HomeMy WebLinkAbout034-R-21 Declaring Lead Pipe Replacement a Public Benefit2/24/21 34-R-21 A RESOLUTION A Resolution Declaring Lead Pipe Replacement throughout the City of Evanston a Public Benefit WHEREAS, the City of Evanston seeks to address the livability and environmental needs of our community by following the Best Management Practices recommended by American Water Works Association to reduce the lead in the drinking water for all Evanstonians; and WHEREAS, the Center for Disease Control and Prevention ("CDC") has identified several health risks in children and adults exposed to lead, including damage to the brain and nervous system, slowed growth and development, learning and behavior problems, hearing and speech problems; and WHEREAS, water leaving the Evanston treatment plant does not contain lead; however, through corrosion of household plumbing materials, lead can leach into the water before it gets to a faucet. According to the Environmental Protection Agency ("EPA"), homes built before 1986 are more likely to have lead in the plumbing, system; and WHEREAS, water service lines installed prior to 1986 may be lead pipes and therefore, the City is replacing the City's portion of the lead pipe during water main construction projects to reduce the potential for lead in these service lines running to and from the City's water main; and 34-R-21 WHEREAS, the City is committed to following the EPA's remediation of lead pipes and any potential lead in Evanston's water as addressed in the EPA's Lead and Copper Rule, 56 FR 26460-26564; and WHEREAS, replacing, a portion of the lead pipe, resulting in a partial lead service line, could cause short term spikes in lead concentrations; and WHEREAS, to address concerns raised by the Illinois Environmental Protection Agency, the City developed a Drinking Water Lead Reduction initiative which follows the Best Manage Practices recommended by the AWWA. This initiative includes the lead service line replacement loan program, point of use filter program, post construction lead testing program, and a grant lead service line replacement program offered in a primarily residential neighborhood where 51 % or more of the residents have incomes that do not exceed 80% of the Area Median Income for the plumbing expenses associated with replacement of the individual lead water service pipe; and WHEREAS, in achieving this goal, the City of Evanston declares that any and all lead pipe replacement is deemed a benefit for the public. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF EVANSTON, COOK COUNTY, ILLINOIS: SECTION 1: The foregoing recitals are incorporated herein by reference as though fully restated. benefit. SECTION 2: The City declares that lead pipe replacement is a public -2- 34-R-21 SECTION 3: That this Resolution 34-R-21 shall be in full force and effect from and after its passage and approval in the manner provided by law.
