AN ORDINANCE'
Adopting the B.O.C.A. Basic Plumbing Code,
Third Edition, 1975, By Reference and Amending
Article III of Chapter 10 of the Code of the
City of Evanston, 1957.
WHEREAS, the City Council of the City of Evanston is desirous of adoptinc
certain criteria for the construction, alteration and installation of plumbing
work contained in the B.O.C.A. Basic Plumbing Code,'Third Edition, 1975; and
WHEREAS, the City Council of the City of Evanston has caused three
copies of the aforesaid Code to be kept on file in the office of the City Clerk
for public inspection for a period of fifteen (15) days prior to the adoption'
of this ordinance;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
EVANSTON, COOK COUNTY, ILLINOIS:
SECTION 1: That Article III'of Chapter 10 of the Code of the City of
Evanston, 1957, as amended be further amended to read as
follows:
"ARTICLE III. PLUMBING CODE
10-20. Adoption of B.O.C.A. Basic Plumbing Code - Exceptions and Additions
• a) Pursuant to the authority granted by Chapter 24, Section 1-2-4 of
the Illinois Revised Statutes and the powers granted home rule units
of government by the Constitution of the State of Illinois, the City
of Evanston hereby adopts by reference as criteria for the issuance
of permits for the construction, alteration, and installation of
plumbing work the B.O.C.A. Basic Plumbing_ Code, Third Edition, 1975,
with the following exceptions:
1. Deletions.
Section P-904.5
2. Additions.
Section P-311.3. The floor of every public water closet or
urinal compartment shall be of concrete or other non -absorbent
material and shall be graded to drain into any floor type
urinal waste opening or into a floor drain.
3. Amendments: The following sections of the B.O.C.A. Basic Plumbing
Code, 1975, are amended to read as follows:

Section P-308.2. Public System Available.
A public water supply system and/or public sewer system shall
be deemed available to premises used for human occupancy if
such premises are within 1000 feet, measured along a street,
alley, or easement, of the public water supply or sewer system
and a connection conforming with the standards set forth in
this code may be made thereto.
Section P-313.3. Freezing.
Water service piping and sewers shall be installed below
recorded -frost penetration but not less below grade than five
(5) feet for water piping and four (4) feet of sewers. Plumbing
piping in exterior building walls shall be adequately protected
against,freezing by insulation or heat or both.
Section P-405.2.3. Building Sewer.
a. In a Trench Separate From Water Service: If the building
sewer is installed in a trench separate from the water
service, the sewer pipe shall be of cast iron, concrete,
vitrified clay tile, bituminized fiber plastic, asbestos
cement, copper tube of a weight not less than that of copper
water tube Type L, hard temper. Joints shall be watertight
and root -proof.
b. In Trench With Water Service: If the building sewer is
installed in the same trench as the water service, the
conditions of Section P-1602.21 shall•be met.
Section P-1602.1 Size of Water Service.
The water service pipe shall be of sufficient size to furnish
water to the building in the quantities and at the pressure
required elsewhere in this code. It shall in no case be less
than one (1) inch nominal diameter. One method for sizing the
water service pipe is described in Appendix A.
b) Any reference to the administrative -authority or building official
shall mean the Director of Inspections and Permits of the City of
Evanston.
c) Any reference to municipality shall mean the City of Evanston.
d) Fees. Fees for the issuances of permits to conduct work pursuant
to this ordinance shall be in accordance with the schedule of fees
established by Ordinance of the City Council of the City of Evanston,
SECTION 2: That Section 10-21 through 10-30 shall be added to Article
IV of Chapter 10 of the Code of the City of Evanston, 1957,
as amended, and shall read as follows:
"10-21. Application..
The provisions of the B.O.C.A. Basic Plumbing Code and the provisions
of this ordinance shall be deemed to apply to all matters concerning
the design, installation, alteration, addition, repair, removal,
construction, use, location and maintenance of plumbing systems, sanitarj

