AN ORDI14ANCE
Amending Certain Sections of the Code of the City of Evanston
to Conform with the Zoning Ordinance Regarding Sidewalk Sales
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF EVANSTON, COOK '

{ SECTION 1: That Section 42-12 of the Code of the City of Evanston,
i
1957, as amended, be and hereby is further amended to
.,,read as follows:
"Section 42-12. Permit Prerequisite to occupation of location for
s; sale of merchandise.
i .
t No person or any licensed peddler or vendor shall occupy or stand in
i`
one place or location on any of the streets or sidewalks of the City
!; for the purpose of selling, offering for. sale or advertising the sale
i of merchandise of any kind or character, including soft drinks, ice
cream,'candy, nuts or other confections, bakery goods or sandwiches
without a permit first having been obtained from the City Manager."
SECTION 2: That Section 42-61 of the Code of the City of Evanston,
1957, as amended, be and hereby is further amended to
:read as follows:
"Section 42-61. Use of Sidewalk for storage of goods, etc.

It shall be unlawful for any public sidewalk to be used for the -
storage of goods, wares or merchandise except as may be provided in
this chapter or by ordinance or resolution of the City Council other-
h wise specially provided. No person shall place or cause to be placed
in or upon any sidewalk any.barrel, box, hogshead, crate, package
' or any other matter or thing whatsoever and shall suffer the same to
i
remain thereon more than one hour. The Director of Public Works
or Department of Police are hereby empowered to cause the same to

be removed at the expense of the person placing the same there. Such
person shall also be subject to a fine of Ten dollars ($10.00) an hour
for each and every hour that such goods, wares, merchandise, matter
or thing remain there after the expiration of one hour."
i; SECTION 3: That Section 42-62 of the Code of the City of Evanston,

�� 1957, as amended, be and hereby is further amended to read

�j "Section 42-62. Placing signs on sidewalks.
I� It shall be unlawful for any person to place any sign on any sidewalk
i4 except as may be provided in this chapter or by ordinance or resolution

of the City Council otherwise specially provided. If any sign is
placed on the sidewalk in violation of this section, the Director of

j; Public Works and Department of Police are hereby empowered to cause
such sign to be removed at the expense of the person placing the

same on the sidewalk."
(� SECTION 4:- This ordinance is intended to and shall be in addition to
i! •
all other ordinances, rules and regulations concerning
~sidewalk sales and shall not be construed as repealing or rescinding any other
;ordinances or parts of ordinances unless in direct conflict therewith.

'SECTION 5: This ordinance shall be in full force and effect from
H and after its passage, approval and publication in the
`:!manner provided by law.
