HomeMy WebLinkAboutORDINANCES-2019-008-O-191 /8/2019 8-0-19 AN ORDINANCE Amending Portions of the City Code to Permit Certain Trucks Used as a Residential Vehicle to Park in Residential Areas BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF EVANSTON, COOK COUNTY, ILLINOIS: SECTION 1: Subsection 10-1-3 "Definitions" within Chapter 1 "General Traffic Provisions" of the Evanston City Code of 2012, as amended (the "City Code"), is hereby further amended to read as follows: 10-1-3. - DEFINITIONS. The following words and phrases when used in this Title shall, for the purposes of this Title, have the meanings respectively ascribed to them in this Section, except when the context otherwise requires; in the event that no definition is provided herein for a word or phrase used in this Title, the meaning shall be determined by reference to the Illinois Motor Vehicle Code, 625 ILCS 5/ et seq., as amended. COMMERCIAL Any vehicle operated for the transportation of persons or property VEHICLE: in the furtherance of any commercial or industrial enterprise, for hire or not for hire, not including, a commuter van, a vehicle used in a ridesharing arrangement when being used for that purpose, or a recreational vehicle not being used commercially. PASSENGER A motor vehicle signed for the carrying of not more than ten (10) VEHICLE: persons. Passenger vehicles include pick-up trucks which are not used for commercial purposes, do not have advertising or commercial equipment, or camper tops attached to the vehicle. Recreational vehicles, as defined blow, are not passenger vehicles. RECREATIONAL Every camping trailer, motor home, mini motor home, travel trailer, VEHICLE truck camper or van camper used primarily for recreational purposes and not used commercially nor owned by a commercial business. TRUCK: Every motor vehicle designed, used or maintained primarily for the transportation of property. SECTION 2: All ordinances or parts of ordinances in conflict herewith are hereby repealed. SECTION 3: If any provision of this ordinance or application thereof to any person or circumstance is held unconstitutional or otherwise invalid, such invalidity shall not affect other provisions or applications of this ordinance that can be given effect without the invalid application or provision, and each invalid provision or invalid application of this ordinance is severable. SECTION 4: Ordinance 8-0-19 shall be in full force and effect after its passage and approval. SECTION 5: The findings and recitals contained herein are declared to be prima facie evidence of the law of the City and shall be received in evidence as provided by the Illinois Compiled Statutes and the courts of the State of Illinois.
