HomeMy WebLinkAboutORDINANCES-1977-106-O-7711/3/77, 11/11/77 0 106-0-77 AN ORDINANCE Granting A Moratorium On Condominium Conversions Within The City Of Evanston WHEREAS, the General Assembly has heretofore adopted certain amend- ments to the "Condominium Property Act" approved June 20, 1963 as amended, which amendments are commonly known as Senate Bills 40 through 60, inclusive; and WHEREAS, said amendments further set forth the conditions and re- strictions on the creation of.condominium housing units within the State of 0 Illinois; and WHEREAS, the Governor of the State of Illinois did on September 16, 1977 transmit to the members of the Senate Both General Assembly certain amendatory vetos, which in essence provided that Senate Bills 40 through 60 would become effective January 1, 1978; and WHEREAS, the City Council is presently considering the possible amendment of restrictions on condominium conversions pursuant to its home rule power and has determined that the best interests of the citizens of the City of Evanston would be served by a moratorium on all condominium conver- sions which do not meet the standards to be established under the provisions of Senate Bills 40 through 60, inclusive. • NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF EVANSTON, COOK COUNTY, ILLINOIS: 106-0-77 • SECTION 1: That a moratorium be .and is hereby established on all conversions of existing buildings to condominium owner- ship or the erection of new buildings for condominium purposes unless said construction or conversion complies in all respects with the provisions of Senate Bills 40 through 60 heretofore adopted by the Senate 80th General Assembly of the State of Illinois as of November 15, 1-977 which are attached hereto and incorporated herewith by reference. This moratorium is to remain in effect until February 1, 1978, at which time this moratorium shall termi- nate. The City Manager is hereby directed to prepare such information as shall be adequate in the form prescribed by him to determine whether or not any proposed construction or conversion for condominium purposes shall comply with said Senate Bills 40 through 60, inclusive. SECTION 2: The provisions of this ordinance shall apply to any • building for which a declaration of condominium and plat of survey have not been filed with the County Recorder or the County Registrar of Titles by the effective date of this ordinance. Any party claim- ing that a building is not subject to the provisions of this ordinance shall submit proof to the Director of Inspections and Permits that the declaration and plat were recorded prior to the effective date of this ordinance. Said submittal shall include, but not be limited to, copies of said declaration and survey including the date stamp and document identification number provided by the County Recorder or Registrar of Titles. SECTION 3: The Director of Inspections and Permits shall be respon- sible for the enforcement of this ordinance. SECTION 4: Any violation of the foregoing ordinance shall be • punished by a fine not exceeding FIVE HUNDRED DOLLARS ($500.00). Each day any violation of this ordinance shall continue shall constitute a separate offense. -2- 106-0-77 • SECTIO14 5: This ordinance shall be in full force and effect from and after its passage, approval, and publication in the manner provided by law.
