A RESOLUTION
Authorizing the City Manager to Sign a Certification Statement for a
Boat Access Area Development Program (BAAD) Grant Application for
the Church Street Boat Ramp Renovations Project
WHEREAS, the Boat Access Area Development Program (hereinafter,
"BAAD") Grant is a state -financed program operated by the Illinois Department of
Natural Resources;
WHEREAS, a BAAD Grant can be requested for acquisition and/or
• construction / renovation of approved public boat, and canoe access areas in Illinois;
• WHEREAS, the BAAD Grant Program operates on a reimbursement basis
providing up to one hundred percent (100%) assistance for approved project costs, with
a maximum award of two hundred thousand dollars ($200,000.00);
WHEREAS, an applicant, as part of its proposal, must adopt and submit a
Certification Statement by September 1, 2013, certifying and acknowledging that it has
the financial resources to complete and operate/maintain the proposed project facility
per terms imposed by the Department of Natural Resources and the approved Project
Agreement;
WHEREAS, the City's Department of Public Works is preparing a grant
proposal for the Church Street Boat Ramp Renovations Project (the "Project"); and

WHEREAS, the CityCouncil designated three hundred and fifty thousand •

dollars ($350,000.00) in property tax -supported bond money in the FY 2013 Capital •
Improvement Program to provide funds for the Project.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
THE CITY OF EVANSTON, COOK COUNTY, ILLINOIS:
SECTION 1: That the foregoing recitals are hereby found as fact and
incorporated herein by reference.
SECTION 2: That the City Council adopts the State of Illinois BAAD Doc-5
Certification Statement attached hereto as Exhibit A and incorporated herein by
reference.
SECTION 3: That the City Manager is hereby authorized to sign, and the
City Clerk herby authorized to attest, on behalf of the City of Evanston, the Certification •
Statement and the Grant Application to apply for a BAAD Grant for the Project. •
SECTION 4: That the City Manager is hereby authorized and directed to
negotiate any additional conditions of the Certification Statement and Grant Application
as may be determined to be in the best interest of the City.
SECTION 5: That this Resolution shall be in full force and effect from and
after its passage and approval in the manner provided by law.

As the official duty designated to represent the C�y of Evanston . I do hereby

certify that the governing body of the project sponsoring agency has authorized submittal of the herein application, and the
information presented in this grant application is true and correct. I do further certify that the project, if approved for financial
assistance through the State of Illinois' Boat Access Area Development grant program will be completed in accordance with all
applicable local and State laws and that the City of Evanston has the financial resources to

satisfactorily complete and operate/maintain the proposed project facility per teens imposed by the Department of Natural
Resources as set forth in IL Adm. Code 3035 and the approved Project Agreement
Failure to complete an approved project within a specified time frame can result in project termination. It is finther understood
that project termination resulting from a failure to execute a project in a timely manner OR for non-compliance with program
regulations by the project sponsor OR failure to proceed with an approved project because of insufficient local funds or a change
in local priorities shall result in the project sponsor being ineligible for DNR grant funding consideration for a two year period
following project termination.
The City of Evanston does hereby fiuther certify that it will indemnify, protect and

hold harmless the State of Illinois. Department of Natural Resources and its representatives from any and all liabilities, costs,
damages or claims arising as a direct or indirect result of the construction; operation or maintenance of the above -referenced
project, and that the proposed facility will be operated and maintained in an attractive and safe manner and open and available
to the public without regard to race, color, sex, national origin, age or disability. This Certification Statement was duly considered
and acted upon and adopted by the CA of Evanston
