company to the • intersection thereof with the north line of McCormick Boulevard extended -37- east, thence southwesterly along the north line of McCormick Boulevard to the intersection thereof with the south line of Elgin Road: (1) During the months of April, May, June, July, August, September, October, and November between the hours of two o'clock A.M. (2:00 A.M.) and six o'clock A.M. (6:00 A.M.). a) On the south side of all streets and public thoroughfares extending in a general easterly and westerly direction, and on the west side of all streets and public throughfares extending in a general northerly and southerly direction on each Wednesday. b) On the north side of all streets and public thoroughfares extending in a general easterly and westerly direction, and on the east side of all streets and public thoroughfares extending in a general northerly and southerly direction on each Tuesday. (2) During the months of December, January, February and March between the hours of two o'clock A.M. (2:00 A.M.) and six o'clock A.M. (6:00 A.M.). a) On the south side of all streets and public thoroughfares extending in a general easterly and westerly direction, and on the west side of all streets and public throughfares extending in a general northerly and southerly direction on Monday, Wednesday and Friday of each week. b) On the north side of all streets and public thoroughfares extending in a general easterly and westerly direction and on the east side of all streets and public thoroughfares extending in a general northerly and southerly direction on Tuesday, Thursday and Saturday of each week. 4 Sec. 27-12.15. Parking during a snow emergency. To facilitate the removal of snow and to assure the regular flow of traffic during and after snowfalls, the streets and public thoroughfares designated in Schedule VI attached hereto and made a part hereof are declared to be Snow Routes. Sec. 27-12.16. Snow emergency - stopping, standing, parking prohibited. When signs have been erected giving notice thereof it shall be unlawful for any person to stop, stand, park, or leave unattended any motor vehicle upon a designated snow route, within the City during a SNOW EMERGENCY. Sec. 27-12.17. Snow emergency defined. A Snow Emergency is hereby declared to be in effect immediately after two (2) inches of snow have accumulated and shall remain in effect for the period of 24 hours thereafter or until the snow has been plowed to the curb lines. Sec. 27-12.18. Snow emergency - movement of parked vehicles. Whenever a motor vehicle has been stopped, parked, or left unattended after the inception of a Snow Emergency, upon a designated snow route within the City, said vehicle is hereby declared to be a traffic hazard and the Chief of Police shall order said motor vehicle removed pursuant to the provisions of Sections 27-19.1 through 27-19.14 of this ordinance. Sec. 27-19. Snow removal - deposit in certain places prohibited. (a) No person shall deposit or cause to be deposited any snow upon any street or public thoroughfare. (b) No person shall deposit or cause to be deposited upon any street or public thoroughfare of the City in such a manner as to obstruct a public side- walk nor shall any person deposit or cause to be deposited any snow upon a • parkway or upon private property so as to obstruct a clear view at the inter- section or traveled roadways. -39- r • Sec. 27-12.20. Penalties. Any person, firm or corporation who violates the provisions of Sections 27-12.15 through 27-12.19. shall be guilty of an offense punishable by a fine of not less than Three dollars ($3.00) nor more than Two hundred dollars ($200.00). Any violator may avoid prosecution for violating the provision of this ordinance by paying to the Clerk of the Circuit Court the minimum applicable penalty provided, prior to the initiation of legal action against the violator, by surrendering the traffic ticket or other notice of violation, either received or placed upon said vehicle. Any person making such payment shall receive a receipt therefor from the Clerk of the Circuit Court. r40- ARTICLE XIII - STOPPING FOR LOADING OR UNLOADING Sec. 27-13.1. Traffic engineer to designate curb loading zones. The traffic engineer is hereby authorized to determine the location of passenger and freight curb loading zones and shall place and maintain appropriate signs indicating the same and stating the hours during which the provisions of this section are applicable. Sec. 27-13.2. Permits relative to loading or unloading. The traffic engineer is authorized to issue to any owner of a vehicle used to transport merchandise or material a special permit renewable annually, and to state therein the terms and conditions thereof, allowing the driver of such vehicle the privilege of loading and unloading the same while the vehicle is parked or backed against the curb, whenever such privilege is reasonably necessary for the conduct of the owner's business and will not seriously interfere with traffic. It shall be unlawful for any owner or driver to violate any of the special terms or conditions of any such permit. Sec. 27-13.3. Permits for curb loading zones. The traffic engineer shall not hereafter designate or sign any curb loading zone upon special request of.any person unless such person makes application for a permit for such zone and for two signs to indicate the ends of each such zone. Upon granting a permit and issuing such signs, the finance director shall collect from the applicant and deposit in the city treasury a service fee of $10.00 per year or fraction thereof. The traffic engineer may by general regulations impose conditions upon the use of such signs and for reimbursement of the city for the value thereof in the event of their loss or damage and their return in the event of misuse or upon expiration of permit. Every such permit shall expire at the end of one year. • Sec. 27-13.4. Standing in passenger curb loading zone. No person shall stop, stand, or park a vehicle for any purpose or period -41- of time other than for the expeditious loading or unloading of passengers in any place marked as a passenger curb loading zone during hours when the regulations applicable to such curb loading zone are effective, and then only for a period not to exceed three minutes. Sec. 27-13.5. Standing in freight curb loading zone. No person shall stop, stand or park a vehicle for any purpose or length of time other than for the expeditious unloading and delivery or pick-up and loading of materials in any place marked as a freight curb loading zone during hours when the provisions applicable to such zones are in effect. In no case shall the stop for loading and unloading of materials exceed 30 minutes. Sec. 27-13.6. Traffic engineer to designate public carrier stops and stands. The traffic engineer shall with the consent of the city council establish bus stops, bus stands, taxicab stands and stands