Rooming Houses, Dormitories, Hotels, Etc. 38-1. Scope - This Chapter shall apply to every dwelling, rooming house, furnished rooming house, lodging house, boarding house, private club, dormitory, fraternity, sorority, hotel, and any other similarly occupied building, structure, or portion thereof kept, held, or used where sleeping or lodging is provided or which is equipped to provide lodging by pre -arrange- ment for a definite period for compensation for three or more persons herein- after called roomers, guests or transients, which are not husband or wife, son or daughter, father or mother, sister or brother, grandparents, grandchildrhn, niece or nephew or domestic employees, not to exceed two (2) in number, of the • owner or operator. 38-2. Conformity with Applicable Ordinances - No house, building, or accessory structure hereafter constructed or erected in the City shall be used as set forth in Section 38-1 herein, and no house, building or accessory structure heretofore erected and not now used for such purpose, or any building, house, structure or portion thereof which is now used or intended to be used or occupied for such purposes shall be converted into, used as, or leased as set forth in Section 38-1 herein, unless such building and every part thereof shall conform to the requirements of this Chapter and to such other requirement3 of the building, zoning, housing, fire prevention and health ordinances of the City as may apply. 38-3. License -Required: Qualifications; Transferability, Etc. - It shall be unlawful for any person to conduct, keep, manage or operate or cause • to be conducted, kept, managed or operated a use as set forth in Section 38-1 herein, without a license therefor. Such license shall not be transferrable. Same - Application - A written application for the license • required by the preceeding section upon forms furnished by the City Collector shall be filed with the City Collector on or before January 1 of each year and shall accurately state the full name and address of the applicant and the person in whose name such license is to be issued, the full name and address of the owner of the building and premises where such use as set forth in Section 38-1 herein is proposed to be carried on, the number of rooms in such building and which of such rooms in the building are to be occupied as sleeping rooms and the number of persons proposed to be accomodated or allowed in each room. Such applicant shall file with his application four (4) copies of a plan of each floor of the building, which plan shall be drawn to a scale of not less than 1/4 inch to a foot showing all fire escapes, stairs, and halls, the location and size of all windows, the location and size of habitable rooms, and the exits on each floor; a statement, in writing, showing the maximum • number of persons proposed to be accomodated or allowed on each floor; and the intended use of every room in the building must be written in the plan submitted, 38-5. Same - Official Approval - Upon receipt of the application and plans required by this chapter, it shall be the duty of the City Collector to submit a copy of the application and plans to each of the following: the Director of Inspections and Permits, the Fire Marshal and the Public Health Director, who shall each cause an inspection to be conducted, and no such license shall be issued until the City Collector has received the written approval from each of such officials. 38-6. Same.- Fees - The license required by this chapter shall be issued by the Department of Inspections and Permits and the annual fee for such license shall be as follows: (a) for each and every building containing a use as set forth in section 38-1 herein, $15.00 for such building; (b) buildings containing a use as set forth in section 38-1 herein, $5.00 per roomer, guest • or transient occupant. Such fee shall accompany the application therefor. 38-7. Duties of Fire Marshal - The Fire Marshal shall determine that all fire hazards have been eliminated from the premises; that such premises have proper and sufficient fire extinguishing equipment; and that such premises comply with all regulations and recommendations of the City Bureau of Fire Prevention. 38-9. Duties of Public Health Director - The Public Health Director shall determine that all regulations and orders of the Illinois Department of Health and the Department of Health of the City, as well as all provisions of the Housing Code of the City and all provisions of any other ordinances pertaining to the sanitation of such premises and every part thereof and to the preservation of the health of the occupants thereof have been complied with. 38-10. Inspections - At least once every three years after the original license has been issued as provided in this chapter, or more often if deemed necessary to conduct, keep or operate any use as set forth in section 38-1 herein, it shall be the duty of the Director of Inspections and Permits to authorize the inspections of such premises and to determine that all ordinances of the City are complied with. 38-11. Number of rooms limited by Zoning Ordinance - No use as set forth in section 38-1 herein shall provide for more than the number of persons permitted by the Zoning Ordinance of the City. 38-12. Register - The landlord, propietor, keeper, manager or clerk of every use as set forth in section 38-1 herein,shall keep a register in which shall be entered the name of every person who becomes a lodger, boarder, or paying guest therein. Such register shall also show the number and location of the room or bed occupied by such person, the date of his arrival, and the period for which the guest engaged board or lodging. Violation of Chapter Declared a Nuisance - The maintenance or use -of any use as defined in section 38-1 herein,in violation of the provisions of this chapter is hereby declared to be and shall constitute a public nuisance. 38-14. Interpretation of Chapter - The provisions of this chapter shall be held to be the minimum requirements with respect to the uses as set forth in section 38-1 herein,for the promotion of the public health, safety, comfort, convenience and general welfare. 38-15. Violation of ordinance - Any owner, tenant or other person who shall violate any of the provisions of sections 38-1 to 38-14 of Chapter 38 "Rooming Houses, Dormitories, Hotels, etc." of the Code of the City of Evanston, 1957, as amended, shall,upon conviction, be punished by a fine of not less than $25.00 nor more than $200.00 in case of a first offense, and by a fine of not less than $50.00 nor more than $200.00 for each and every subsequent offense,and each day's failure to comply with any such provisions shall constitute a separate violation." SECTION 2: All ordinances or portions of ordinances in conflict with the terms of this ordinance are hereby repealed. SECTION 3: This ordinance shall be in full force and effect from and after its passage, approval and publication in the manner provided by law.
