AN ORDINANCE
Granting Variations with Respect to the Property
Located at 1400-1414 Oak Avenue
Evanston, Illinois
WHEREAS, on April 20 and May 18, 1976 the Zoning Board of Appeals
conducted a public hearing upon the application of Edward J. Noonan (contract
purchaser) for variations from the control over use, control over bulk, build-
ing on lot, use, height, yard, non -conforming structures and uses, and struc-
tures designed for a non -conforming use, regulations of the Evanston Zoning
Ordinance adopted November 21, 1960 as amended, and as they apply to the -
property located at 1400-1414 Oak Avenue, Evanston, Illinois, located in an
R1 Single-family Residence District, said public hearing having been conducted
pursuant to notice and publication thereof as provided by law; and
WHEREAS, the Zoning Board of Appeals has recommended that such relief be
denied; and
• WHEREAS, the City Council of the City of Evanston makes the following
findings a fact with reference to said application for variations:
The variation will not alter the essential character of the locality, but
will not allow it to be retained.
The variation will be beneficial, and will not be detrimental to the
public welfare or injurious to or depreciate the value of other property or
improvements in the neighborhood, but will allow the historic character to be
preserved, in accordance with our Comprehensive General Plan.
The variation will not impair an adequate supply of light and air to
adjacent property, nor substantially increase the danger of fire or otherwise
endanger the public safety, because no change will be created,
The Council therefore finds that the variation, if granted,.will be in
harmony with the general purpose'and intent of the ordinance.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF

.SECTION 1: That the application of Edward J. Noonan (contract purchaser)
for a variation from the control over use', control over bulk,
building on lot, use, height, yard., non -conforming structures and uses, and.
structures designed for a non -conforming use, regulations. of the Evanston Zoning
Ordinance to permit the conversion of a single-family dwelling into a
two-family dwelling, and the expansion of the first floor dwelling unit located
in a second principal building on the property located at 1400-14.14 Oak Avenue,
Evanston, Illinois, and legally described as:
Lots 1, 2, 3, 10, 11, and 12, in Block 48 in Evanston, Illinois,
in Section 18, Township 41 North, Range 14, East of the Third
Principal Meridian, in Cook County, Illinois,
be and hereby is granted subject to compliance with all other provisions of the
Zoning Ordinance and other applicable laws,, all in accordance with the findings
of the City Council of the City of Evanston, and shall conform to the following
conditions:
•
1. The land (as distinguished from improvements) shall remain under com-
mon ownership, including a condominium association, (but may be resub-
divided) so long as the existing buildings or those allowed herein are
extant.
2. The property shall not be developed so that any buildings are located
within 72 feet of the south property line along Greenwood Street.
3. No more than 4 additional detached single-family dwellings shall be
constructed on the property, for a total'of 8 dwelling units.
4. Exterior construction changes to the existing buildings shall be
limited to the following:
1) new entries, entry porches and steps
2) green houses,
3) porches, decks, patios
4) bay windows
5) removal of existing 3 car garage and shed, porches,
doors, windows and garage features as required to
• .complete architectural changes
6) colors coordinated to new single-family houses'

The external facades of the converted buildings shall be preserved
• during the lifetime of said buildings. Future changes which do not
adversely affect the architectural or historic features of the build-
•
•
ings may be made if they are approved by the Planning and Development
Committee after consultation with the Preservation Commission.
5. The present two existing buildings will not be demolished without a
special permit granted by the City Council.
6. A covenant of agreement to the above terms and conditions shall be .
submitted in recordable form by the applicant, and shall be recorded
before any permits are issued.
SECTION 2: The Director of Inspections and Permits is hereby.ordered and
directed to grant such permits as may be required to effectu-
ate the.provisions of this ordinance.
SECTION 3: This ordinance shall be in full force and effect from and
after its passage and approval in the manner provided by law.