for other passenger common -car- rier motor vehicles on such public streets in such places and in such number as shall be determined to be of the .greatest benefit and convenience to the public, and every such bus stop, bus stand, taxicab stand or other stand shall be designated by appropriate signs. Sec. 27-13.7. Stopping, standing, parking of buses and taxicabs regulated. (a) The operator of a bus shall not stand or park such vehicle upon any street at any place other than a bus stand so designated as provided herein. (b) The operator of a bus shall not stop such vehicle upon any street at any place for the purpose of loading or unloading passengers or their baggage other than at a bus stop, bus stand or passenger loading zone so designated as provided herein, except in case of an emergency. (c) The operator of a bus shall enter a bus stop, bus stand or passenger loading zone on a public street in such a manner that the bus when stopped to load or unload passengers or baggage shall be in a position with the right front • wheel of such vehicle not farther than 18 inches frEmn the curb and the bus • -42 r. U1 approximately parallel to the curb so as not to unduly impede the movement of other vehicular traffic. (d) The operator of a taxicab while for hire shall not stand or park such vehicle upon any street at any place other than in a taxicab stand so designated as provided herein. This provision shall not prevent the operator of a taxicab from temporarily stopping in accordance with other stopping or parking regulations at any place for the purpose of and while actually engaged in the expeditious loading or unloading of passengers. Sec. 27-13.8. Restricted use of bus and taxicab stands. No person shall stop, stand or park a vehicle other than a bus in a bus stop, or other than a taxicab in a taxicab stand when any such stop or stand has been officially designated and appropriately signed, except that the driver of a passenger vehicle may temporarily stop therein for the purpose of and while actually engaged in loading or unloading passengers when such stopping does not interfere with any bus or taxicab waiting to enter or about to enter such zone. Sec. 27-13.9. Designation of passenger loading zones and public carrier stops and stands. It having been determined from traffic studies that the areas designated in Schedule VII are necessary for the safety of pedestrian and vehicular traffic, those areas designated in Schedule VII are hereby declared to be loading zones, public carrier stops and stands. -43- ARTICLE XIV - STOPPING, STANDING OR PARKING RESTRICTED OR PROHIBITED ON CERTAIN STREETS Sec. 27-14.1. Application. The provisions of this article prohibiting the standing or parking of a vehicle shall apply at all times or at those times herein specified or as i di- sated on official signs except when it is necessary to stop a vehicle to avoid F[r, conflict with other traffic or in compliance with the direction of a police F, officer or official traffic -control device. Sec. 27-14.2. Regulations not exclusive. The provisions of this article imposing a time limit on parking shall not relieve any person from the duty to observe other and more restrictive provisions r prohibiting or limiting the stopping, standing or parking of vehicles in specified places or at specified times. Sec. 27-14.3. Parking prohibited at all times on certain streets. When signs are erected giving notice thereof, no person shall park a vehicle at any time upon any of the streets described in Schedule VIII, attached to and made a part of this ordinance. Sec. 27-14.4. Parking prohibited during certain hours on certain streets. When signs are erected in each block giving notice thereof no person shall park a vehicle between the hours specified in Schedule IX on the days therein specified upon any of the streets or portions of streets described in said Schedule IX, attached to and made a part of this ordinance. Sec. 27-14.5. Limited parking permitted. When signs are erected in each block giving notice thereof no person shall park a motor vehicle for a period greater than that designated in Schedule X upon those streets or portions of streets indicated in said Schedule X on any day except Saturday, Sunday and National Holidays. Sec. 27-14.6. Parking signs required. . Whenever by this or any other ordinance of this city any parking time limit -44- i is imposed or parking is prohibited on designated streets it shall be the duty of the traffic engineer to erect appropriate signs giving notice thereof and no such regulations shall be effective unless said signs are erected and in place at the time of any alleged offense. -45- l� is • ARTICLE XV - RESERVED PARKING AREAS Sec. 27-15.1. Designated. The areas designated in Schedule XI are hereby declared to be reserved space parking areas for the parking and storage of passenger motor vehicles by those persons who shall be granted an allotted space therein as provided in this article. Sec. 27-15.2. Permit required - application and fee. It shall be unlawful for any person to park a vehicle in the reserved parking areas designated in Section 27-15.1 of this Code, unless the owner or operator of such vehicle shall have received from the finance director a permit for such parking and shall have paid the charges therefor for the current quarter year. Space for the storage and parking of passenger motor vehicles shall be reserved, set aside and allocated to those persons who shall make application therefor to the finance director and upon the payment of the rental fee as may be prescribed by the city council from time to time. Sec. 27-15.3. Issuance of permits - transferability - renewal. No permits shall be issued for any designated parking area in excess of the number of parking spaces provided in such area. Should there be applicants for space in any designated area in excess of the number of parking spaces available, such applications shall be placed on file by the finance director, to be filed in chronological order. No person shall be permitted to sell, transfer or assign reserved space to any other person. Reassignment of space shall be by the finance director. Renewal of reserved space shall have preference over all other applications; provided, that such renewal applications are on file prior to the expiration date. Sec. 27-15.4. Identification of vehicles. Any person who shall have been assigned space by the finance director in any reserved space parking area -shall have the privilege of parking or storing his passenger motor vehicle in any available space within the designated parking area; provided that such motor vehicle is marked with the identification provided -46- • for that purpose by the finance director. No motor vehicle shall be parked, • left or stored in any such area unless it is marked with such identification. s n U Sec. 27-15.5. Manner of parking. Vehicles parked or stored in