HomeMy WebLinkAbout093-R-21 Authorizing the City Manager to Sign the First Amendment to the Service Agreement with Andy Frain Servicing, Inc10/11 /2021 93-R-21 A RESOLUTION AUTHORIZING THE CITY MANAGER TO SIGN THE FIRST AMENDMENT TO THE SERVICE AGREEMENT WITH ANDY FRAIN WHEREAS, the City of Evanston ("City") and Andy Frain Services, Inc. ("Andy Frain") entered into a Professional Services Agreement dated November 28, 2018 ("Agreement") to provide school crossing guard services for the City ("Services"); and WHEREAS, the Agreement called for Services to terminate January 1, 2022 with no option for renewal; and WHEREAS, the City does not wish to issue a new Request for Proposal while it is discussing Crossing Guard expenses for future City and School budget(s); and WHEREAS, the Agreement needs to be extended so that the City continues to have Services; and WHEREAS, pursuant to Section 1-17-1(a) of the Evanston Municipal Code, the City, through its City Manager, is authorized to enter into agreements for the conduct of such affairs of the City. NOW BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF EVANSTON, COOK COUNTY, ILLINOIS, THAT: SECTION 1: That the foregoing recitals are hereby found as fact and incorporated herein by reference. SECTION 2: The City Manager is hereby authorized and directed to sign the First Amendment to the Professional Services Agreement, attached hereto as Exhibit A. SECTION 3: If any provision, clause, sentence, paragraph, section or part of this Resolution, shall, for any reason, be adjudged by a court of competent jurisdiction to be unconstitutional or invalid, said judgment shall not affect, impair or invalidate the remainder of the Resolution. SECTION 4: This Resolution 93-R-21 will be in full force and effect from and after the date of its passage and approval in the manner provided by law. Attest: pp -�Jte�iarux, �cnde-�.a.
