• { Amending Section X of the Zoning Ordinance R
With Reference to Off -Street Parking
WHEREAS, the Evanston Zoning Amendment Committee has on December 4, 1975,

January 15, 1976, and February 5, 1976 conducted a public hearing on the amend-
ki ment of Section X.B. of the Zoning Ordinance so as to revise and update the
i
sections therein dealing with the circumstances under which off-street parking
l
must be provided and exceptions thereto, said public hearing have been con-
ducted pursuant to notice published in the manner prescribed by law; and,
i� WHEREAS, the Evanston Zoning Amendment Committee has reported its
findings and recommendations to the City Council of the City of Evanston:

NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF

EVANSTON, COOK COUNTY, ILLINOIS:

i SECTION 1: That the first paragraph of Section B. of Section X of the
;l Zoning Ordinance of the City of Evanston, 1960, as amended
• :a be and hereby is deleted, and the following paragraphs substituted in lieu
thereof: '
"B. OFF-STREET PARKING.
In connection with any structure hereafter erected, or in which additional
dwelling units are created, off-street parking spaces shall be provided
meeting all the minimum requirements of this Section X. Any parking space
hereafter installed shall be improved so as to meet all the minimum re-
quirements of this Section X.

Whenever any structure is either altered so as to increase the "floor

area --for determining off-street parking and loading requirements,"
�! as defined herein, or a use or uses (as set forth in Section X.B.10)
are changed or both, so as to increase the minimum parking requirements
'! as calculated by application of the formulae in Section X.B.10., parking .
spaces shall be provided equal to the amount of the resulting increase;
provided that in no case shall more spaces be required than necessary
to meet the minimum requirements as set forth in Section X.B.10. Parking
f� spaces accessory to buildings and uses which exist on the effective
date of this ordinance shall not be reduced to less than the number
required under this Section X for buildings hereafter erected."
SECTION 2: That Section B.11.a. of Section X of the Zoning Ordinance
of the City of Evanston, 1960, as amended be and hereby is
• further amended to read as follows: ,

"B.11.a. Notwithstanding any other provisions of this ordinance, struc-
tures located in Business, Commercial, or Manufacturing Districts may be
altered so as to increase the "floor -area --for determining off-street
parking and loading requirements," as defined herein, by no more than
twenty percent of that existing on August 15, 1966, where such alteration
!! is otherwise lawful, without providing additional parking spaces, pro-
vided that no additional dwelling units are added and that the off-street
parking use classifications(s) of the property is (are) not changed."

SECTION 3: That the present Section B.11.b. of Section X of the Zoning
Ordinance of the City of Evanston, 1960, as amended be

!1 deleted and the following paragraph inserted in lieu thereof: R
"B.11.b. Notwithstanding any other.provisions of this ordinance, the
off-street parking use classification(s) (Section X.B.10) of part or all
of structures located in Business, Commercial, or Manufacturing Districts
i? may be changed provided no additional dwellings units are added, so as to
increase the minimum parking requirements (as calculated by application
of the formulae in Section X.B.10) by no more than five percent of the
spaces required on August 15, 1966, provided that this exemption may not
be taken in conjunction with or -in addition to any other off-street
parking exemption. No structure shall be eligible for this exemption
• within five years of completion of construction as identified by the date
of issuance of the certificate of use and occupancy (not provisional ap-
proval for use and occupancy)."
�j SECTION 4: All ordinances or parts of ordinances in conflict herewith #
?' are hereby repealed.
SECTION 5: This ordinance shall be in full force and effect from and
" after its passage, approval and publication in the manner
provided by law.