any reserved space parking area shall be parked within the marked lines whenever lines are provided as a designation of parking spaces. No vehicle shall be parked or left in any driveway or other area not designated for parking. Sec. 27-15.6. Construction of reserved space agreement. The issuance of a permit to park or store a motor vehicle within any designated reserved space parking area shall constitute a rental -of vacant space and neither the city nor any of its officers or employees shall be liable for any loss or damage to such vehicle or its contents, or for the loss or theft of the same. Sec. 27-15.7. Revocation of permits. Any permit granted under this division may be revoked at any time by the city manager, in which event a rebate shall be prorated for the unexpired term. -47- ARTICLE III - PARKING METER ZONES Sec. 27-16.1. Parking meter zones. (a) Parking meter zones are hereby established upon those streets or parts of streets described in Schedule III, attached to and made a part of this ordinance, in which zones the parking of vehicles upon streets shall be regulated by parking meters upon the days and between the hours specified in said Schedule III. (b) The traffic engineer is hereby authorized, subject to the approval of the city council by amendment of said Schedule III, to establish parking meter zones at other locations upon those streets or parts of streets where it is determined upon the basis of an engineering and traffic investigation that the installation of parking meters shall be necessary to aid in the regulation, control and inspection of the parking of vehicles. Sec. 27-16.2. Installation of parking meters. (a) The traffic engineer shall install parking meters in the parking meter zones established as provided in this ordinance upon the curb immediately adjacent to each designated parking space. Said meters shall be capable of being operated, either automatically or mechanically,; upon the deposit therein of United States currency, for the full period of time for which parking is lawfully permitted in any such parking meter zone or,, 'in lieu thereof, for the periods of time, upon the deposit therein of a coin car coins of United States currency as specified in Schedule III. (b) Each parking meter shall be so designatecV;, constructed, installed and set that upon the expiration of the time period registered, by the deposit of one or more coins, as provided herein, it will indicaxtte by an appropriate signal that the lawful parking meter period has expired, ands during said period of time and prior to the expiration thereof, will indicmte the interval of time which remains of such period. - • (c) Each parking meter shall bear thereon a lbgend indicating the days and • hours when the requirement to deposit coins therein sthall apply, the value of -48- FA • • the coins to be deposited, and the limited period of time for which parking is lawfully permitted in the parking meter zone in which such meter is located. Sec. 27-16.3. Parking meter spaces. (a) The traffic engineer shall designate the parking space adjacent to each parking meter for which such meter is to be used by appropriate markings upon the curb and/or the pavement of the street. Parking meter spaces so desig- nated shall be of appropriate length and width so as to be accessible from the traffic lanes of such street. (b) No person shall park a vehicle in any such designated parking meter space during the restricted or regulated time applicable to the parking meter zone in which such meter is located so that any part of such vehicle occupies more than one such space or protrudes beyond the markings designating such space, except that a vehicle which is of a size too large to be parked within a single designated parking meter zone shall be permitted to occupy two adjoining parking meter spaces when coins have been deposited in the parking meter for each space so occupied as is required in this ordinance for the parking of other vehicles in such space. Sec. 27-16.4. Deposit of coins and time limits. (a) No person shall park a vehicle in any park-ing space upon a street alongside of and next to which a parking meter has been installed during the restricted and regulated time applicable to the parkiing meter zone in which such meter is located unless a coin or coins of Uni,-d States currency of the appropriate denomination as provided by ordinance shall have been deposited therein, or shall have been previously deposited therein for an unexpired inter- val of time, and said meter has been placed in operation. (b) No person shall permit a vehicle within ihi-s control to be parked in such parking meter space during the restricted and regulated time applicable to the parking meter zone in which such meter is located while the parking meter for such space indicated by signal that the lawful parking time in such space -49- I has expired. This provision shall not apply to the act of parking or the necessary time which is required to deposit immediately thereafter a coin or coins in such meter. (c) No person shall park a vehicle in any such parking meter space for a consecutive period of time longer than that limited period of time for which parking is lawfully permitted in the parking meter zone in which such meter is located, irrespective of the number or amounts of the coins deposited in such meter. (d) The provisions of this section shall not relieve any person from the duty to observe other and more restrictive provisions of this ordinance and the Illinois Vehicle Code prohibiting or limiting the stopping, standing or parking of vehicles in specified places or at specified times. Sec. 27-16.5. Use of slugs prohibited. No person shall deposit or attempt to deposit in any parking meter any slug, button or any other device or substance as substitutes for coins of United States currency. Sec.. 27-16.6. Tampering with meter. No person shall deface, injure, tamper with, open or willfully break, destroy or impair the usefulness of any parking meter. Sec. 27-16.7. Collection of coins and disposition thereof. The collection of coins from the operation of parking meters shall be under the supervision of the finance director and shall be deposited by him with the city treasurer. Net proceeds from the operation of parking meters, after payment of the cost of meters and installation thereof, and after payment of maintenance, operation and supervision expense, shall be used for the acqui- sition, improvement and operation of public parking facilities, as the city council may from time to time authorize and direct. IMS ARTICLE XVII - REGULATING KINDS AND CLASSES OF TRAFFIC ON CERTAIN STREETS Sec. 27-17.1. Traffic engineer to limit the weight of vehicles on certain steets and bridges. It shall be unlawful for any person to drive or move or for the owner to cause or knowingly permit to be driven or moved on any street in the city any vehicle