HomeMy WebLinkAboutORDINANCES-1975-096-O-7596-0-75 ' AN ORDINANCE Adopting the B.O.C.A. Basic Mechanical Code, Second Edition, 1975, By Reference and Amending Article IV of Chapter 10 of the Code of the City of Evanston, 1957. WHEREAS, the City Council of the City of Evanston is desirous of adoptinc certain criteria for the construction, alteration and installation of mechanical work contained in the B.O.C.A. Basic Mechanical Code, Second Edition, 1975; and WHEREAS, the City Council of the City of Evanston has caused three copies of the aforesaid Code to be kept on file in the office of the City Clerk for public inspection for a period of fifteen (15) days prior to the adoption i of this ordinance; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF EVANST(-N, COOK COUNTY, ILLINOIS: SECTION 1: That Article IV of Chapter 10 of the Code of the City of Evanston, 1957, as amended be further amended to read as follows: "ARTICLE IV. MECHANICAL CODE 10-40. Adoption of B.O.C.A. Basic Plumbing Code - Exceptions and Additicns. a) Pursuant to the authority granted by Chapter 24, Section 1-2-4 of the Illinois Revised Statutes and the powers granted home rule units of government by the Constitution of the State of Illinois, the City of Evanston hereby adopts by reference as criteria for the issuance of construction, alteration, and installation of mechanical work the B.O.C.A. Basic Mechanical Code, Second Edition, 1975, with the following exceptions: A. Deletions. Sections M-119.0 through 119.4 inclusive. The last sentence of Section M-500.1 which reads as follows: 'This article shall govern the annual inspection and fees imposed for such inspections.' Section M-500.5. Section M-501.1. Section M-502.1. Table M-502. Section M-1100.0 through M-1122.1 inclusive. b) Any reference to the administrative authority or building official shall mean the Director of Inspections and Permits of the City of Evanston. - { r r 96-0-75 0 -2- c) Any reference to municipality shall mean the City of Evanston.' SECTION 2: That Section 1-41 through 10-42 shall be added to Article IV of Chapter 10 of the Code of the City of Evanston, 1957, as amended, and shall read as follows: "10-41. Penalty. Any person who shall install, extend, alter, repair or maintain mechanical systems in or adjacent to buildings except in conformity with the pro- visions of the B.O.C.A. Mechanical Code, 1975 Second Edition as adopted shall be punishable by a fine of not less than fifty dollars nor more than five hundred dollars for each and every offense. Each day that an offense continues shall be deemed a seperate offense. 10-42. Severability. It is the intention of the City Council that the provisions of this ordinance and the B.O.C.A. Basic Mechanical Code are severable and that the invalidity of.any section or part of any section of this ordinance and the Code hereby adopted shall not affect any other section or portion of this ordinance or code." SECTION 3: This ordinance shall be in full force and effect from and after its passage, approval and publication i.n the manner provided by law. SECTION 4: A11 ordinances or parts of ordinances in conflict herewith are hereby repealed.
