HomeMy WebLinkAbout069-O-21 Amending the City Code to Create the Housing & Community Development Committee6/3/21 69-0-21 AN ORDINANCE Amending Portions of the City Code Codifying the Housing and Community Development Committee WHEREAS, the City of Evanston desires to codify the creation of the Housing and Community Development Committee by realigning the responsibilities of the Housing and Community Development Act Committee and the Housing and Homelessness Commission as they relate to the development and preservation of decent and affordable housing and viable urban communities, and the expansion of economic opportunities primarily for low, moderate, and middle -income persons. WHEREAS, consolidating these responsibilities in a single Committee eliminates overlaps in responsibilities between those two bodies and enables the strategic use of multiple funding sources to achieve City Council objectives. WHEREAS, the Committee is responsible for developing recommendations for the use of federal Community Development Block Grant ("CDBG") and HOME Investment Partnership ("HOME") entitlement funding, and the City's Affordable Housing Fund ("AHF") to achieve City Council goals of maintaining economically, racially and ethnically integrated neighborhoods, and recommending the elimination of policies that perpetuate inequitable investment that has disparate impact on Blacks, Latinos and other people of color. 69-0-21 WHEREAS, the City Council determines that it is in the best interest of the City to codify the functions of the new Housing and Community Development Committee into the City Code. WHEREAS, Article VII, Section 6(a) of the Illinois Constitution of 1970, which states that the "powers and functions of home rule units shall be construed liberally," was written with the intention that home rule units be given the broadest powers possible" (Scadron v. City of Des Plaines, 153 111.2d 164). WHEREAS, pursuant to 65 ILCS 5/1-2-1, the City may make all rules and regulations to carry into effect the powers granted to the City, such broad and general grant of authority complementing the City's home rule powers. WHEREAS, it is well -settled law in Illinois that the legislative judgment of the City Council must be considered presumptively valid (see Glenview State Bank v. Village of Deerfield, 213 III.App.3d 747(1991)) and is not subject to courtroom fact- finding (see National Paint & Coating Assn v. City of Chicago, 45 F.3d 1124 (1995)). The Citv Council establishes a Housinq and Communitv Development Committee ("Committee") to act in an advisory capacitv to the City Council on matters that relate to the built environment and the use of federal Communitv Development Block Grant funds except Public Services cateqory ("CDBG") and HOME Investment Partnership ("HOME") funds. and the Citv's Affordable Housina Fund CAW') and anv other fundina source that Citv Council deems appropriate to address primarily the needs of Evanston's low. moderate and middle -income residents. The Committee is responsible for capital and economic development proiects and proarams includina, but not limited to: housing acquisition, development, and preservation, and housing services includinq landlord -tenant services and Inclusionary Housing Ordinance waitlist management; Citv infrastructure and facilities proiects in lower income neiqhborhoods; non-profit public facilities proiects includina homeless shelters: and economic development proiects and programs. The Committee is also responsible for the development and implementation of the Citv's Housinq and Urban Development ("HUD") Consolidated Plan, annual Action Plans and Consolidated Annual Performance and Evaluation Reports, includina seekina input from the public followina the Citizen Participation Plan, as required. Recommendations of the Committee will ao directly to the Citv Council, as with its predecessor, the Housinq and Communitv Development Act Committee. 2-4-2. - MEMBERSHIP. The Committee consists of nine (9) members who serve without compensation and reside or work in the Citv of Evanston. In appointing committee members. the Mavor will consider knowledae. familiarity, and/or experience with housina policies: needs of different populations including seniors or persons with disabilities: different tvpes of housina stock: renter and homeowner issues: public and private housina and real 69-0-21 estate development, finance, or sales: property management: and communitv outreach and enaaaement. The members must consist of the followinq: A. Four (4) Council members, at least two who represent wards with siqnificant low/moderate income residents. B. Two (2) members who reside or work in predominantly low/moderate income Evanston neighborhoods. C. Two (2) at-larqe members. D. One (1) member who has lived experience in public housing, Housinq Choice Voucher/Proiect-Based Voucher programs, or housinq restricted to households with incomes less than or equal to 80% of the area median. A member may meet more than one aualification. No member may be a full-time or part-time emplovee of the Citv of Evanston, or anv agencv, facilitv, or service that receives CDBG, HOME, AHF, or anv other fundinq overseen by the Committee on behalf of the Citv of Evanston. 2-4-3. - TERM. Council members are assianed by the Rules Committee to four (4) vear terms. Non - Council Committee members are appointed by the Mavor to three (3) vear terms with the advice and consent of the Citv Council. Non -Council Committee members may serve for not more than two (2) full terms. 2-4-4. - POWERS AND DUTIES. In carrvina out its responsibilities. the Committee shall have the following specific powers and duties: A. Oversee the U.S. Department of Housina and Urban Development's Consolidated Planninq process for the Citv of Evanston entitlement qrants (Community Development Block Grant, HOME Investment Partnerships, and Emerqencv Solutions Grant), including the review of the Citv's annual Action Plan and Consolidated Annual Performance and Evaluation Report ("CAPER"): B. Ensure that fundina is prioritized for proiects and services that provide decent housing, a suitable livinq environment, and economic opportunity for Evanston's low and moderate income residents: -5- 69-0-21 C. Receive citizen input on housing, communitv and economic development needs and comments relating to the implementation of the Consolidated Planninq process: D. Evaluate applications, prioritize, and recommend funding allocations to Citv Council for housing, public facilitv and infrastructure improvements. and economic development programs and proiects that advance the priorities set forth by City Council priorities and improve the health and wellbeing of Evanston's low, moderate, and middle -income residents: E. Monitor the progress and impact of proiects and programs receivinq Citv funding: F. Conduct periodic reviews and assessments of the effectiveness of Citv ordinances and policies at achievinq Citv Council qoals and recommend amendments to increase their effectiveness for consideration by City Council. This can include, but is not limited to, the Inclusionary Housinq Ordinance and Residential Landlord Tenant Ordinance: and G. Coordinate housing -related expenditures of CDBG, HOME and Affordable Housinq Funds, revenue sharinq funds and all other special and General funds relatinq to housing, community, and economic development. H. Perform such other acts as may be necessary or proper to carry out the purposes of this Chapter. 2-4-5. - ADOPTION OF RULES: SELECTION OF A CHAIRPERSON. A Chairperson is appointed by the Mavor from amonq its Citv Council members. The Committee must also develop and review bylaws, rules and requlations necessary to exercise its responsibilities on a periodic basis, and adopt new work plans annually. SECTION 2: All ordinances or parts of ordinances in conflict herewith are hereby repealed. SECTION 3: If any provision of this ordinance or application thereof to any person or circumstance is held unconstitutional or otherwise invalid, such invalidity shall not affect other provisions or applications of this ordinance that can be given 0-21 effect without the invalid application or provision, and each invalid provision or invalid application of this ordinance is severable.