of a size and weight exceeding the limitations provided by state law, or otherwise in violation of state law, unless under the terms of a special permit issued as provided in Section 27-17.4. of this ordinance. Sec. 27-17.2. Commercial vehicles of excessive weight prohibited from using certain streets. When signs are erected giving notice thereof, no person shall operate any commercial vehicle exceeding 8000 pounds gross weight at any time upon any of the streets or parts of streets described in Schedule XIII attached to and made a part of this ordinance, except that such vehicles may be operated thereon for the purpose of delivering or picking up materials or mrchandise and then only by entering such street at the intersection nearest the destination of the vehicle and proceeding thereon no farther than the nearest intersection thereafter. Sec. 27-17.3. Operation of vehicles carrying merchandise restricted. When signs have been erected giving notice thereof, no person shall operate a vehicle for the carrying of goods, wares, or merchandise upon the streets or portions thereof described in Schedule XIV attached to and made a part of this ordinance, except such vehicles as are engaged in the repair of construction of said streets; provided, however, that such vehicles carrying goods, wares or merchandise for delivery to or pick up from any premis,es abutting upon such streets, shall be permitted to enter upon said street at the intersection nearest the destination, but shall not proceed further there®:n than the nearest intersection thereafter, and provided further that nothing contarmed herein shall be construed • to prevent persons now engaged in business upon such streets from having access thereto for himself or his customers or patrons, .but such access shall be confined . to the use of that portion of such streets lying be,tiween the cross streets between -51- which said business is located. Sec. 27-17.4. Traffic engineer - permits for excessive weight and size. The traffic engineer within his discretion, upon application in writing may issue a special permit in writing authorizing the applicant to operate or move a vehicle or combination of vehicles of a size or weight of vehicle or load exceeding the maximum specified by the Illinois Vehicle Code, or otherwise not in conformity with the provisions of the Illinois Vehicle Code, upon any street within the city. Where a permit is sought for overweight, the application shall show that the load to be moved by such vehicle or combination of vehicles cannot reasonably be dismantled or disassembled. The application for any such permit shall specifically describe the vehicle and load to be operated or moved and the particular streets for which a permit to operate is requested. The traffic engineer, shall issue or withhold such permit at his discretion; or, if such permit is issued, to limit the number of trips, or to establish seasonal or other time limitations within which the vehicles described may be operated on the streets indicated, or otherwise to limit or prescribe conditions of operation of such vehicle, when necessary to assure against undue damage to the road foundations, surfaces or structures, and may require such undertaking or other security as may be deemed necessary to compensate for any injury to any roadway or road structure. Every such permit shall be carried in the vehicle or combination of vehicles to which it refers and shall be open to inspection by any police officer or authorized agent of the traffic engineer, and no person shall violate any of the terms or condtions of such special permit. Whenever any vehicle is operated or movement is made in violation of a permit issued in accordance with the provisions of this section, the person to • whom such permit was granted, in addition to. -he driver of such vehicle, shall be deemed guilty of such violation and either or both such persons may be -52- 9. 1._. prosecuted for such violation. • Sec. 12-17.5. Funeral processions prohibited on certain streets. No funeral procession or hearse shall be permitted upon Sheridan Road or Ridge Avenue of the City; provided, however, that nothing herein shall be construed to prevent the removal of any deceased body from any house or apartment building abutting upon such pleasure driveways, and the forming of a funeral procession therefrom, but such deceased body, hearse or procession shall not be permitted to proceed further thereon than to the nearest crossing street in the direction in which such procession or Hearse is moving. Sec. 27-17.6. Operation of certain vehicles on certain streets prohibited. (a) No motorized vehicle producing less than five brake horse power shall be operated upon any of the streets designated in Schedule XV, which schedule is made a part_of this ordinance. 4 (b) No person shall operate a bicycle upon those streets designated in Schedule XV. (c) No person shall operate, stop, park or stand a motorized vehicle, (1) within any public park; (2) over or through any barrier created for the purpose of diverting traffic; (3) upon any beach, parkway, sidewalk, or public area of the city, except, insofar as such vehicles are, required for the maintenance, construction, renovation or alteration of such park, beach, parkway, sidewalk or public area, or the operator of such a vehicle has first received a permit for said operation or the operator of such vehicle is operating an authorized emergency vehicle in the pursuance of an emergency operation, or a police vehicle in the patrolling of the aforesaid areas. Sec. 27-17.7. The traffic engineer shall, by and with, the consent of the City Council, be authorized to designate certain streets or portions thereof as truck routes. Upon designation, signs shall be erected giving notice thereof. Those streets or portions thereof so designated shall be maintained in Schedule XVI attached hereto and made a part hereof. -53- 1/22/76 - It prosecuted for such violation. Sec. 27-17.5. Sec. 27-17.7. The traffic engineer shall, by and with the consent of the City Council, • be authorized to designate certain streets or portions thereof as truck routes. Upon designation, signs shall be erected giving notice thereof. -53- ARTICLE XVIII - INSPECTION OF VEHICLES Sec. 27-18.1. Required. It shall be unlawful for a resident of the city, including corporations having their principal offices or places of business in the city, owning a motor vehicle for the transportation of persons or property, to operate the same over the public streets of the city, without first having such vehicle inspected at the municipal testing station in the city, as provided in this article. Such inspection shall also be required of every vehicle without motive power designed for carrying persons or property and being drawn or towed by a motor vehicle. Sec. 27-18.2. Purpose of inspection. The inspection of motor vehicles shall be