WHEREAS, the City of Evanston is the owner of property hereinafter legally described; and WHEREAS, said property is presently vacant except for the public off- street parking on part of parcel 3 and all of parcel 4; and WHEREAS, in the opinion of the Corporate authorities of Evanston, said real estate is no longer necessary, appropriate, required for the use of, profitable to, or in the best interest of said city; and WHEREAS, it has been the intent of the city over the past seven years to sell said land for needed housing; and WHEREAS, the corporate authorities of the City of Evanston determined that the best interest of the City of Evanston would be served by the convey- ance of said property to parties who will develop said property for mixed income housing and in accordance with the terms and conditions hereinafter set forth. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF EVANSTON, COOK COUNTY, ILINOIS: SECTION 1: That the City Manager be and is hereby authorized and directed to give notice of a proposal to sell real estate legally described as Parcel 1: That part of the Northeast 1/4 of the Northeast 1/4 of Section 13, Township 41 North, Range 13, East of the Third Principal Meridian, lying east of the East line of Block 12 in Evanston Center Addition, South of the South Line of Simpson Street and Northwesterly of the Northwesterly right-of-way line of the Chicago and North Western Railway, in Cook County, Illinois, being part of Jackson Avenue, in the City of Evanston, Illinois. Parcel 2: Lots l to 4, both inclusive, in the resubdivision of lots 1 and 2 in Block 12 in Evanston Center Addition, and all that part of Lots 1 to 5, both inclusive, in Block 3 in Grant and Jackson's Addition to Evanston, lying Northwesterly of the Northwesterly right-of-way line of the Chicago and North Western Railway, all in the Northeast 1/4 of Section 13, Township 41 North, -2- Range 13, East of the Third Principal Meridian in Cook County, Illinois. e ,. (Lot 10 described in Parcel 4) Parcel 4: All that part of Lots 7 to 10, both inclusive, i.n Block 3 in Grant and Jackson's Addition to Evanston, lying Northwesterly of the Northwesterly right-of-way line of the Chicago and North Western Railway, all in the Northeast 1/4 of Section 13, Township 41 North, Range 13,.East of the Third *,. Principal Meridian in Cook County, Illinois. Parcels 3 (part) and 4 commonly known as the Foster Field .parking lot. Parcel 5: Lot 1 in. Block 1 in Gilbert & Farmer's Addition to Evanston, a Subdivision of the West 1/3 of the Southeast 1/4 of the Northeast 1/4 of Section 13, Township 41 North, Range t 13, East -of the Third Principal Meridian in Cook County,, Illinois. Parcel 5 commonly known as 1847 Ashland Avenue. SECTION 2: That said notice of a proposal to sell shall be published for three successive weeks in a newspaper of general circula- tion in the City of Evanston. The first publication shall be not less than 30 days before the date provided in said notice for the opening of bids for the real estate. All such bids shall be opened by the Human Services Committee prior to the regular meeting of the City Council. The corporate authorities may accept the high bid or any other bid determined by them to be in the best interest of the City of Evanston. Corporate authorities may reject any and all bids. Parcel 5 commonly known as 1847 Ashland Avenue. "The property proposed to be sold is presently vacant except.for • the southerly part which is being utilized for public off-street parking. "The city proposed to sell said property subject to the following terms and conditions: 1: The real estate shall be developed for a total of not more than_ thirty (30) units. 2. There shall be included in the project units of two (2), three (3), and four (4) bedrooms, however, no less than four four (4) bedroom units may be included. 3. At least 20% of the project's units must be placed, in the Section.:I 8 new construction program of the Federal Housing Act of 1974. A. greater commitment to the Section 8 new construction.program=of.the Federal Housing Act of 1974 is desirable and will be given favorable • consideration in awarding the contract. 4. The successful bidder is encouraged to make use of any appropriate State and Federal legislation which will help to keep rents within the reach of low and moderate income families. 7 ' , .. 48-0-76 -4- 5. Provisions shall be made for useable open space within the develop- ' r ment and a means for implementation of these proposed open space improve- ments. 6. Enclosed private patios or balconies shall be provided for each unit and common tot -lots for pre-school children shall be available at eachy, > -,' site. 7. A landscape plan shall be developed to provide shade, screening and enclosure, and a substantial barrier of fencing and trees pl.anned along the railroad and the alley. 8. The alley adjacent to the site shall be paved and developed as a• street. Financial arrangements shall be negotiated with the city. TherE: shall be no cost of such paving and developing to the west side owners on • said street/alley. i' 9. Provisions shall be made for one parking space per unit in close proximity to the unit. 10. A system of interior walks shall be provided to both main and back exits of each unit and designated areas set aside for garbage and i W' trash pick-up.' 11. The bidders shall submit site and architectural. sketch plans; the details of which are spelled out in the instructions to prospective developers. 12. There shall be submitted a bid bond or check in the amount of ten per cent of -the bid price together with a completion bond or other security acceptable to the City to guarantee performance. 13. Details of instructions to bidders and design criteria are available to all prospective bidders at the Evanston Municipal Building, 1501 Oak • �,a$'; Avenue 14. The public -parking on the subject property will remain open and available for use by the City as a parking lot until construction commences. 15. The City shall apply to the Zoning Board of Appeals for a.zoning .;; variation of approximately 182.5 square feet per unit to allow the con- struction of four (4) units on Parcel 5. All other units shall be y r 48-0--7(x constructed according to applicable codes except those mentioned above. 16. A detailed management plan shall be submitted as required by Section 8 with a care and maintenance plan for the buildings at -both sites. 17. The bid proposal shall contain satisfactory evidence of the bidder's technical and financial ability to undertake and complete the improvement: within a reasonable time. 18. The City is willing to finance this land purchase, subject to reasonable security. Bidder shall submit a financing proposal which shall include a schedule of debt service. The City acknowledges that it is willing to subordinate its position to that of the primary lenders. 19. A covenant running with the land shall be executed stipulating that the property herein developed and improvements thereto shall not be • removed from the tax rolls, the identity or status of subsequent owners and/or users notwithstanding. Said restriction may be waived by subsequent action of the Evanston City Council. 20. The City reserves the right to reject any and all bids, and to accep, such bid or waive any requirement hereof as the corporate authorities shall deem to be in the City's best interests. The City shall place great emphasis upon proof of the bidder',s ability to perform.in the manner indicated in this bid proposal. 21. The successful bidder shall reserve at least 20% of the units con- structed upon the subject premises for lease to low and moderate income lessees (which terms shall be determined to mean the income levels as may from time to time be published by the Housing and Urban Development Department of the United States as low and moderate.incomes). 22. The deed to the premises offered herein shall be delivered subject to a reverter interest in favor of the City of Evanston to assure com- pliance with all the conditions of this sale." SECTION 4: This ordinance shall be in full force and effect from and after its passage and approval in the manner provided by law.
