AN ORDINANCE
Providing for a Special Assessment Abatement
WHEREAS, the City of Evanston has heretofore adopted several ordinances
providing for the making of local improvements by special assessment in the
City; and .
WHEREAS, pursuant to such ordinances, special assessments have been
confirmed in the courts of Cook County and all requisite statutory steps as
required by law have been taken in such proceedings, including the entry of
a judgment of confirmation, construction of the improvements, and the
issuing of bonds and vouchers; and
WHEREAS, there has been final settlement with the contractor and the
Board of Local Improvements has had the cost thereof, including the cost of
engineering and legal services, certified in writing to the court in which
the assessment was confirmed, together with an amount estimated by the board
to be required to pay the accruing interest on bonds or vouchers issued to
anticipate collection; and
. WHEREAS, the total amount assessed for the improvement upon the public
and private property exceeds the cost of the improvement; and
WHEREAS, Section 9-2-114 of Chapter 24 of the Illinois Revised Statutes.
1973, provides that all such excess except that amount required to pay such
interest as is provided for by law, must be abated and the judgment reduced
proportionately to the public and private property owners and shall be credited
pro rata upon the respective assessments for the improvement under the direc-
tion of the Court; and
WHEREAS, the Board of Local Improvements found such excesses to exist
in the cases of Special Assessments 1312, 1320 and 1326 and certified this
fact to the Court having jurisdiction herein together with the recommendation
of the amounts to be abated; and
WHEREAS, the said Court making final confirmation on the aforesaid
specialassessments directed legal counsel for the City of Evanston to prepare

NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
EVANSTON, COOK COUNTY, ILLINOIS:
SECTION 1: That there be an abatement upon each of the lots, blocks,
tracts or parcels of land as contained in the assessment
rolls as hereinafter set forth as assessed of its pro rata proportion of the i
f
surplus of said assessment. That the names, permanent index numbers and
legal descriptions of the parcels affected, together with the installment
amounts revised on a pro rata basis to conform with the amount to be abated
are as follows:

SECTION 2: That the said adjustments to be made under the abatement
procedure, shall only involve the installments remaining
to be paid except in those instances where the entire assessment was prepaid
in which case the amount by which the assessment was reduced shall be paid
to the owner of record of each lot, block, tract or parcel, as of the date
of this ordinance, being the time of the declaration of the abatement.
SECTION 3: That with respect to each of the subject special assessments
herein, the total amounts to be abated are as follows:
1312 - $14,712.42
1320 - $ 1,610.79
1326 - $ 919.79
SECTION 4: That the Board of Local Improvements shall keep and
exhibit publicly in its office an index of all permanent
index numbers upon which abatements are due and payable and, on proper proof,
the amount of the reduction shall be repaid to persons entitled thereto.
SECTION 5: That the Board of Local Improvements shall give notice
to each of the property owners of record and, upon receipt
of proof of ownership and production of paid receipt for prepayment of the
entire assessment, shall issue a check payable to said property owner.
SECTION 6: This ordinance shall be in full force and effect from and
after its passage and approval in the manner provided by
law.