conducted under the direction of the department of police of the city and shall be made for the purpose of determining whether the vehicle or its parts and accessories conform in all respects with the requirements of this chapter and state law, respecting the sufficiency of all equipment required for the.safe operation on public high- ways of motor vehicles. Sec. 27-18.3. Notice of inspection. It shall be the duty of the finance director, when application shall be made by any person for the issuance of -any city vehicle license for any motor vehicle, to deliver to such person applying for such license a printed notice, which printed notice shall specify plainly on the face thereof: (1) the place where the department of police will conduct the inspection of motor vehicles as provided for in this article; (2) that motor vehicles not previously inspected shall be presented for inspection within twenty-four hours after the purchase of a city vehicle license therefor; (3) that motor vehicles previously inspected shall be next presented for inspection on the respective dates appearing on the reverse side of the respective certificates of inspection issued to him as provided in this article. Such notice shall contain a brief explanation of -54- It such other provisions of this article as the city manager shall deem advisable for the general information of the motor vehicle owner. Seca 27-18.4. Inspection periods. The period in each year from January first to and including June thirtieth shall be known as the first inspection period and the period from July first to and including December thirty-first shall be known as the second inspection period. Each motor vehicle owned by a resident of the city and used for the transportation of persons or property shall be submitted by such resident owner for inspection as required by this article at least once in each inspection period. Sec. 27-18.5. Issuance of certificates of inspection. Upon the determination by the department of police, after inspection, that any motor vehicle or its parts or accessories, conforms in all respects with the requirements of this chapter and state law respecting the sufficiency of equip- ment of motor vehicles, the department of police shall immediately issue to the owner of such motor vehicle a suitable certificate of inspection, which certificate the owner of such vehicle shall immediately attach, or cause to be attached, to the left side of the windshield or left side vent window. Sec. 27-18.6. Time and notice for succeeding inspection. Whenever a certificate of inspection shall have been issued as provided in this article, it shall be the duty of the department of police immediately to fix a date in the immediately succeeding inspection period for the next inspection of the motor vehicle for which such certificate shall have been issued and to stamp the same on the reverse side of such certificate of inspection in waterproof ink, or perforate the certificate with such date. No notice other than such date so stamped on or perforated in such certificate and the notice provided for in Section 27-18.3. of this ordinance, shall be necessary to be given to any owner or operator of a motor vehicle. It shall be unlawful for any person to operate any motor vehicle owned by a resident of the city over the streets or alleys of -55- the.city on any date subsequent to the date so stamped on or perforated in such certificate of inspection unless such motor vehicle shall first be submitted for inspection and shall have passed inspection as provided in this article; provided, that vehicles disapproved may be operated only as provided in Section 27-18.7 of this ordinance. Sec. 27-18.7. Rejection and reinspection of vehicles. In the event that it shall be determined by the department of police, after an inspection, that any motor vehicle or its parts and accessories so submitted does not conform in all respects with the requirements of this chapter and state law respecting the sufficiency of the equipment thereon, the department of police shall, at the time of such disapproval, fix another date, not earlier than seven days nor later than ten days from such date of inspection, for a reinspection of such motor vehicle of such date for reinspection. It shall thereupon become the duty of the owner of such motor vehicle to repair, adjust or cause to be repaired or adjusted, such motor vehicle within such period of ten days, and to again submit the vehicle for reinspection on the date designated for such reinspection. Sec. 27-18.8. Driving rejected vehicles. No person shall drive or operate any motor vehicle which has been disapproved by the department of police, after inspection, as not conforming in all respects with the requirements of this chapter and state law respecting the sufficiency of the equipment thereon on any of the streets or alleys of the city, except as may be necessary to take such vehicle from the place of inspection to the place of repair or adjustment and return. Sec. 27-18.9. Display of certificate. It shall be unlawful for any person to use, maintain, store for purposes other than sale, park or operate within the City of Evanston any motor vehicle • registered or required to be registered with the Secretary of State, State of Illinois, to an address within the corporate limits of the City of Evanston, • -56- I . r . . , " : _a�.. unless such vehicle shall display a Certificate of Inspection as provided in this article. Violation of the provisions of this section shall take place when a motor vehicle, registered or required to be registered with the Secretary of State to an Evanston address, shall not have displayed in a prominent place thereon the Certificate of Inspection issued to the owner thereof by the department of police for either the current inspection period, in case the same has been issued, or for the immediately preceding period. It shall be unlawful to transfer a Certificate of Inspection from one vehicle to another. A violation of these provisions may take place whether or not said vehicle is actually in operation on the streets•or public ways of the City. If at the time of application a complaint is pending charging failure to obtain or display a Certificate of Inspection as provided in this Article, further prosecution may be avoided by " obtaining said Certificate of Inspection, presenting the Safety Lane Inspection Report Card along with said complaint to the City Collector, and paying the penal sum of ten dollars ($10.00) to said City Collector. Any person violating the provisions of this section shall be punished in one of the following ways: (a) By a fine in the amount of Fifty Dollars ($50.00) in the event that said violator has not secured the required Certificate of Inspection at the time of his court appearance; (b) By a fine in the amount of Ten Dollars ($10.00) in the event that the violator has secured the required