HomeMy WebLinkAboutORDINANCES-1976-015-O-762-3-76 15-0-76 ; AN ORDINANCE • AMENDING SECTION IV OF THE ZONING ORDINANCE PERTAINING TO NONCONFOI2hIING STRUCTURES AND USES AND STRUCTURES DESIGNED FOR A NONCONFORMING USE BE IT ORDAI14ED BY THE CITY COUNCIL OF THE CITY OF EVANSTON, COOK COUNTY, ::ILLINOIS: SECTION 1: That the present subsection M of Section IV of the Zoning Ordinance of the City of Evanston, 1960, as amended be and hereby is further amended and redesignated subsection L. ; SECTION 2: That the following paragraphs be added to Section IV of the Zoning Ordinance of the City of Evanston, 1960, as amended, sand that they shall be designated subsection M: I'M. OCCUPANCY OF DWELLING UNITS. ' i 1. No dwelling unit shall be occupied by more than one family as defined ti by this ordinance except as hereinafter provided. 2. No dwelling unit which contains less than one thousand (1,000) square feet of floor area shall be used to provide living quarters for roomers, servants, or permanent guests. Where the floor area of a dwelling unit exceeds one thousand (1,000) square feet and the 'family' occupying said dwelling unit does not consist of unrelated persons, said dwelling unit may also be used for living quarters for not more than two servants, roomers, or permanent guests, provided that said living quarters are located within and are physically .an integral part of the dwelling unit. 3. Where a dwelling unit is not occupied by a family as provided in 1 or 2 above, said dwelling unit may be occupied by not more than three unre- lated persons; provided that said dwelling unit contains not less than three hundred (300) square•feet of floor area for each such occupant. Thomas, Assistant City Attorney Re: SECTION IV OF THE ZONING ORDINANCE It has come to our attention that when ordinance 100-0-75 was amended per request of the Planning and Oevelopment Committee to delete the new subsection J which was to have been added, which addition would have caused subsections J through N to have been redesignated as subsections K through 0 respectively, through an oversight the old subsection L was amended and redesignated subsection (l. This, of course, was no longer necessary since no new paragraph was being added and therefore there was no need for redesig- nation of subsections. As a result of this oversight the old subsection 1-1 relating to the occupancy of dwelling units was erroneously deleted from the provisions of the Code. The enclosed ordinance is designed to rectify this error, by reestablishing the former subsection L as amended per ordinance 100-0-75 and by reestablishing the old subsection 14 to Section IV of the Zoning Ordinance. The Law Department will be happy to respond to any inquiries in this regard.. •
