AN ORDINANCE
Establishing Flood Control Districts
I, II, III, and Providing for the
Disconnection of Downspouts
in Said Districts
WHEREAS, it is in the best interest to the public to prevent the
overloading of sewer systems, caused by direct entry of storm waters, ground
waters, and other extraneous flows; and
WHEREAS, it is in the best interest of public health and safety
to prevent sewer backups caused by the introduction of direct extraneous
flows into the sewer systems; and
WHEREAS, it is in the best interest of the community to prevent
is damage to residential, commercial, and industrial property, from sewer system
backups caused by direct entry of storm waters into the sewer system; and
WHEREAS, portions of the City of Evanston are predominately
single family residential areas which can be identified as water shed areas
for specific sewer systems; and
WHEREAS, said sewer systems were constructed many years ago and
are now inadequate to carry off storm waters entering into the systems during
periods of heavy rain which results in flooding of basements and lower levels
of homes; and
WHEREAS, many of the properties served by the sewer systems have
downspouts connected directly to the sewer systems thereby decreasing the
time of concentration and increasing the surcharge of the systems, thereby
causing pollution and basement flooding; and
WHEREAS, the disconnection of downspouts could ameliorate
• the flooding problems in certain areas of the community; and
WHEREAS, in certain situations, the disconnection of the down-
spouts might cause surface flooding to adjacent properties and that the
inspection of each residence is required to make this determination; and

• WHEREAS, public hearings were conducted in the three proposed areas to
explain the requirements and benefits of the program and to receive public
input;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
EVANSTON, COOK COUNTY, ILLINOIS:
SECTION 1: That the present Sections 10-29 and 10-30 of the Code of the
City of Evanston, 1957, as amended be and hereby are renum-
bered as Sections 10-34 and 10-35 respectively.
SECTION 2: That Article III of Chapter 10 of the Code of the City of
Evanston, 1957, as amended, be further amended by the
insertion therein of the following provisions:
"10-29. Flood Control Areas.
The following areas are hereby designated as Flood Control Areas:
• Flood Control Area I
Area bounded on the north by Sheridan Place;
On the west by Ridge Avenue;
On the south by Milburn Street; and
On the east by Lake Michigan
Flood Control Area II
Area bounded on the north by Isabella Street;
On the west by Gross Point Road;
On the south by Central Street; and
On the east by Lincolnwood Drive
Flood Control Area III
Area bounded on the north by the CTA tracks;
On the west by Asbury Avenue;
On the south by Howard Street; and
On the east by Ridge Avenue
10-30. Inspections of Flood Control Areas.
The City Manager shall cause every residence located in Flood
Control Areas numbered I, II, and III to be inspected as soon as
practicable after the enactment of this ordinance in order to
determine whether the downspouts thereon should be disconnected. If

the aforesaid inspection indicates that the disconnection should be
• made, the City Manager shall cause the owner of such residence to be
so notified in writing and encouraged to disconnect the downspouts on
his residence and to so notify the City of Evanston upon completion.
10-31. Notice and Reinspection.
Upon receipt of notice that the downspouts have been disconnected,
the City of Evanston shall conduct an inspection to verify and approve
the disconnection. After approval, the owner shall be reimbursed by
the City in the amount of $7.50 for each downspout disconnected with
a maximum reimbursement not to exceed $30.00 per house. No reimburse-
ment shall be made for any downspouts disconnected prior to the enact-
ment of this ordinance or for any downspout disconnected without a
determination by the City that it be so disconnected.
10-32. Compliance.
• It is the intent of this ordinance to encourage the disconnection
of downspouts, where feasible as determined by inspection by the city
in the three flood control districts established herein and said dis-
connection to be accomplished on a voluntary basis by the home owners.
10-33. Suspension of Application --Plumbing Code.
When an area of the city has been designated a Flood Control Area,
the provisions of Article 8 of The BOCA, Basic Plumbing Code, Third
Edition, 1975, Article 8, Section P. 801.1 shall be deemed to be sus-
pended and where a provision of such code or any other construction or
building code shall conflict with requirements of this ordinance, this
ordinance should be deemed to supercede."
SECTION 3: This ordinance is intended to and shall be in addition to
all other ordinances, rules and regulations concerning
storm water drainage and shall not be construed as repealing or rescinding any
• other ordinances or parts of ordinances unless in direct conflict therewith.

SECTION 4: This ordinance shall be in full force and effect from and
after its passage, approval and publication in the manner
provided by law.
