A RESOLUTION
Ratifying the Building Official's Modification
of Section 1009.3 of the
2003 International Building Code
as It Pertains to 415 Howard Street

WHEREAS, the City of Evanston has adopted the 2.003
International Building Code _(the "IBC"), with amendments, pursuant to Title 4,
Chapter 2 of the Evanston City Code of 1979, as amended; and
WHEREASi Section 104.1& of the IBC grants the City's Building
Official the authority to:
grant modifications, for individual cases, upon application of the
owner or owner's representative, provided the building official shall
first find special individual reason makes the strict letter of this code
impractical and the modification is in compliance with the intent and
purpose of this code and that such modification does not lessen
health accessibility, life and fire safety, or structural requirements;
and
WHEREAS, the City Building Official has, pursuant to said authority
and after making the necessary determinations, granted such a modification to
the property commonly known as 415 Howard Street, Evanston, Illinois (the
"Subject Property"), with regards to Section 1009.3 of the IBC, which regulates
the tread depth of egress stairs; and

NOW BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY •
OF EVANSTON, COOK COUNTY, ILLINOIS:
SECTION 1: That the City Council hereby ratifies the City Building
Official's modification of Section 1009.3 of the 2003 International Building Code
as it pertains to the property commonly known as 415 Howard Street, Evanston,
Illinois, attached hereto as Exhibit A and incorporated herein by reference.
SECTION 2: That this resolution shall be in full force and effect
from and after its passage and approval in the manner provided by law.

RE: 415 Howard, Stair Tread Deptlf Modification

On May ls`, 2008, pursuant to the 2003 ICC International Building Code, Section 104.10, •
"Modifications," the Building Official of the City of Evanston granted the above -
referenced building a modification to Section 1009.3 of the IBC, which requires stair
tread to be no less than I V deep (see attached). As built, the egress stairs have a
minimum tread depth of 10". The 10" tread depth is allowed in another section of the
code for stairs within a dwelling unit, therefore the modification has been determined to
be in compliance with the intent and purpose of the code and in satisfaction of the criteria
set forth in said Section 104.10. All other code requirements for the egress stairs under
2003 ICC International Building Code Section 1009 Stairways and Handrails have been _
met. The Certificate of Occupancy for the building was subsequently issued on
September 3, 2008. Said modification shall be irrevocable and shall benefit any assigns
and/or successors in interest.
