HomeMy WebLinkAboutORDINANCES-2019-155-O-1911 /6/2019 155-0-19 AN ORDINANCE Amending Evanston City Code 3-2-15-2(A), "Tax Imposed," To Increase the Parking Tax on Monthly Permits in Certain City Owned Garages BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF EVANSTON, COOK COUNTY, ILLINOIS: SECTION 1: Subsection 3-2-15(2)(A) of the Evanston City Code of 2012, as amended, is hereby further amended and revised as follows: (A) There is hereby levied and imposed upon the use and privilege of parking a motor vehicle in or upon any "parking lot, parking area, or garage," as defined in this Section 3-2-15, in the City, a tax of sixty cents ($0.60) for each motor vehicle parked in or on each parking lot, parking area, or garage for every twenty -four-hour period or any fraction thereof. If a motor vehicle is parked in or on a parking lot, parking area, or garage for which a charge is made on a weekly, monthly, quarterly, or annual basis, the amount of tax shall be three dollars ($3.00) per week, twelve dollars ($12.00) per month, thirty-six dollars ($36.00) per quarter, or one hundred forty-four dollars ($144.00) per year. The weekly, monthly, quarterly, or annual tax shall not be increased or decreased on account of Saturdays, Sundays, or legal holidays falling within such weekly, monthly, quarterly, or annual period, whether or not the motor vehicle is actually parked in or on said parking lot, parking area, or garage on such days. Exception: The parking tax on monthly permits in the City -owned parking garage located at 821 Davis St. (commonly known as Sherman Plaza Parking Garage) shall be sixty dollars ($60.00) per month. The parking tax on monthly permits for all other City -owned parking garages shall be fifty ($50.00) per month. SECTION 2: All ordinances or parts of ordinances in conflict herewith are hereby repealed. SECTION 3: If any provision of this ordinance or application thereof to any person or circumstance is held unconstitutional or otherwise invalid, such invalidity shall not affect other provisions or applications of this ordinance that can be given effect without the invalid application or provision, and each invalid provision or invalid application of this ordinance is severable. 155-0-19 SECTION 4: This Ordinance 155-0-19 shall be in full force and effect on February 1, 2020, after its passage, approval, and publication in the manner provided by law. SECTION 5: The findings and recitals contained herein are declared to be prima facie evidence of the law of the City and shall be received in evidence as provided by the Illinois Compiled Statutes and the courts of the State of Illinois.