and storm drainage, sanitary facilities, water supply, storm and
sewage disposal in servicing existing and proposed buildings or
structures in the City.
10-22. Non-metallic pipe materials.in water service - Prohibited.
Notwithstanding any of the provisions of the B.O.C.A. Basic Plumbing_
Code, 1975, to'the contrary the use of non-metallic pipe materials
in water distribution services is hereby prohibited.
10-23. Licensed Plumbers.
No plumbing work of any kind shall be done in the City of Evanston
except in compliance with the Illinois Plumbing License Law, Ch. 111-1/2,.
S 116.36 to 116.75, Ill. Rev. Stats., 1969.
10-24. Licensed Plumber - Bond.
No licensed plumber shall perform plumbing work in the City of Evanston
except for minor repairs unless prior thereto he shall have on file in
the office of the City Clerk, a bond in the sum of $10,000 with sureties
conditioned upon, among other things, the applicant indemnifying and
saving harmless the City of Evanston from all claims or damages arising
from any negligence and unskillfulness in the execution or protection
of his work and from any unfaithful or inadequate work done by virtue
of any permit that may be issued to him by the Department of Inspections
and Permits, and also if required by the City of Evanston, restoring streets,
sidewalks, and pavements over any piping he may lay, and filling all
excavations made by him, so as to leave said streets, sidewalks and
pavements in as good state and condition as he found them, and keeping
and maintaining the same in good order fora reasonable time thereafter, to
the satisfaction of the Street Department of the City of Evanston, and
further conditioned upon the aforesaid plumber paying all fines that may
be imposed upon him for any violation of any ordinance, rule or
_regulation adopted by the municipality, and conforming to all the lawful
regulations of the municipality pertaining to the business of plumbing.

10-25. Drain Layer - Certification.
No person shall hold himself out to do or engage in the work of drain
tile laying within the City unless prior thereto he shall have applied
for and been issued a Drain Layers Certificate by the Director of
Inspections and Permits.
10-26. Drain Layer - Examination Prior to Certification.
The Director of Inspections and Permits shall cause an examination, to
determine the applicant's qualifications, to be conducted by the Plumb-
ing Inspector and the Superintendent of the Sewer Department from time
to time as the demand for certificates may require. Said examiners shall
determine, from a written examination and an actual demonstration of
workmanship, whether or not each candidate for a drain layer's certif-
icate has sufficient knowledge and ability to qualify as a certified
drain layer. Upon satisfactory completion of said examination, the
examiners shall notify the Director of Inspections and Permits who shall
authorize the issuance of a drain layer's certificate to the successful
candidates. Said certificates shall expire on December 31 of the
• year of issuance. A certificate may be renewed by qualified drain
layers who have performed work satisfactory in character to the
Plumbing Inspector and Superintendent of Sewers upon application
therefor to the Director of Inspections and Permits. Should an appli-
cant fail to pass the examination, he may apply for re-examination upon
payment of a second examination fee of five dollars. Said re-examination
shall not be held sooner than'six months following the date of the
previous examination and shall be similar in character and thoroughness.
10-27. Application and Renewal - Fees.
Upon application for issuance or renewal of.a drain layers certificate,
the applicant shall pay the sum of $25 to the City Collector as a
certifid'ation fee.
10-28. Drain Layer - Bond.
No certified drain layer shall perform work within the City unless prior
thereto he shall have filed in the office of the City Clerk a bond in
the penal sum of $10,000 in a form approved by the City Attorney upon

sureties approved by the City Clerk conditioned upon the applicant's
indemnification of the City from all claims arising out of work performed
in the City by virtue of any permit issued to the drain layer by the
Department of Inspections and Permits, and conditioned upon the
restoration of any portion of the public way or excavations made by him
to a safe and presentable condition; and such repairs or restorations
shall be maintained in good order for a reasonable period thereafter;
and further conditioned upon the prompt payment of all fines which may
be imposed upon him for violation of any ordinance of the City; and
further upon the faithful conformance by the drain layer to the regu-
lations of the municipality of the business of drain laying.
10-29. Penalty.
Any person who shall install, extend, alter, repair or maintain plumbing
systems in or adjacent to buil-dings except in conformity with the
provisions of the B.O.C.A. Basic Plumbing Code, Third Edition, 1975,
as adopted shall be punishable by a fine of not less than fifty dollars
nor more than five hundred dollars for each and every offense. Each day
• I that an offense continues shall be deemed a separate offense.
10-30. Severability.
It is the intention of the City Council that the provisions of this
ordinance and the B.O.C.A. Basic Plumbing Code are severable and that
the invalidity of any section or part of any section of this ordinance
and the Code hereby adopted shall not affect any other section or portior
of this ordinance or code."
SECTION 3: That Article V of Chapter 10 of the Code of the City of
Evanston adopting the National Electrical Code as a criteria
for electrical work, consisting of Sections 10-25 through 10-27 inclusive,
be and hereby is renumbered as Article V, Section 10-50 through 10-52 inclusive.
SECTION 4: This ordinance shall be in full force and effect from and
after its passage, approval and publication in the manner
provided by law.
• SECTION 5: All ordinances or parts of ordinances in conflict herewith
are hereby repealed.