Certificate of Inspection at the time of his court appearance. Sec. 27-18.10. Inspection of new and used motor vehicles. Any dealer in new or used motor vehicles shall .have all motor vehicles, new and used, inspected as provided in this article. Sec. 27-18.11. Penalty. Any person violating any of the provisions of tfhis article shall be fined -57- not less than Ten Dollars ($10.00) nor more than One Hundred Dollars ($100.00) for each offense except where otherwise provided herein. • I* ARTICLE XIX - REMOVAL AND IMPOUNDING OF ILLEGALLY PARKED OR ABANDONED VEHICLES Sec. 27-19.1. Meaning of abandoned vehicles. The words "abandoned vehicle," as used in this article shall be deemed to refer to any motor vehicle standing or parked on a public way, which vehicle is either: (a) in such a state of disrepair as to be incapable of being driven; (b) has not been moved or used for more than seven consecutive days and is apparently deserted. Sec. 27-19.2. Authority of police to remove and impound vehicles; grounds for removal; duty to notify owners. (1) The Chief of Police or his designee is hereby authorized to immediately and without notice tow away, or cause to be towed away, any car or other vehicle on any public street, public place, or private property, and to impound such vehicle until the owner, where his identity may be practicably ascertained through current license plates or registration, has been notified and given the opportunity to obtain a hearing, where the owner's liability for payment of any towing and storage expense may be determined along with the issue of abandonment: a) When any vehicle is left unattended upon any bridge or viaduct or in any subway or tunnel, or upon any approach thereto; b) When any vehicle on any public way is so disabled as to constitute an obstruction to traffic and the person in charge of the vehicle has abandoned the same or is incapacitated to 'such an extent as to be unable to provide for the custody and removal of such vehicle; c) When such parked vehicle creates or constitutes a traffic or other hazard to the community; d) When any vehicle is parked on private property without the express or implied consent of the owner of the property. 0 -59- • (2) Where a motor vehicle standing or parked on a public way, but not under such circumstances as those outlined in subsection (1) above, necessitating immediate removal, has not been moved or used for more than seven consecutive days and is apparently deserted, the Chief of Police or his designee is hereby directed to give immediate notice to the owner, where his identity may be reasonably ascertained through current license plates or registration; (3) The notice required in subsections (1) and (2) of this section shall be given by certified mail return receipt requested, and shall contain full description of the vehicle, its present location and the legal and factual basis for the presumption of abandonment, as well as a date, within 10 days from the date of the notice, on which the owner may appear at a hearing before the Chief of Police or his designee, to show cause why the City should not remove the vehicle, and, if the removal has already been effected, why the owner should not be responsible for the payment of any towing and storage charges incurred or to be incurred in said removal before regaining the use and possession of the vehicle; (4) Where a motor vehicle is discovered under the conditions outlined above in subsections (1) and (2) of this section and the identity of the registered owner of said vehicle cannot be practicably ascertained through current license plates or registration, the Chief of Police may provide for the disposal of said vehicle without notice to the registered owner or other person legally entitled to the possession of the vehicle, in the manner authorized by Sections 4-207 and 4-208 of Chapter 95-1/2 of the Illinois Revised Statutes; (5) Where notice has been given to the owner of an abandoned vehicle and said owner has failed to respond to said notice within the time period prescribed by subsection (3) above, the removal of said vehicle by the police department may be effected immediately thereafter. . I) Sec. 27-19.3. Procedure for redemption of impounded vehicle by owner; removal and storage fees. Before the owner or person entitled to the possession of any impounded vehicle (hereafter, "owner") shall be permitted to remove the same, he shall furnish evidence of his identity, ownership of the vehicle and his right of possession thereto, and upon delivery shall sign a receipt for the vehicle. If said owner.should elect to waive his right to a hearing under Section 27-19.2 of this article, he must also sign a statement to the effect that he has been informed of said right and has consciously elected to its waiver. If he has failed to show cause why he should not be responsible for the payment of any towing and storage charges incurred in the removal of said vehicle as provided in subsection (3) of Section 27-19.2 of this Code, then he shall pay a fee equal to the actual cost of said towing charges together with such daily fees for storage of such towed vehicle as may from time to time be established by contract approved by the City Council. The foregoing fees shall be in addition to any fee levied or assessed against the owner or operator of such vehicle by reason of the violation of this chapter or any other ordinance or statute, and any arrest which may have resulted from such violation. Sec. 27-19.4. Notice to Chief of Police of abandoned vehicles. It shall be the duty of the superintendent of streets to notify the Chief of Police of the location of any abandoned motor vehicle found on any public way within the city and it shall also be the duty of any police officer to give notice to the Chief of Police of the location of any such motor vehicle. Sec. 27-19.5. Duty of Chief of Police to cause Removal and Impoundment. It shall be the duty of the Chief of Police to cause every vehicle removed from any public way or private property, as provided in Section 27-19.2. of this ordinance, to be removed and conveyed by or under the direction of a member of the department of police to the nearest and most convenient pound or storage • space available for that purpose. -61- 1/30/76 I Sec. 27-19.6. Reports on towed vehicles. When a motor vehicle is authorized to be towed away as provided in this article, the police department shall keep and maintain a record of vehicles towed, listing the color, year of manufacture, manufacturer's trade name, manufacturer's series name, body style, vehicle identification number and license plates, year and number, displayed on the vehicle. The record shall also include the date and owner, location towed from, location towed to, reason for towing and the name of the officer authorizing the tow. Sec. 27-19.7. Record searches. When the Chief of Police authorizes the