HomeMy WebLinkAboutORDINANCES-2020-026-O-202/4/2020 26-0-20 AN ORDINANCE Amending Title 7, Chapter 3, Requiring Sidewalk Installation or Replacement of Substandard Sidewalks BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF EVANSTON, COOK COUNTY, ILLINOIS: SECTION 1: City Code Title 7, Chapter 3, "Sidewalks; Sidewalk Construction", of the Evanston City Code of 2012, as amended, is hereby further amended to add the following subsections: 7-3-2. — SIDEWALK CONSTRUCTION. 7-3-2-9. — SIDEWALKS REQUIRED. Public sidewalks shall be installed where none exists whenever new construction is erected unless otherwise provided by the City Council of the City of Evanston. Sidewalks shall be installed the entire length of the lot frontage(s) where the lot abuts a street and shall be recorded on the project's site/civil plan. Construction specifications shall conform with the requirements of this Section. 7-3-2-10. — REPLACEMENT SIDEWALKS REQUIRED WHERE SUBSTANDARD SIDEWALKS EXIST. When new construction occurs where public sidewalks exist, public sidewalks shall be replaced where substandard sidewalk squares exist or when sidewalk squares have been damaged during construction. A. Where substandard sidewalk squares exist, replacement of the entire sidewalk square is required. The sidewalk square replacements shall be recorded on the project's site/civil plan. S. Substandard sidewalk squares include those with: 1. Vertical displacement: a shifting in the underlying base causing an unevenness of pavement between sidewalk panels. Sidewalk squares that have sunken or risen to a height difference of one inch (1") or more to the adjacent sidewalk square shall be replaced; 26-0-20 2. Sloping: an abrupt change in the slope of the whole sidewalk square; 3. Cracking: a separation of the sidewalk pavement caused by cracks forming in the concrete. Sidewalk squares that are broken and/or separated into three (3) or more pieces with cracks equal or greater to one -quarter inch (1/4") in width shall be replaced; 4. Spalling/Scaling: the flaking away of the hardening concrete. Sidewalk squares that have spalling or scaling to 33% or more of the surface shall be replaced; 5. Sidewalk squares that require improvement to meet the Americans With Disabilities Act (ADA) guidelines. C. The following chart provides non -exhaustive examples of potential sidewalk square problems and their common causes. Construction specifications shall conform with the requirements of this Section. The City Engineer or his/her designee shall have the duty of inspecting the sidewalks prior to the commencement of new construction to determine the sidewalk squares that shall be replaced. SECTION 2: All ordinances or parts of ordinances in conflict herewith are hereby repealed. SECTION 3: If any provision of this ordinance or application thereof to any person or circumstance is held unconstitutional or otherwise invalid, such invalidity shall not affect other provisions or applications of this ordinance that can be given effect without the invalid application or provision, and each invalid provision or invalid application of this ordinance is severable. SECTION 4: Ordinance 26-0-20 shall be in full force and effect after its passage and approval. 26-0-20 SECTION 5: The findings and recitals contained herein are declared to be prima facie evidence of the law of the City and shall be received in evidence as provided by the Illinois Compiled Statutes and the courts of the State of Illinois.
