HomeMy WebLinkAboutORDINANCES-1976-092-O-7692-0-76 AN ORDINANCE • Amending Section 2-138 of the Municipal Code Relating to the.Qualifications of Civil Service Commissioners "WHEREAS, the City Council of the City of Evanston finds that the requirements for appointment to the position of Civil Service Commissioner unduly restrict the choice of such officials by eliminating from consideration 1 governmental employees, and -WHEREAS, the City of Evanston is a home rule municipality empowered by the Constitution of the State of Illinois, 1970 to enact legislation governing its own affairs; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF EVANSTON, COOK COUNTY, ILLINOIS: SECTION 1: That Section 2-138 of the Code of the City of Evanston, 1957, as amended, be further amended to read as follows: Section 2-138 Appointment and term of office; quorum; qualifications; oath. The mayor, with the approval of the city council, shall _appoint three persons who shall constitute and be known as the civil service commission: One for three years; one for two years; and.. one for one year from the time of appointment and until their respective successors are appointed and qualify. In every year thereafter the mayor shall in like manner appoint one person as the successor of the commissioner whose term shall ex - pine in that year to serve as such commissioner for three years and until his successor is appointed and qualified. Two commissioners shall constitute a quorum. All appointments to the commission, both ori- ginal and to fill vacancies, shall be made so that not more then two members shall at the time of appointment be members of the same political party. The commission- ers shall hold no other lucrative office of the United States, the state or any municipal corporation or pol- itical subdivision thereof, provided however that this section shall not be construed to..prevent an employee • 92-0-76 w -2- of the United States, the state or any political sub - ..division thereof from serving as a commissioner so long as such employment does not create a conflict with the duties to be performed by such commissioner. Each commissioner, before entering upon the duties of .his office shall take the oath prescribed by Section 2-4 of this Code. SECTION 2: This ordinance shall be in full force and effect from and after its passage, approval, and publi- cation in the manner provided by law. Section 3: All ordinances or parts of ordinances in con- flict herewith are hereby repealed.
