AN ORDINANCE
Amending Title 2, Chapter 16 of the Evanston City Code,
"Zoning Board of Appeals"
NOW BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
EVANSTON, COOK COUNTY, ILLINOIS, THAT:
SECTION 1: City Code Title 2, "Boards and Commissions" of the Evanston City
Code of 2012, as amended ("City Code"), is hereby amended and shall read as follows:
Chapter 16 Zonina Board of ADDeals
2-16-1. - APPOINTMENT. COMPOSITION. TERMS.
(A) The Mavor shall appoint seven (7) Evanston citizens to serve as reaular
members of the Zonina Board of Appeals, subiect to confirmation by the Citv
Council.
(B) All appointed reaular members of the Zonina Board of Appeals shall serve as
such without compensation.
(C) Appointments of reaular members shall be for five (5) vears and then may be
reappointed for an additional term.
(D) An appointment by the Mavor, subiect to confirmation by the Council, to fill a
vacancv in an unexpired term shall be for the remainder of the term. Thereafter.
that member shall be eliaible for appointment for two (2) full terms.
(E) When a reaular member of the Zonina Board of ADDeals has been unable or has
failed to attend meetinas durina a consecutive period of four (4) months. such
absence shall be construed. after notice to the member thereof. as a resianation
from the Commission. A vacancv thus created shall be filled as in the case of
other vacancies.
2-16-2. — RULES: SELECTION OF CHAIRPERSON.

The responsibilities of the Zoning Board of Aaaeals are as outlined in Section 6-3-1-4 of
the City Code. The Zoning Board of Appeals shall establish its own rules of procedure
that do not conflict with Section 2-16 of the Citv Code. The Board shall annually elect a
Chairperson from among its members.
SECTION 2: All ordinances or parts of ordinances in conflict herewith are
hereby repealed.
SECTION 3: This ordinance must be in full force and effect after its
passage, approval, and publication in a manner provided by law.
SECTION 4: If any provision of this ordinance or application thereof to
any person or circumstance is held unconstitutional or otherwise invalid, such invalidity
must not affect other provisions or applications of this ordinance that can be given effect
without the invalid application or provision, and each invalid provision or invalid
application of this ordinance is severable.
