HomeMy WebLinkAboutORDINANCES-1975-093-O-7593-0-75 • AN ORDINANCE Amending the Zoning Ordinance to Exempt Single and Two Family Homes from the Off -Street Parking Requirements of the Zoning Ordinance where Certain Conditions Exist Whereas, the Evanston Zoning Amendment Committee has on September 4, 1975 conducted a public hearing on the question of exemption from the off-street parking regulations for single-family and two-family homes constructed prior to January 1, 1965 which never provided the required off-street parking, were not subsequently, structurally altered, and for which there are physical obstacles to creating off-street parking, said public hearing having been conducted pursuant to notice published in the manner prescribed by law; and Whereas, the Evanston Zoning Amendment Committee has reported its findings and recommendations to the City Council of the City of Evanston; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF EVANSTON, COOK COUNTY, ILLINOIS: 9 SECTION 1: That Section X.B.11 of the Zoning Ordinance of the City of Evanston, 1960, as amended, be and hereby is further amended by adding the following subparagraph d: "X.B.11.d. Notwithstanding any other provisions of this ordinance properties which were improved with single-family or two-family homes constructed prior to January 1, 1965 pursuant to a building permit from the City of Evanston but without the off-street parking facilities otherwise required by this ordinance need not provide such off-street parking facilities if: (1) neither the owner, nor his predecessors, in title have taken any affirmative action to eliminate required off-street parking spaces originally provided; (2) no structural alterations were made subsequent to original con- struction; and (3) there existed on August 1, 1974 physical obstacles to the creation of the required off-street parking on the site including but not limited to buildings, porches, stoops, and large trees. Fences, i-n and of themselves, shall not be construed as a sufficient obstacle to the creation of required off-street parking. Any property found to be eligible for this exemption shall be so certified in writing by the Director of Inspections and Permits. Copies of the certification together with a statement with respect to the required finding and conditions and any other relevant documentation shall be provided to the property owner and shall • be kept on file in the Inspections and Permits Department." SECTION 2: This ordinance is intended to and shall be in addition to all other ordinances, rules and regulations concerning off-street parking requirements and shall not be construed as repealing or rescinding any other ordinance or part of any ordinance unless in direct con- flict therewith. 1E • 93-0-75 -2- SECTION 3: This ordinance shall be in full force and effect from and after its passage, approval and publication in the manner provided by law.
