HomeMy WebLinkAboutORDINANCES-1975-060-O-75S i • 60-0-75 Revised 7-17-75 AN ORDINANCE { Establishing City of Evanston Special Service Area No. 3 i of the City of Evanston, Cook County, Illinois WHEREAS, the constitution of the State of Illinois, 1970, has established the authority of municipalities to designate special service areas within the boundaries of Home Rule Municipalities, and WHEREAS, the City of Evanston, a home rule municipality, has conducted a public hearing on June 23, 1975, pursuant to notice prescribed by Chapter t 120, Sections 1301 et seq of the Illinois Revised Statutes, and WHEREAS, the City Council of the City of Evanston has made the following findings of fact as the result of the aforesaid public hearing: a) That the question of the establishment of the area hereinafter 3 I described.as a special service area is considered by the City Council pursuant i to a resolution entitled: "A RESOLUTION PROPOSING THE ESTABLISHMENT OF A SPECIAL SERVICE AREA IN THE CITY OF EVANSTON, COOK COUNTY, ILLINOIS, AND j j PROVIDING FOR A PUBLIC HEARING AND OTHER PROCEDURES IN CONNECTION THEREWITH", f adopted June 2, 1975, and is considered pursuant to the aforementioned public hearing held on June 23, 1975, by the City Council of the City of Evanston; b) That in accordance with the laws of the State of Illinois, notice of the aforesaid public hearing was duly published in the Evanston Review., a 1 �1newspaper of general publication within the City of Evanston on June 5, 1975, !, - }at least fifteen days prior to public hearing and given by mail to persons 11whose names appear as payers of general taxes in the last preceding year for ;?each lot, block and parcel of land lying within the proposed special service M'area, said notice having been given by depositing postage paid a copy of the i?notice in the U.S. mails on June 10, 1975, not less than 10 days prior to the s . :`date set for the public hearing. In the event taxes for the last preceding ;year were not paid, the said notice was sent to the person last listed'on-the ltax rolls prior to that year as the owner of said property. A certificate of ,publication of said notice is attached to this ordinance as Exhibit 1. Said 1!notice conformed in all respects to the requirements of.Sections 1301 to �F �i '11311, inclusive; of Chapter 120 of the Illinois Revised Statutes of 1973, as i z ,amended; .s 1 0 • 0 -2- c) That a public hearing on the questions -set forth in the notice was held on June 23, 1975 and all interested persons were given an opportunity j �. to be heard on the question of the creation of a special service area, the services pertaining thereto, and the question of an annual tax for the maintenance of said special service, including the issuance of bondsin anticipation of said taxes; i d)' That all objections and protests to the proposed special service area, the services pertaining thereto and the taxation of the owners of properties within said special service area were heard and determined at the aforesaid public hearing; e) That the aforesaid public hearing.was properly and finally adjoined; on June 23, 1975. f) That having considered the data presented at the aforementioned public hearing, the City Council of the City of Evanston finds that it i-s in the public interest and in the interest of the City of Evanston Special Service Area No. 3 that said Special Service area as hereinafter described be esta- blished; t g) That the said area is compact and contiguous and constitutes a business and commercial area within the City of Evanston. h) That it is in the best interests of' -said service area that the ; � I municipality provide special services for the common interests of the area r hereinafter designated and that said.area as proposed as a special service �i U area will benefit specifically from the municipal services proposed to be provided, and further, that said special services are unique and in addition to the general municipal services provided to the City of Evanston as a whole. NOW, THEREFORE, BE IT ORDAINED, by the City Council of the City of Evanston, Cook County, Illinois: SECTION 1: That a special service area to be known and designated as City of Evanston Special Service Area No. 3 is hereby j� established and shall consist of the following described territory: (A map I of said territory is attached hereto as Exhibit 2.) a • A. • a - Thence Southeasterly along said North line 1. Special services as they apply to Special Service i Area No. 3 shall include: The improvement of parkways with surface treatment of exposed aggregate and bands of brick pavers along the curbs and in other places; the installation of new street lighting, street trees, tree grates, planter walls, street signs, and street furniture such as obelisks, trash receptacles, benches and drinking fountains, together with any such other and further services necessary and/or incidental to the accom- plishment of the aforesaid improvements. SECTION 3: That the City of Evanston Special Service Area No. 3 is 1 created so that bonds may be issued for purposes aforesaid !payable from taxes levied upon the property within the aforesaid special service' ,area in addition to all other City taxes so levied and provided, however, that #bonds shall be issued not to exceed the principal amount of One Million, Two i ;Hundred Thousand dollars ($1,200,000.00)•at an interest rate not to exceed 1 t eight percent (8%) per annum and further that said bonds shall mature within twenty (20) years from the date of issue. SECTION 4: This ordinance shall be in full force and effect from and I after its passage and approval and publication in the ;manner provided by law.