impounding of a motor vehicle under this article and does not know and is not able to ascertain the identi- fication of the registered owner.or other legally entitled person or for any reason is unable to give a notice to the owner as provided in Section 27-19.2(3) of the Code, the Chief of Police or his designee shall cause the motor vehicle registration records of the State of Illinois to be searched by a direct communication to the Secretary of State for the purpose of obtaining the required ownership registration. The Chief of Police or his designee shall also cause the stolen motor vehicle file of the Illinois State Police to be searched by a direct communication to the Illinois State Police for stolen or wanted information on the vehicle. Further, the Chief of Police or his designee shall send or cause to be sent, a written report of such removal and impoundment to the Secretary of State. Such notice shall include a description of the vehicle, the date, time and place of removal and the address of the place where such vehicle has been impounded. Sec. 27-19.8. Disposal of unclaimed vehicles. When an abandoned or unclaimed vehicle seven years of age or newer remains unclaimed by the registered owner or other -person legally entitled to its possession for 30 days after notice has been given, as provided in Section 27-19.2 of this article, the Chief of Police or his designee shall cause it to be sold at public sale to the highest bidder. Notice of time and place of sale shall be posted in a conspicuous place for at least ten days prior to the sale on the premises where the vehicle has been impounded. At least ten days prior to the sale, the Chief of Police or his designee shall cause a notice of the time and place of sale to be sent by certified mail to the registered owner or other person known to be legally entitled to possession of the vehicle. Such notice shall contain a complete description of the vehicle to be sold and the steps to be taken to reclaim the vehicle. Where certified notification required by Section 27-19.2, has been returned by postal authorities to the police department or towing service due to the addressee having moved, or being unclaimed at the address obtained from the registration records, the sending of a second certified notice shall not be required. All costs not recovered in a sale authorized by this article shall be paid by the owner of such vehicle. No member of the police department or any other employee of the city, directly or indirectly, shall purchase or participate in the bidding for and purchase of any vehicle so offered for sale. Sec. 27-19.9. Disposal of unclaimed vehicles without notice. When the identification of the registered owner or other person legally entitled to the possession of abandoned or unclaimed vehicles seven years of age or newer, cannot be determined, the vehicle may be sold without notice to the registered owner or other person legally entitled to possession of the vehicle. When an abandoned vehicle of more than seven years of age is impounded, as authorized by this article, it shall be kept in custody for a minimum of ten days for the purpose of determining ownership, contacting the registered owner by United States mail, public service or in person, and an examination of the • Illinois State Police stolen motor vehicle files for theft and wanted information. • -63- At the expiration of the ten day period, without benefit of disposition information being received from the registered owner, the Chief of Police or his designee may authorize disposal of vehicle as junk only. Sec. 27-19.10. Disposition of proceeds of sale. The proceeds of the sale authorized by this article, after deducting the costs of removal and storage and the expense of advertising and conducting the sale shall be paid to the finance department. Sec. 27-19.11. Police reports after vehicle is reclaimed and disposed of. When a motor vehicle in the custody of the police department is reclaimed by the registered owner or other legally entitled person, or when the vehicle is sold at public sale or otherwise disposed of, as provided in this article, a report of the transaction shall be maintained by the police department for a period of one year from the date of sale or disposal. Sec. 27-19.12. Vehicle removed from private property. The cost of removal and storage of any vehicle removed from private property at the request of the owner of the property shall be paid by the owner of the property if the vehicle is not redeemed by the owner of the vehicle prior to the sale. The proceeds of the sale shall be used to reimburse the owner of the property who requested removal and who has paid the cost of removal and storage. Sec. 27-19.13. Authority of police to relocate vehicles. In the event any emergency arises necessitating the removal of any vehicle upon any public way, members of the department of police are hereby authorized to remove or relocate any such vehicle from one location to any other location. Sec. 27-19.14. Responsibility for costs not recovered. Any costs incurred by the City of Evanston for removal, impoundment or destruction of vehicles under this article not otherwise recovered shall be • paid by the registered owner or person legally entitled to possession. is -64- ARTICLE XX - WHEEL TAX Sec. 27-20.1. License required. It shall be unlawful for any person to use, maintain, store,for purposes other than sale, park or operate within the City of Evanston any motor vehicle registered or required to be registered with the Secretary of State, State of Illinois, to an address within the corporate limits of the City of Evanston, unless such vehicle is licensed as provided in this article. A violation of the provisions of this Section shall take place when a motor vehicle registered or required to be registered with the Secretary of State to an Evanston address shall not have been licensed, whether or not said vehicle is actually in operation on the streets or public ways of the City. If, at the time of application, a complaint is pending charging failure to obtain or display said vehicle license, further prosecution may be avoided by obtaining said license and paying -the sum of $10.00 as a penalty at the time of such application. Any person violating the provisions of this section shall be punished in one of the following ways: a) By a fine in the amount of $50.00 in the event that said violator has not secured the required vehicle license at the time of his court appearance; b) By a fine in the amount of $10.00 in the event that the violator has secured the required vehicle license at the time of his court appearance but has not paid the aforementioned penalty fee. Sec. 27-20.2. Application. Any person desiring a license for any motor vehicle shall file his application with the finance director upon a form provided therefor which shall set forth the name and address of the