HomeMy WebLinkAboutORDINANCES-2015-052-O-154/17/2015 52-0-15 AN ORDINANCE Adding Dryden Place to the City of Evanston Grid System as a Private Street NOW BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF EVANSTON, COOK COUNTY, ILLINOIS, THAT: SECTION 1: The Illinois Municipal Code, 65 ILCS 5111-80-19, permits the legislative authority of a municipal corporation to originally name and then may change the name of any street, avenue, alley or other public place. SECTION 2: Section 7-2-3 of the Evanston City Code of 2012 allows for the naming of City of Evanston ("City") streets which shall be known and designated by • the names applied thereto respectively on the maps and records of the City and as designated by the ordinances of the City, then in force, fixing the names of such streets and avenues. SECTION 3: Currently, within the City of Evanston, there are five single family homes located on an unnamed private street within the Asbury -Ridge subdivision. See map attached as Exhibit A. SECTION 4: The proposed street name is Dryden Place. Dryden Place will have direct access to Asbury Avenue north of Dempster Street. The name Dryden Place is in honor of the family that built and first occupied the property located within that private street. SECTION 5: Section 7-2-3 (B) of the Evanston City Code of 2012 allows 0 that short streets running east and west may be designated as "places." The proposed 52-0-15 • Dryden Place is considered a short street that runs east and west. SECTION 6: The purpose of naming and recognizing the proposed Dryden Place as part of the City Grid System is to enhance the easy and rapid location of properties for the delivery of public safety and emergency services, postal delivery and business delivery, and to provide for the posting of residential addresses in the City. SECTION 7 The City Council of the City of Evanston hereby names the short street running east and west that has direct access to Asbury. Avenue north of Dempster as Dryden Place, which is in accordance with the aforesaid property legally described in Exhibit B, attached hereto and incorporated herein by reference. SECTION 8: The findings and recitals contained herein are declared to be prima facie evidence of the law of the City and shall be received in evidence as • provided by the Illinois Compiled Statutes and the courts of the State of Illinois. SECTION 9: All ordinances or parts of ordinances in conflict herewith are • hereby repealed. SECTION 10: If any provision of this ordinance or application thereof to any person or circumstance is ruled unconstitutional or otherwise invalid, such invalidity shall not affect other provisions or applications of this ordinance that can be given effect without the invalid application or provision, and each invalid provision or invalid application of this ordinan--e is severable.
