HomeMy WebLinkAboutORDINANCES-1977-020-O-773/17/77, 4/7/77, 4/14/77, 5/5/77 20-0-77 AN ORDINANCE Amending The Zoning Ordinance With Regar& To The Definition Of Family Occupancy Of Dwelling Units And Related Provisions -' WHEREAS, the Evanston Zoning Amendment Committee has on March 7, 1974, April 4, 1974, May 2, 1974, June 6, 1974, July 11, 1974, August 1, 1974,• October 7, 1976, November 4, 1976, December 2, 1976, and January 6, 1977 con- ducted a public hearing on the amendment of certain sections of the Zoning Ordinance relating to the definition of "family", occupancy of dwelling units and related provisions for the purpose of establishing standards governing the use and occupancy of dwelling units by unrelated persons, including matters for the provision of parking facilities, minimum floor area requirements, and is similar environmental considerations, said public hearing having been conducted pursuant to notice published in the manner prescribed by law; and WHEREAS, the Evanston Zoning Amendment Committee has reported its findings and recommendations to the City Council of the City of Evanston; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF EVANSTON, COOK COUNTY, ILLINOIS: SECTION 1: That Section III of the Evanston Zoning Ordinance adopted November 21, 1960, as amended, be further amended by amending the definition of "family" by adding thereto the following subsection�� (c): "(C) A group of two (2) or more persons containing within it one (1) or more families, as defined above, including a husband and wife married to one another and their child- ren, as well as adults, living together in a dwelling <] 20-0-77 unit as a single housekeeping unit and management, in premises in which the adult occupants are affiliated -- with a bonafide not for profit corporation organized for religious purposes chartered by the State of Illinois_ which owns or rents the property and has been in exis- tence for at least five (5) years prior to seeking certi- fication by the Director of Inspections and Permits as hereinafter provided, provided that in no case shall the total occupancy of the dwelling unit exceed two (2) persons per bedroom, nor shall the premises be utilized for religious services open to the public or otherwise used as places of public assembly. (A type (c) family may occupy a dwelling unit only according to the proce- dures in Section IV.M.)" SECTION 2: That Section IV.M.1 of the Zoning Ordinance of the City of Evanston, 1960, as amended, be and hereby is further amended to read as follows: "l. No dwelling unit shall be occupied by more than one (1) type (a) or type (b) family as defined in this ordinance, except as hereinafter provided. Exception: Upon written application to the Director of Inspections and Permits, certification of approval shall be issued for occupancy of a dwelling unit by a type (c) .family in all districts where dwelling units are allowed, except R-1 and R-2, provided that the applicant establishes that the occupancy conforms with the definition of a type (c) family. The members of a type (c) family household shall not keep or store more than one (1) motor vehicle for each such dwelling unit or for each off-street parking space lawfully existing in conn.ection with such dwelling unit, whichever is greater. Certification will be revoked at any time the occupancy or off-street parking no longer conforms to the definition of a type (c) family, or if, upon reasonable review, a request for current records is not answered so as to establ.ish that the type of ownership complies with the definition of a type (c) family." SECTION 3: That Section VI.B.I.a of the Zoning Ordinance of the City of Evanston, 1960, as amended, be and hereby is further amended to read as follows: It "a. Single-family detached dwellings, provided that no type (c) families occupy dwellings in R-1 or R-2." -2- a r ' 20-0-77 SECTION 4: That Section X.B..10 of the Zoning Ordinance of the City of Evanston,'1960, as amended, be further amended by relettering subsections e. through bb. thereof respectively .to f. through cc. and the insertion therein of the following new subsection e..: "e. Type (c) family household. The members of a type (c) family .household shall not keep or store at their dwel- ling unit more than one (1) motor vehicle for each such dwelling unit or for each off-street parking space law- fully existing in connection with such dwelling unit, whichever is greater." SECTION 5: All ordinances or parts of ordinances in conflict here- with are hereby repealed.