applicant and a description of the vehicle for which the license is desired. Sec. 27-20.3. Issuance of license. The application required by the preceding section shall be transmitted to the finance director and upon the payment by the applicant of the license fee -65- provided for in this article, the finance director shall issue, or cause to be issued, a license authorizing the use of such motor vehicle within the city until the expiration date of such license. Sec. 27-20.4. Schedule of license fees. All trailers shall have affixed thereon a vehicle inspection emblem as provided under Sections 27-18.1 to 27-18.11 of this ordinance, provided that only one annual inspection shall be required. Motor trucks and tractor trailers, designed for the carrying of loads, shall be classifed as to gross, tare and net weights. Such classification shall be identified by the prefix letter on the.plate which shall correspond to the classification of the vehicles as provided by the Secretary of State, and the license fee for such motor vehicles shall be as follows: -66- 1/29/76 Y� provided for in this article, the finance director shall issue, or cause to be issued, a license authorizing the use of such motor vehicle within the city until the expiration date of such license. Sec. 27-20.5. Affixing license. The license issued by the City under this article shall be in the form of decalco- mania or other form of sticker and shall be displayed, affixed and attached on the left side of the windshield of the vehicle in such a manner as not to obstruct the vision of the driver. Sec. 27-20.6. Transfer of license. Any person who is the owner of a motor vehicle on the first day of January shall be required to have affixed on the left side of the windshield of the vehicle a wheel tax license for that year. All such licenses shall expire on the thirty-first day of December following the,date of issuance. In the event of new ownership, the new owner shall make application for a wheel tax license within twenty-four hours after acquiring a vehicle. Sec. 27-20.8. Prorating license. One-half year rates on all vehicle licenses shall apply only to those owners who purchased vehicles on or after July first. No wheel tax license shall be issued to any owner for a half -year period until such owner has received his license indicating registration of such vehicle with the Secretary of State and such wheel tax license shall be issued for such period as the state license has been issued. The license fee to be paid for a period of six months or less shall be one-half of the annual license it fee for the vehicle under its proper classification.. Sec. 27-20.9. Damaged licenses. Whenever any licensee shall have lost or had his license damaged or defaced, a duplicate license shall be issued for a fee of one dollar after the licensee has made proper application and affidavit to the effect that the license has become lost, damaged or defaced, and after the finance director has investigated such affidavit and approved a the same. Sec. 27-20.10. Loads in excess of classifcation. If any person shall have applied for and received a wheel tax license for a motor truck or tractor -trailer and shall at any time carry on such vehicle a load greater than is permitted in accordance with the classification of -the license issued to such vehicle, the owner or operator of such vehicle shall be punished as provided . in Section 27-20.1 of this chapter. He shall further be required to make immediate application for a wheel- tax license in the proper classification, and such application • shall be retroactive from the date of the original issuance of the license. -68- 1/29/76 t is Any person who is the owner of a motor vehicle on the first day of January shall be required to have affixed on the left side of the windshield of the vehicle a wheel tax license for that year. Exemptions. All vehicles owned or operated by the City,the Evanston public library, consuls representing foreign nations or officers of foreign legations, shall be exempt from the provisions of this article; provided, however, that each and every vehicle in this classification shall be required to have a wheel tax license according to its proper classification, and such license shall be issued to the applicant upon the proper application without fee. I • • ARTICLE XXI - PENALTIES Sec. 27721.1. Penalties; driving under the influence. Any person who violates the provisions of Sec. 27-9.6 of this chapter shall be guilty of an offense punishable by a fine of not less than $100.00 nor more than $500.00 for each offense. Sec. 27-21.2.'Penalties; parking regulations. Any person, firm or corporation who violates the provisions of Articles XIII, XIV, XV, and XVI of this chapter shall be guilty of an offense punishable by a fine of not less than $5.00 if paid within 10 days after the date of said violation notice, and not less than $10.00 if paid more than 10 days after the date of said violation notice, nor more than $200.00. Any violator may avoid prosecution for violating this chapter before legal action has been brought against him by surrendering the traffic ticket or other notice of violation, either received or placed upon such vehicle, and paying to the Clerk of the Circuit Court of Cook County, Second Municipal District, within 10 days from the date appearing on said violation notice, the sum of $5.00, or if not paid within the period of 10 days from the date appearing upon the violation notice, then the sum of $10.00 before legal action has been brought against said violator. Any person making such payment shall receive a receipt therefor from the Clerk of the Circuit Court of Cook County, Second Municipal District. Sec. 27-21.3. Penalties; generally. Penalties not provided for specifically within this chapter shall be subject to the provisions of Sec. 1-4 of the Code of the City of Evanston. -70- ARTICLE XXII - SCHEDULES REFERRED TO IN ORDINANCE SCHEDULE i Sec. 27-22.1. Application. The provisions of this ordinance relating to the operation of vehicles refer exclusively to the operation of vehicles upon highways except where a different place is specifically referred to in a given section. Sec. 27-23.2. Effect of headings. Article and section headings contained herein shall not be deemed to govern, limit, modify or in any manner affect the scope, meaning or extent of the provisions of any article or section thereof. Sec. 27-23.3. Short title. This ordinance may be known and cited as the City of Evanston Traffic Ordinance. Sec. 27-23.4. Ordinance not retroactive. This ordinance shall not have a retroactive effect and shall not apply to any traffic accident, to any cause of action arising out of a traffic accident or judgement arising therefrom, or to any violation of the motor vehicle ordinance of this city, occurring prior to the effective date of this ordinance. Sec. 27-23.5. Effect of partial invalidity.
