HomeMy WebLinkAboutORDINANCES-2020-036-O-202/27/2020 36-0-20 AN ORDINANCE Amending City Code Subsections 7.10.3, "General Regulations," and 7-11-2, "Areas Prohibited for Bathing Purposes," By Preventing Access to the Rock Revetment along the Lakefront BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF EVANSTON, COOK COUNTY, IL- LINOIS: SECTION 1: City Code Subsection 7-10-3, "General Regulations", of the Evanston City Code of 2012, as amended, is hereby further amended to add the following -subsection: 7-10-3. — GENERAL REGULATIONS. (L) Lakefront Rock Revetment Reaulation. Except for City employees or authorized Contractors workino for the City, no oerson shall climb onto. walk. run. stand or sit upon the rock revetment anvwhere along the citv owned lakefront. SECTION 2: City Code Subsection 7-11-2, "Areas Prohibited for Bathing Purposes", of the Evanston City Code of 2012, as amended, is hereby further amended to read as follows: 7-11-2. — AREAS PROHIBITED FOR BATHING PURPOSES.. No swimming is permitted from public rights -of -way not officially designated as public beaches or from boats located within three hundred (300) yards of the public shoreline. SECTION 3: All ordinances or parts of ordinances in conflict herewith are hereby repealed. SECTION 4: If any provision of this ordinance or application thereof to any person or circumstance is held unconstitutional lor otherwise invalid, such invalidity shall not affect other provisions or applications of this ordinance that can be given effect without the invalid application or provision, and each invalid provision or invalid application of this ordinance is severable. SECTION 5: Ordinance 36-0-20 shall be in full force and effect after its passage and approval. SECTION 6: The findings and recitals contained herein are declared to be prima facie evidence of the law of the City and shall be received in evidence as provided by the Illinois Compiled Statutes and the courts of the State of Illinois.
