HomeMy WebLinkAbout068-R-18 In Support of Restorative Justice Practices in the City of Evanston9/25/2018 68-R-18 A RESOLUTION In Support of Restorative Justice Practices in the City of Evanston WHEREAS, criminal recidivism in the United States remains at a national high, with 76.6% of convicted offenders being rearrested within five (5) years (M. R. Durose, Recidivism of Prisoners Released in 30 States in 2005: Patterns from 2005 to 2010, Washington, DC: U.S. Department of Justice, Bureau of Justice Statistics (2014)); and WHEREAS, to counter rising recidivism rates, restorative justice practices are being implemented in jurisdictions nationwide to provide a comprehensive solution to increasing recidivism rates (J. C. Tsui, Breaking Free of the Prison Paradigm: Integrating Restorative Justice Technique's Into Chicago's Juvenile Justice System, The Journal of Criminal Law and Criminology, 635-555 (2014)); and WHEREAS, offender rehabilitation is not only possible through restorative justice practices, but also essential to the community reparation process. If offenders are less likely to reoffend, the safety and security of the community has been effectively increased (Joseph L. D. Kennedy, Long -Tenn Effectiveness of a Brief Restorative Justice Intervention, International Journal of Offender Therapy and Comparative Criminology, 1-15 (2018)); and WHEREAS, the long term effectiveness of restorative justice intervention has proven successful in lowering the proportion of individuals who recidivated in comparison to those who were not part of a restorative intervention process; and fib-R-18 WHEREAS, restorative justice practices are used internationally in justice systems, schools, and communities to repair harm and build community; and WHEREAS, the City Council tasked the Alternatives to Arrest Committee to find local alternatives to arrest for misdemeanors and reduce the number of young adults with arrest and conviction records; and WHEREAS, the Evanston City Council finds that achieving and maintaining a community that implements restorative justice practices for juveniles is in line with the public policy of the City and seeks to implement more comprehensive restorative justice practices in circumstances where juveniles are arrested for minor general offenses, NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF EVANSTON, COOK COUNTY, ILLINOIS, THAT: SECTION 9: The foregoing recitals are found as fact and incorporated herein by reference. SECTION 2: The Evanston City Council directs the Evanston Police Department to refer all appropriate and applicable cases to Administrative Adjudication as a diversion from the juvenile justice system. SECTION 3: The Evanston City Council additionally encourages the Evanston Police Department to provide training of police officers in restorative practices. SECTION 4: The Evanston City Council directs the Administrative Adjudication Hearing Officers to offer community service participation for juveniles in conjunction with deferred prosecution to eliminate employment hardships due to juvenile arrest and conviction records. -- 68-R-18 SECTION 5: This resolution shall be in full force and effect from and after the date of its passage and approval in the manner required by law.
