HomeMy WebLinkAboutORDINANCES-1976-041-O-76CJ 41-0-76 AN ORDINA14CE Vacating a 'Z-Shaped Alley with the Properties of the Southeast Corner of Forest Avenue and Main Street for Consideration WHEREAS, the City Council of the City of Evanston has considered the re- quest of the American National Bank and Trust Company as Trustee under Trust #226610 to vacate the portion of the "Z" shaped public alley adjoining and adjacent to Lots 1, 2, 3 and 4 in Goessling's resubdivision in certain portions of White's Addition to Evanston; and WHEREAS, the City Council of the City of Evanston finds that such public alley is no longer necessary to or in the public interest to remain dedicated for public purposes; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF EVANSTON, COOK COUNTY, ILLINOIS: SECTION 1: That those portions of property dedicated as public ways being a "Z"-shaped alley within the Southeast corner property of the intersection of Forest Avenue and Main Street and legally described as: Alley -in Goessling's Resubdivision of Lots 1, 2 and 3 of Block B of White's Addition to Evanston, in the NE-1/4 of Section 19, Township 41 North, Range 14, East of the Third Principal Meridian, in the City of Evanston, Cook County, Illinois. , and as described upon the plAt attached hereto and made a part hereof be and the same is hereby vacated and closed inasmuch as the corporate authorities of the City of Evanston have deemed that the public interest will be subserved by vacating those portions of the public alleys .hereinabove described. F SECTION 2: That as consideration for the vacation of said public way the parties thereby benefitted shaT1 pay to the City of Evanston the sum of seven thousand five hundred dollars ($7500.). • SECTION 3: The City of Evanston hereby reserves unto itself and to all public utilities owning public service facilities such as rights--of-way, license and easement rights to subJect equipment as is presently 41-0-76 ; i -2- 3 installed and located upon those portions of the public right-of-way hereby closed together with the right of ingress and egress for the maintenance, renewal, and reconstruction thereof. SECTION 4: All ordinances or parts of ordinances in conflict herewith are hereby repealed. SECTION 5: This ordinance shall be in full force and effect from and after its passage, approval and publication in the manner provided by law.
