HomeMy WebLinkAboutORDINANCES-1976-039-O-766/3/76, 6/24/76 12/21/76, 2/3/77 2/9/77 e 39-0-76 AN ORDINANCE Requiring Price Stating in Retail Establishments WHEREAS, the City Council of the City of Evanston finds it to be in the interest of the general health, safety, and welfare of the citizenry to insure accurate pricing of any product or commodity offered for sale within i the City; and WHEREAS, the City Council finds that the placement of prices on in- dividual items will serve to best advise the public of the actual cost of the •products which are intended for purchase: � l y t NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF EVANSTON, COOK COUNTY, ILLINOIS: SECTIOfV 1: That Chapter 29 of the Code of the City of Evanston, 1957, as amended be further amended by adding thereto i Sections 29-76 thru 29-78 which shall read as follows: "Section 29-76. Definitions Unless the context otherwise requires, the following terms as used in this ordinance shall be construed according to the definitions given below. • CONSUMER COMMODITY - goods that directly satisfy human wants. MULTI-PAK - refers to a series or group of pre -packaged items which have been further enclosed in a package or other protective covering, said group of items to be offered for sale as a single unit. v . r • 39-0-76 PRE -PACKAGED - refers'to enclosure consumer commodities in a package or other protective covering pr1or to display for the purpose of sale. PRINCIPAL PURPOSE - chief or primary function or end. RETAIL SALE - for sale directly to the ultimate consumer. "Section 29-77. Price of Consumer Commodities to be Posted --Packaging a. It shall be unlawful for any store the principal purpose of which is the retail sale of food and/or drugs, to display for sale any consumer commodity unless the selling price is accurately stated in a clear and conspicuous manner in arabic numerals which can be easily read by the consumer purchaser. b. On any pre -packaged consumer commodity the selling price shall be marked directly on the package. On any consumer commodity which s is not pre -packaged the selling price small be stated on a sign contiguous to the point of display of the consumer commodity so ; priced. • 4 C. Exception: Notwithstanding the provision of subparagraph (b) � above, nothing contained therein shall be construed to require price marking upon the individual packages of the following classes of items: C7 1. Identical items within a multi-pak package which multi-pak package is properly price marked; 2— Single cigars and single packages of cigarettes; 3. Candy and chewing gum and other confectionery items less than 60 grams in size; 4. Items in vending machines; 5. Advertised sale items and milk in stores with a gross area not greater than 6,000 square feet. d. All meats, poultry, and poultry parts pre -packaged in the store premise, sold or offered for sale shall be packaged in trays affording a minimum of 90 percent visibility of surface of the produce sold pre -packaged. -2- 39-0-76 • "Section 29-78. Penalties Any retail store violating any of the provisions of this ordinance shall be fined a sum not less than fifty dollars ($50.00) nor more than five hundred dollars ($500.00) for each offense. Any violation of any of the provisions of this ordinance, in addition to any of the fines provided for herein, may be grounds for revocation of any license issued by the City of Evanston to any such violator." SECTION 2: All ordinances or parts of ordinances in conflict here- with are hereby repealed. SECTION 3: This ordinance shall be in full force and effect ninety (90) days after it has been passed, approved and pub- lished in the manner provided by law. 3 Introduced February 7 1977 Adopted February 14 1977 1 ATTEST: f /s/ Maurice 9.
